Fiscal Impact The current budget provides $88,000 for the Consolidated General Municipal Election to be held November 5, 2024. This figure represents an estimate - as actual election costs are unknown until the conclusion of the election and costs are allocated accordingly. Alternative Action The City Council (Council} could decline to adopt the resolutions and provide alternative direction to staff. Backg�ound/AnaZysis The City of Redding (City) Municipal Code Section 2.1'7.010 states the general municipal election shall be consolidated with and held on the same day as the statewide general election. At the election to be held on Tuesday, November 5, 2024, two City Council Member positions and the City Treasurer position wi11 appear on the ballot. Report to Redding City Council June 14,2024 Re: 4.12(a)--Resolutions re November 5,2024, General Municipal Election Page 2 Traditionally, the City has contracted with the County of Shasta to provide consolidated election services. Therefore, pursuant to the State of California Elections Code Section 10403, the City must adopt a resolution requesting that the Board of Supervisors of the County of Shasta to consolidate the elections. The nomination period begins Monday, July 15, 2024, and closes at 5:00 p.m., Friday, August 9, 2024. If an incumbent does not file nomination papers by the close of the nomination period, the filing deadline will be extended to 5:00 p.m. on Wednesday, August 14, 2024, only for non- incumbent candidates for that office. In accordance with Elections Code Section 1330'7, and to ensure candidates are aware of the City's standards relative to the nomination process, staff recommends that the Council adopt a resolution providing standards for candidates for elective office. The resolution includes the following: • Candidate statement requirements, as well as cost; and • Ballot designation regulations. Environmental Review This is not a project defined under the California Environmental Quality Act, and no further action is required. Attachments ^Resolution - Candidates Standards ^Resolution - Consolidation ^AMENDED Resolution - Consolidation RESOLUTION NO. 2024- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING, CALIFORNIA, ADOPTING STANDARDS FOR CANDI�DATES FOR ELECTIVE OFFICE FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 5, 2024 WHEREAS, in accordance with Redding Municipal Code Section 2.17.010, the City of Redding's (City) general municipal election shall be consolidated with and held on the same day as the statewide general municipal election; and WHEREAS, Section 13307 of the State of California Elections Code (Elections Code) provides that the governing body of any local agency adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs of the candidate's statement; and WHEREAS, the City wishes to establish standards for candidates to follow for said election, including, but not limited to, candidate statement, ballot designation, and deadline for filing nomination papers; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER,AS FOLLOWS: l. The nomination period begins Ju1y 15, 2024, and ends August 9, 2024, and may be extended to August 14, 2024. Pursuant to Elections Code Sections 10220- 10225, nomination papers are to be filed with the City Clerk d�uring regular business hours as posted, not later than Friday, August 9, 2024. 2. Pursuant to Elections Code Section 13307, each candidate for elective office to be voted for at the election to be held on Tuesday, November 5, 2024, may prepare a candidate statement on an appropriate form provided by the City Clerk. The statement may include the name, age, and occupation of the candidate and a brief description of no more than 200 words of the candidate's education and qualifications expressed by the candidate himself or herself. It may not, however, include the party affiliation of the candidate, nor membership or activity in partisan political organizations. The statement shall be filed, in typewritten and electronic format, in the office of the City Clerk at the time the candidate's nomination papers are filed, along with the estimated fee, The statement may be withdrawn, but not changed, during the period of filing nomination papers and until 5:00 p.m. of the next working day after the close of the nomination period. 3. The City C1erk shall estimate the total cost of printing and handling the candidate statements. The estimate approximates the actual cost that varies from one election to another election and may be significantly more or less than the estimate, depending on the actual number of candidates filing statements. Accordingly, the City C1erk is not bound by the estimate and sha11, on a pro rata basis, bill the candidate for additional actual expense or refund any excess paid depending on the final actual cost. In the event of underpayment, the City Clerk shall require the candidate to pay the balance of the cost incurred. In the event of overpayment, the City C1erk shall refund the excess amount paid. If the candidate alleges that he or she is indigent and unable to pay the costs, the provisions of Elections Code Section 13309 sha11 apply. 4. The City C1erk is to utilize the Secretary of State's ballot designation regulations as the City's standard. 5. No eandidate will be permitted to include additional materials in the sample ballot package. 6. The City Clerk is directed to provide each candidate or the candidate's representative a copy of this Resolution at the time nominating petitions are issued. CURTIS, City Attorney RESOLUTION NO. 2024- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING REQUESTING THAT THE BOARD OF SUPERVISORS OF THE COUNTY OF SHASTA CONSOLIDATE A GENERAL MUNICIPAL ELECTION WITH THE STATEWIDE GENERAL ELECTION ON TUESDAI', NOVEMBER 5, 2024 WHEREAS, pursuant to Redding Municipal Code Section 2.17.010, the City of Redding's (City) general municipal election sha11 be held on Tuesday, November 5, 2024; and WHEREAS, it is desirable that the general municipal election be consolidated with the Statewide General Election to be held on Tuesday, November 5, 2024, and that, within the City, precincts, polling places, and election officers of the two elections be the same, and that the Shasta County Election Department canvass the returns of the general municipal election, and that the election be held in all respects as if there were only one election; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER, AS FOLLOWS: 1. (c} The consolidated election will be held and conducted in a manner prescribed in California Elections Code Section 10418. 2. The County Election Department is authorized to canvass the returns of the general municipal election. The Election shall be held in all respects as if there was only one election and only one form of ballot sha11 be used. 3. The Board of Supervisors is requested to issue instructions to the County Election Department to take any and all steps necessary for holding the consolidated election. 4. The City recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for the City's share of all reasonable costs. 5. The City Clerk is hereby directed to file a certified copy of this Resolution with the Board of Supervisors and the County Elections Department of the County of Shasta.
