Fiscal Impact Adopting the Resolution will have no fiscal impact to the City of Redding (City). All costs associated with the processing of this project are paid by the applicant. The portions of the vacated right-of-way will revert to the abutting parcels as fee owners. Alte�native Action The City Council (Council)may choose not to adopt the Resolution and not vacate these portions of Center Street and Shasta Street. BackgNound/Analysis The owner of 1242 Center Street has requested the vaeation of a portian af Center Street and a portion of Shasta Street as described in the attached Exhibit A and shown on the attached Exhibit B. Center Street and Shasta Street were originally shown on Town of Redding Plat which was filed in 1875 but were not formally dedicated. These streets are considered to be implied dedications as subsequent use by the public and expenditure of public funds for street maintenance were made. Report to Redding City Council August 14,2024 Re: 4.12(c)--Summary Vacation of a portion of Center Street ana'Shasta Street Page 2 In 2021, the City's Diestelhorst to Downtown Improvement Project realigned a portion of street improvements on Center Street. This project which constructed new curb, gutter, sidewalks, and separated bike lanes provided for bike and pedestrian facilities connecting the Sacramento River Trai1 to the downtown area. This re-alignment created an area unnecessary for street or public purposes. The area of Center Street and Shasta S�reet as described in the attached Exhibit A and depicted in the attached Exhibit B, contain no public facilities and are not needed for future public purposes. This area may be determined to be excess and eligible for summary vacation per Streets and Highways Code 8334. The Resolution has been approved as to form by the City Attorney. Environmental Review This summary vacation can be declared exempt from environmental review under the California Environmental Quality Act Guidelines Section 15305 (1Vlinor Alterations in Land Use Limitations), which allows for minor alterations to land as long as the average slope on site is less than 20 percent and would not result in any changes in land use or density. This action will not result in the creation of any new parcels nor will it change land use density. The existing General Plan and Zoning land use designations would remain as they currently exist and the average slope does not exceed 20 percent. Therefore, this summary vacation can be considered a minor alteration in land use limitations. The recitals set forth abave are true,correct and are hereby adopted as findings of fact. 2. Pursuant to Streets and Highways Code 8334, the City Council determines this portion of Center Street and Shasta Street to be excess and is unnecessary for present or prospective public street use. 3, The City Council approves the request to summarily vacate this portion of Center Street and Shasta Street adjacent to the Stockyard B1ock as shown on the Original Town of Redding,filed in the Office of the County Recorder in Book of Old Plats at Page 55, Shasta County Records as described in E�ibit"A"and shown on the attached Exhibit`B." 4. The vacation of this portion of Center Street and Shasta Street is consistent with tl�e General Plan. This action will: reduce maintenance needs of public streets; will not preclude uses consistent with current zoning; and encourages design compatible with its surroundings. 5. The vacation of this portion of Center Street and Shasta Street qualifies as Categorically Exempt froin environinental review under the California Environmental Quality Act Guidelines Section 15305—Minor Alterations in Land Use Limitations. No changes in land use or density will occur and areas affected contain an average slope of less than 20%. There is no possibility that this action will have a significant impact on the environment. 6.
