Fiscal Impact Upon sale of the property, the proceeds wauld go to the Public Works Departmen�. The sales price must be supported by a Broker's Opinion of Va1ue. Alte�native Action The City Council could choose not to sell the property and the City of Redding (City) would continue to hold fu11 responsibility for the property and its upkeep. Report to Redding City Council March 27, ZOZ4 Re: 4.12(g)--Adopt Reso declaring 3030 Crossroaa's Exempt Surplus Property and Authorizing sale Page 2 Background/Analysis On November 20, 2018, the Board of Administrative Review considered and approved Site Development Permit SDP-2018-01067 granting approval for the construction of a convenience gas mart. This permit requires the owner to vacate excess right-of-way along Old 44 Drive in order to accommodate proposed improvements. The excess right-of-way is currently being considered for Summary Vacation (A-2023-01097). A portion of the underlying fee ownership of the land within the excess right-of-way belongs to the City. City fee ownership was acquired from the Shasta County when the Annexation #83-6 was adopted in 1986. Shasta County acquired ownership by relinquishment from the State Lands Commission after State Highway 44 and Old Oregon Trail interchange improvements were completed. The property is described in Exhibit A and depicted on Exhibit B. It is located on the Southeast corner of 01d 44 Drive and Old Oregon Trail and contains11,302 square feet. Since the property is incapable of independent development, it is appropriate to use a Broker's Opinion of Value to set the sales price. The City would retain any easements necessary to maintain access to public works infrastructure with the sale of the property. Pursuant to State of California legislation, parcels must be designated surplus by adhering to specific surplus property procedures. The City has complied with Government Code Section 54220 and has fulfilled the requirements set by the California Department of Housing and Community Development to ensure the law is adhered to with regard to the sale of surplus properties, including the property located at 3030 Crossroads. No further actions are needed to proceed with the disposition of the property. Environmental Review Staff has reviewed the activity and has determined that it is categorically exempt from environmental review under the California Environmental Quality Act Guidelines, pursuant to Section 15312 - Surplus Government Property Sales. Class 12 projects consist of the sale of surplus properties, except for the sale of land in areas of statewide, regional, or areawide concern. This City-owned property is not located in an area of concern, and the sale has no potential to have a significant effect on the environment. Attachments ^Resolution ^Location Map ^Exhibit A ^Exhibit B NOE Summary Vac &Exempt Surplus Property RESOLUTION NO. 2024- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING PROPEI2TY AS EXEMPT SURPLUS PROPERTl', SUBJECT TO THE RETENTION OF ANY EASEMENT(S),IF REQUIRED, FOR PUBIC SERVICES UTI�LITIES AND AUTHORIZING THE CTTY MANAGER, OR DESIGNEE, TO NEGOTIATE THE TERMS OF THE SALE OF SAID PROPERTI'AND EXECUTE ANY OTHER DOCUMENTS NECESSARY TO EXECUTE THE SALE WITH THE BUYER WHEREAS, the City of Redding is the owner of real property(the "Property") described in Exhibit"A" and depicted in Exhibit`B;" and WHEREAS, the subject property is used as excess right of way; and WHEREAS, the Surplus Property Act (California Government Code section 54220 et seq.) provides guidelines for localities to follotiv regarding the sale and lease of City-owned property; and WHEREAS, Government Code section 54221(b) requires that a local agency shall, at a regular public meeting, declare land as either "surplus land" or "exempt surplus land" before it may take any action to dispose of the land; and WHEREAS, the surplus property meets the definition of 'Bxempt" under Government Code Section 54221 (�(1)(B): "Surplus land that is less than one-half acre in area and is not contiguous to land owned by a state or local agency that is used for open-space or low- and moderate-income housing purposes;" and WHEREAS, the property is appro�mately 11,302 square feet or approximately 0.25 acres; and WI�EREAS,the property is not listed in a coastal zone, adjacent to a historical unit of the State Parks System, listed or determined by the State Office of Historic Preservation to be eligible for the National Register of Historic Places, or within the Lake Tahoe region as defined in Section 66905.5, as described in Government Code section 54221(�(2)(B). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES I�EREBY RESOLVE THAT: 1. The above recitals are true, correct, and are adopted herein as findings of fact. 2. The Property is declared exempt surplus property, subject to the retention of any easement(s), if required, for public service purposes. 3. Sale of the Property by the City is categorica]1y exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15312 of the CEQA Guidelines (Surplus Government Property Sales).
