HomeMy WebLinkAboutReso 2005-120 - NCPA -- e RESOLUTION NO. 2005-120 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AUTHORIZING FORMATION OF A JOINT POWERS AUTHORITY WITH THE NORTHERN CALIFORNIA POWER AUTHORITY (NCP A) TO FURTHER TRANSACTIONS AND ACTIVITIES IN CONNECTION WITH THE PRODUCTION, PROCUREMENT AND/OR SALE OF ELECTRIC POWER, ENERGY, FACILITIES AND RESOURCES. WHEREAS, the City of Redding along with NCPA desire to enter into a Joint Exercise of Powers Agreement for the formation of a Joint Powers Authority (JP A) to be known as the SIERRA NEV ADA ELECTRIC POWER AUTHORITY (SNEP A) in order to further the Parties' mutual interest in future transactions and activities in connection with the production, procurement, and/or sale of electric power, energy, facilities and resources; and WHEREAS, the City of Redding has reviewed the attached Joint Exercise of Powers Agreement which has been prepared in accordance with and pursuant to the California Joint Exercise of Powers Act, consisting of Sections 6500 through 6599.2 of the Government Code ofthe State of California; and NOW, THEREFORE, IT IS RESOLVED by the City Council that the Council ofthe City of Redding approves the following: 1. Formation of Joint Powers Authority. The Council authorizes the creation of a joint powers authority between the City and NCP A, to be known as the SIERRA NEVADA ELECTRIC POWER AUTHORITY (SNEP A). The Council approves and authorizes the Mayor to execute and the City Clerk to attest a joint exercise of powers agreement forming the joint powers authority, in substantially the form on file with the City Clerk, together with any minor changes deemed advisable by the City Attorney. 2. Official Actions. The Mayor, City Manager, the Director of the Redding Electric Utility, the City Clerk, and all other proper officers of the City are authorized and directed to take all actions and do all things necessary or desirable hereunder with respect to the formation of the joint powers authority, including but not limited to the execution and delivery of any and all agreements, certificates, instruments, and other documents, which they, or any of them, may deem necessary or desirable and not inconsistent with the purposes of this resolution. 3. Board Appointments. In accordance with Section 3.B. ofthe Joint Exercise of Powers Agreement, as the Redding Electric Utility Director, Mr. James Feider shall serve on behalf ofthe City of Redding on the Board of Directors for SNEPA in an ex ojjicio capacity and the City of Redding's second board member to serve on behalf of the City of Redding is hereby appointed by the City Council to be Tim Nichols, Assistant Director-Resource Planning. o U\ \ - g . -- . " e 3. Effective Date. This Resolution shall take effect immediately upon its adoption and the JPA shall be deemed effectively formed in accordance with the terms of Section 18 of the Joint Exercise of Powers Agreement.
