(2) ORDERING THE LEVY OF THE ANNUAL ASSESSMENTS FOR FISCAL YEAR 2005-2006 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 (COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE). WHEREAS: A. On July 19, 2005, by Resolution 2005-93, the City Council approved the Report of the Engineer as filed relating to Landscape Maintenance District "C" (District) and gave notice of the time and place of the August 2,2005, public hearing regarding the levy and collection of assessments for Fiscal Year 2005-2006. B. A map of each area in the District is attached and made a part hereof. C. The public hearing, duly and properly noticed, commenced at the City Council Chambers, 777 Cypress A venue, Redding, California, on August 2, 2005, and was concluded prior to the adoption of this resolution. At the public hearing, the City Council gave every interested person an opportunity to object to the proposed assessments. D. All legal prerequisites to the adoption ofthis resolution have occurred. THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. The matters set forth' above are true and correct. 2. The maps of the assessment district contained in the Engineer's Report are confirmed. 3. The City Council has considered all oral statements and written protests or communications made or filed by interested persons at the public hearing of August 2, 2005, and expressly overrules any and all protests filed objecting to the proposed assessments to be levied in the District. 4. The City Council finds that the Engineer's Report has fairly and properly apportioned the costs of the improvements to each lot/remaining parcel of land in the district in proportion to the estimated benefits to be received by each lot/remaining parcel ofland from the improvc~ments. 5. An assessment of $7.46 against each developable lot/remaining parcel located within the e e District for Fiscal Year 2005-2006 is adopted and confirmed, except that an assessment shall nO,t be levied on property owned by a Federal or State governmental agency or another local agency. 6. The City Clerk shall forthwith transfer to the Auditor-Controller and the Assessor-Recorder of Shasta County a certified copy of this resolution and a certified copy of the assessment district maps contained in the Engineer's Report for Landscape Maintenance District "C." 7. That the City Clerk shall give notice of said hearing pursuant to the Streets and Highways Code Section 22626(a).
