The portion being considered for summary vacation was acquired by dedication in 1979 with the recording of Par cd Map PM-4-79. B. This portion of street right-of-way has not been used for the purpose for which it was dedicated or acquired within the last five years.. Therefore, the owner of the property has asked that the City vacate this portion of street right-of-way, described in Exhibit "A" and shown hatched on Exhibit "B," attached and made a part hereof by reference. C. The Engineering Division of the Development Services Department has advised the City Council that there are no in-place public utility facilities that are in use or that would be affected by the proposed vacation described in Exhibit "A" and shown hatched on Exhibit "B." NOW, THEREFORE~I THE CITY COUNCIL DETERMINES, RESOL W:S AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. 2. The City Council approves the request to summarily vacate the portion of right-of-way described in Exhibit "A" and shown hatched on Exhibit "B." 3. This portion of street right-of-way has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding this vacation. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
