RESOLUTION NO. 2005-105
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PORTION EXCESS RIGHT OF WAY
LOCATED WITHIN 9M DANA DRIVE (A-8-05)
WHEREAS:
A. The portion being considered for summary vacation was acquired by dedication in
1979 with the recording of Par cd Map PM-4-79.
B. This portion of street right-of-way has not been used for the purpose for which it
was dedicated or acquired within the last five years.. Therefore, the owner of the property has
asked that the City vacate this portion of street right-of-way, described in Exhibit "A" and shown
hatched on Exhibit "B," attached and made a part hereof by reference.
C. The Engineering Division of the Development Services Department has advised the
City Council that there are no in-place public utility facilities that are in use or that would be
affected by the proposed vacation described in Exhibit "A" and shown hatched on Exhibit "B."
NOW, THEREFORE~I THE CITY COUNCIL DETERMINES, RESOL W:S AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2. The City Council approves the request to summarily vacate the portion of right-of-way
described in Exhibit "A" and shown hatched on Exhibit "B."
3. This portion of street right-of-way has not been used for the purpose for which it was
dedicated or acquired for five consecutive years immediately preceding this vacation.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.

LAND DESCRIPTION
All that portion of the SE 1A of Section 31, Township 32 North, Range 4 West, M.D.B. & M.
more fully described as follows;:
Commencing at the 1A Corner common to Sections 31 and 32, Township 32 North, Range 4
West, M.D.B. & M. as shown on that Record of Survey recorded July 7, 1988, at Book 48 of
Land Surveys at page 15; thence S 880 28'09" W, 276.85 feet, more or less, to the point of
intersection with the extension of the west line of that Parcel "A" as approved by Lot Line
adjustment 50-88 as shown thereon; thence southerly along said westerly extension of said line
to a point which lies 42.00 feet south of (measured at right angles to) the centerline of Dana
Drive as shown on said Record of Survey; thence easterly parallel with the extension of the
centerline of said Dana Drive, N 880 28'09" E, 221.81 feet to the Point of Beginning, thence
continuing along the line of said extension, N 880 28'09" E, 20.02 feet to the beginning of a
curve, concave southwesterly, having a radius of 10.00 feet, thence southeasterly and
southerly along said curve through a central angle of 90003 '37", an arc length of 15.73 feet;
thence southerly, parallel with the section line common to Sections 31 and 32, S 1028'14" E,
20.02 feet to the cusp of a curv(: concave southwesterly, having a radius of 30.00 feet, thence
northerly and northwesterly along said curve through a central angle of 90003 '37", an arc
length of 47.16 feet to the Point of Beginning.
