SUBJECT: 4.11(a)--Update Regarding Emergency Repair and Replacement of Substandard

Recommendation
Accept update regarding the Emergency Repair and Replacement of Substandard Sewer Pipe and
Failing Asphalt Concrete Pavement on Placer Street Project and, in accordance with Public
Contract Code Section 22050(c)(1), make a determination by a four-fifths vote that there is a
need to continue the emergency work.
Fiscal Impact
The Emergency Repair and Replacement of Substandard Sewer Pipe and Failing Asphalt
Concrete Pavement on Placer Street Project (Project) costs wi11 be funded by the City of
Redding's (City) Wastewater, Water, and Streets Divisions. The updated, estimated total project
cost of the repairs is $3,405,000.
Alternatzve Action
The City Council (Council) may choose not to accept the project status report and provide
further direction to staff.
Backg�ound/AnaZysis
On May 7, 2024, Council adopted an emergency resolution for the project and autho�ized the
negotiation of an emergency public works eontract. Cox & Cox Construction (Contractor)
completed all underground repairs at a11 locations by August 30, 2024. The contractor also
completed repaving of Placer Street on September 9, 2024. The remaining work to be performed
includes, restriping of Placer Street and various locations around Placer Street, Court Street and
Tehama Street along with the raising of manhole and valve lids along Placer Street. All
remaining items of work are anticipated to be completed by mid-October 2024, with final project
closeout befare the end of the calendar year.

The below table provides further details of the contractor's progress based on the number of
locations that need to be addressed and estimated costs. Costs billed through August 2024, are
$1,040,697. Staff will continue to update Council as the project progresses.

The project proposes to replace substandard sewer pipe, associated infrastructure, failing asphalt
concrete and other miscellaneous public health and safety work, on Placer Street and within the
Magnolia Area Sewer Improvement Phase I project limits.
Environmental Review
This action is not a project as defined by the California Environmental Quality Act (CEQA) and
no further action is required. On May 7, 2024, the Council determined that the project is
categorically exempt from environmental review under the CEQA Guidelines, per Section
15269(b)-Emergency Projects.

SUBJECT: 9.11(f�--Emergency Construction Contract to Repair and Replace Substandard
Sewer Pi e and Failin As halt Concrete Pavement on Placer Street
Recommendation
Authorize the following actions relative to the Emergency Repair and Replacement of
Substandard Sewer Pipe and Failing Asphalt Concrete Pavement on Placer Street Project
(Proj ect):
(1) Adopt Resolution, by not less than four-fifths affirmative vote, authorizing the City
Manager to negotiate and award an emergency public works contract for the Project in an
amount not to exceed$2,000,000;
(3) Authorize the City Manager, or designee, to approve construction contingency amounts
up to a total of$300,000;
(4) Authorize the City Manager, or designee, to approve construction management and
inspection amounts up to a total of$175,000; and
(5) Find that the Project is exempt from review under the California Environmental Quality
Act Guidelines,pursuant to Section 15269(b)—Emergency Projects.
Fiscal Impact
The estimated Emergency Repair and Replacement of Substandard Sewer Pipe and Failing
Asphalt Concrete Pavement on Placer Street Project (Project) total cost is $2,475,000. These
costs include construction, construction contingency and staff time for construction management
and inspections. The project will be funded with remaining Magnolia Area Sewer Improvements
Phase 1 funds. Including withheld retention, liquidated damages and uncompleted work items
which is approximately $2,160,000. Supplemental funding of $315,000 wi11 come from the
Wastewater, Water and Streets Division's Fiscal Year 2023-24 budgets which have sufficient
funds appropriated.

Alternative Action
The City Council (Council) may choose to not authorize the award of an emergency contract,
and instead have staff prepare plans and specifications to award a contract to the low bidder in
accordance with state and ]oca] contracting procedures. Or, Council could provide alterative
direction to staff.
Background/Analysis
On April l, 2024, Council voted to enter into a Contract Amendment, Settlement Agreement and
Release with the contractor for the Magnolia Area Sewer Improvements Phase 1 project. This
settlement agreement was partially due to the contractor's refusal to make required repairs to
substandard work done on the project. This substandard work has the potential to create public
health and safety issues.
Staff has considered repackaging the project plans and specifications for bidding; however, this
process would likely require a minimum of six months in order to obtain an executed contract
and ultimately provide a contractor with a notice to proceed. This timeline is unacceptable given
the condition of the installed sewer infrastructure and would jeopardize being able to complete
all the repair work, including re-paving Placer Street, prior to the onset of winter. In addition,
current Magnolia Area Sewer Improvement Phase 1 project site conditions present potential
impacts to public health, property and safety. Therefore, staff proposes an einergency contract to
replace the substandard sewer pipe and associated infrastructure, failing asphalt concrete and
minor associated public health and safety work on Placer Street and within Magnolia Area Sewer
Improvements Phase 1 project limits. Staff estimates the work wi11 be complete within four
months of commencement of construction activities.
It is noted that the Public Contract Code (PCC) (Section 20168) provides that the local
government's legislative body may pass a resolution by a four-fifths vote of its members
declaring that the public interest and necessity demand the immediate expenditure of public
money to safeguard life, health and property. Further, the PCC (Section 22050)provides that"in
case of emergency, a public agency, pursuant to a four-fifths vote of its governing body, may
repair or replace a public facility, take any directly related and immediate action required by that
emergency, and procure the necessary equipment, services, and supplies for those purposes
without giving notice for bids to 1et contracts."
It is in the public's interest and necessity to repair the sewer system,pave Placer Street and repair
or replace other associated minor items of work immediately to ensure protection of the public's
health, safety and personal property occurs.
The Resol�ution has been approved as to form by the City Attorney.
Environmental Review
Staff has determined that the project is exempt from review under the California Environmental
Quality Act Guidelines, pursuant to Section 15269(b) — Emergency Projects. Section 15269(b)
includes emergency repairs to publicly and privately-owned service facilities necessary to
maintain service essential to the public health, safety, or welfare. The emergency repair and
replacement will occur in areas of previous disturbanee, and the repairs are necessary to maintain
service essential to public health.

A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF REDDING TO
AUTHORIZE TI�E CITY MANAGER TO AWARD AN EMERGENCY
CONSTRUCTION CONTRACT TO REPAIR AND REPLACE SUB-
STANllARD SEWER PIPE AND FAILING ASHPFIALT CONCRETE
PAVEMENT ON PLACER STREET
WHEREAS,Public Contract Code section 22050 and Redding Municipal Code 4.22.120(A)_provide that,
in the case of emergency, a public agency may repair or replace a public facility, take any directly related
and immediate action required by that emergency, and procure the necessary equipment, services, and
supplies for those purposes without giving notice for bids to]et contracts; and
WHEREAS,on April l,2024,Council voted unanimously to enter into a Contract Amendment, Settlement
Agreement and Release regarding the Magnolia Area Sewer Improvements—Phase I proj ect; and
WHEREAS, portions of the underground sewer improvements constructed as part of the Magnolia Area
Sewer Improvements —Phase I project were not constructed in accordance with the contract documents;
and
WHEREAS,proper sewer infrastructure is critical to public health; and
WHEREAS,if not repaired immediately,the improperly installed sewer infrastructure has a high potential
for failure during high-flow periods,winter,potentially ultimately causing significant disruptions in service,
failures and damage to assoeiated public and adjacent private infrastructure; and
WHEREAS, Placer Street is a primary arterial with moderate traffic volumes and the asphalt concrete
pavement is in a failing condition as a result of longitudinal and transverse sewer trench pavement patches
within the roadway section presenting a public safety concern; and
WHEREAS, a competitive solicitation for bids is anticipated to require six(6)months and would further
delay the needed repairs to prevent sewer blockages,sink holes and further damage to the public and private
infrastructure unti12025; and
WHEREAS,continued pavement failure and blockage of the sewer conveyance system would threaten the
safety and property of roadway users and persons nearby; and
WHEREAS, isolation of the impacted area so that the delay due to competitive bidding could be
accommodated would not mitigate or eliminate the threat to persons and property;
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The City Council of the City of Redding finds that the recitals set forth above are true and correct
and are hereby adopted as findings of fact.
2. The public interest and necessity require the immediate expenditure of public money to restore the
sewer conveyance system to full capacity,protect the public health,safety and welfare,and prevent
further damage to the roadway.
3. The City Council of the City of Redding therefore authorizes the City Manager to award an
emergency construction contract to repair the sewer system and roadway along Placer Street.
4. The action authorized herein shall be reviewed by the City Council at all regular meetings of the
Council until such time as the City Council determines that the emergency is abated.
