Attachments ^Proclamation A C A A N '�" AY C�F'I'HE +CITY tJF REDDIl�G, Cr�I,�:FORNIA IN SUPPORT OF PRESERVATION OF THE SECOND AMENDMENT OF T�IE UNITED STATES CONSTITUTION "A well regulated Militia,being necessary to the security of a free State, the right of the people to keep and bear arms, shall not be infringed."-U.S. CONST.,Amendment II. WHEREAS, the Redding Mayor intends that this Proclamation will support and defend the rights of the people as outlined in the Second Amendment for Redding's diverse community comprising people of various ethnic, religious, and political groups with a population of over 90,000 residents who may or may not choose to own a firearm; and WHEREAS,the Redding Mayor acknowledges the Declaration of Independence as one of the foundational documents in the formation of the United States of America and affirms that all Redding residents "are created equai, that they are endowed by their Creator with certain unalienable rights,that among these are life,liberty, and pursuit of happiness...;" and WHEREAS, the Redding Mayar affirms that the U.S. Constitution was established by our founding fathers "to form a more perfect Union,establish Justice,insure domestic Tranquility,provide for the common defense,promote the general Welfare, and secure the Blessings of Liberty for ourselves and our Posterity;"and WHEREAS,the Redding Mayor acknowledges that the first 10 Amendments to the U.S. Constitution are known as the Bi11 of Rights, and that support and defense of these rights were necessary for the ratification of the U.S. Constitution by the states.Therefore,the defense and preservation of these Amendments is still important today for all Redding residents; and WHEREAS, the American people have retained the individual, pre-governmental right to keep and bear arms, Cruiskshank v U.S., 92 US 542,(1876)and"the right itself declares that it shall not be infringed,"and that right has been earlier codified into the United States Constitution, as the Second Amendinent; and WHEREAS, the right of the individual to keep and bear arms was restated in Heller v. District of Columbia, 554 US 570 (2008); and WHEREAS, the United States Supreme Court issued a decision in McDonald v. City of Chicago, 561 US 742 (2010), which unequivocally incorporated the individual rights of the Second Amendment to the various States through the Fourteenth Amendment; and WHEREAS, the decision issued by the United States Supreme Court NYSRPA v. Bruen, 597 U.S. 1 (2022), reaffirms its declarations in Helle�v D.C.,554 US 570(2008), Caetano v.Mass,577 US 5�1 (2016),McDonald v. City of Chicago, 561 US 742 (2010), that we the people of the United States, and the State of California, have the individual, pre- governmental right,to bear,or carry any firearm cormnonly owned or used for lawful purposes of defense of self,family, and community, including the defense against tyranny, for recreation, training or competition; and WHEREAS, the California Legislature passed and continues to pass unconstitutional laws which infringe upon or ban activities within the plain text of the Second Amendment outlined in Bruen, Heller, Caetano,McDonald and many other precedent cases,and the Ninth Circuit Court has been specially warned by the United States Supreme Court to stop these activities (see Justice Thomas decision NYSRA v Br�uen), and Governor Newsom recently referred to the Second Amendment as "beeoming a suicide pact" (CBS evening news,l/23/23 Nora O'Donnell interview), demonstrating his disregard for his oath of office,the taxpayer funds that are used to defend unconstitutional laws in the courts,and for the liberty of the citizens of this state; WHEREAS,the Redding Mayor supports and defends the Second Amendment, as it is written and originally intended, for all Redcling residents whether they choose to own a gun or not; WHEREAS, the Redding Mayor reserves the right to use all means at her disposal to support and defend the Second Amendment. Whil� it is th� prerogative of the various arms of the State of California to test the outer bounds of permissib�e regulation uncler the Second Amendment to the United States Constitution, it is the poliey of the Mayor of the�ity of Redding ta nat use its powers or expend its limited resources unneeessarily infringing upon the people's right to bear arms in the pursuit of questionable legal theories; and NOW,THEREFORE, as Mayor of the City of Redding,I do hereby declare that I support all discussions seeking new ideas to protect our citizens from potential violence and criminal activity,but will not support any order,provision,law, or agency initiative that violates the Constitution of the United States, the Califomia Constitution, or the Second Amendment as determined by the courts pursuant to Article III of the United States Constitution.
