RESOLUTION NO. 2005-121
LANDSCAPE MAINTENANCE DISTRICT "J"
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING TErE REPORT OF THE ENGINEER AS FILED, AND
DECLARING ITS INTENTION TO:
(1) ORDER THE FORMATION OF TERRITORY INTO A LANDSCAPE
MAINTENANCE DISTRICT, TO BE KNOWN AS LANDSCAPE
MAINTENANCE DISTRICT "J."
(2) SET A PUBLIC HEARING DATE RE LANDSCAPE MAINTENANCE
DISTRICT "J."
(3) LEVY AND COLLECT ASSESSMENTS IN DISTRICT "J" FOR
FISCAL YEAR 2006, PURsuANT TO THE LANDSCAPING AND
LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500
OF THE STREIETS AN][) HIGHWAYS CODE.
WHEREAS:
A. On this date, the City Council adopted a Resolution initiating proceedings for the formation
of LANDSCAPE MAINllENANCE DISTRICT "J" (District) under authority gnmted by
the Landscaping and Lighting Act of 1972, as set forth in Part 2 of Division 15 of the Streets
and Highways Code of the: State of California
B. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code
Section 22565, et seq., setting forth a full and detailed description of the improvements, the
boundaries of the proposed assessment district and any zones therein, any bonds or notes to be
issued, and the proposed assessments upon assessable lots and parcels of land within the
proposed district.
C. The purpose of the proposed District, which is generally located adjacent to th{: Sunset
Avenues Subdivision, Unit 1, along Sunflower Drive and Buenaventura Boulevard, is to
provide maintenance to those landscaping improvements.
D. The City Council intends to levy the proposed special assessment based on a unifoml special
benefit and assessment methodology over all developable lots within the proposed District.
E. Only costs for maintenance oflandscaping; repairs to the irrigation system; electric and water
charges; replacement of vegetation as necessary; and any and all incidental expenses, including
administrative costs and a contingency fund, in connection therewith will be assessed,
including a contingency for an annual automatic cost escalation, which shall be tied to the
"20 Cities Construction Cost Index" from the most recent June Engineering News Record and
shall become effective July 1, 2006, and every July thereafter.
F. This Resolution is made in satisfaction of those requirements set forth in the Streets and
Highways Code Section 22624.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT:
1. The foregoing recitals are true and correct.

2. Pursuant to the Streets and Highways Code Section 22586, the City Council hereby approves
the Report of the Engineer, as filed with the City Clerk, containing a full and detailed
description of the improvements; the boundaries of proposed LANDSCAPE
MAINTENANCE DISTRICT "J" and any zones therein; any bonds or notes to be issued;
and the proposed assessmt:::nts upon assessable lots/parcels within said district.
3. A public hearing will be held on Tuesday, November 1, 2005, at the hour of7 p.m., or as soon
thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress
A venue, Redding, Califomia, to address the levy of the proposed assessment for Fisc:al Year
2005-2006. The proposed assessment for Fiscal Year 2006 is $464.22.
4. Only costs for the vegetation management and maintenance of landscaping; miscellaneous
lighting; mulching; vandalism; repairs to the irrigation system; electric and water charges;
replacement of vegetation as necessary; removal of trimmings, rubbish, and debris;
maintenance of the detention basin; and other improvements to remove or cover graffiti,
administrative costs, painting of any walls, and such other maintenance and incidental
expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be
assessed. Pursuant to Government Code S 53739, the amount of each fiscal year's assessment
shall be adjusted for inflation in an amount not to exceed that provided by the "20 Cities
Construction Cost Index" from the most recent June Engineering News Record and shall
become effective July 1, 2006, and every July thereafter.
5. The City Clerk shall give notice of said hearing by causing this Resolution to be pu.blished,
posted, and mailed as provided in Section 22556 of the Streets and Highways Code.
I HEREBY CERTIFY that the foregoing resolution of intention was introduced, read and adopted
at a regular meeting of the City Council on the 6th day of September 2005 by the following vote:
