HomeMy WebLinkAboutReso. 2024-051 - Resolution setting a public hearing for LMDs D-01-22RESOLUTION NO. 2024-051 LANDSCAPE MAINTENANCE DISTRICTS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED AND DECLARING ITS INTENTION TO: SET A PUBLIC HEARING DATE REGARDING THE FOLLOWING LANDSCAPE MAINTENANCE DISTRICTS D, E, F, G, H, Hl, J, K, L, M, N, O, P, Q, R, S, S1, T, U, V, W, 01-06, 02-06, 03-06, 04-06, 05-06, 06-06, 07- 06, 08-06, 09-06, 11-06, 01-07, 02-07, 02-09, 03-09, 01-11, 02-11, 03-11, 01-13, 02-14,03-14,01-15,02-16,03-16,01-17,01-19,02-19,01-20 AND 01-22; 2. LEVY AND COLLECT ASSESSMENTS IN THESE DISTRICTS FOR FISCAL YEAR 2024-25 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA A. The City Council heretofore ordered the consolidated formation of the Landscape Maintenance Districts under authority granted by the Landscaping and Lighting Act of 1972 as outlined in Part 2 of Division 15 of the Streets and Highways Code of the State of California; and B. The purpose of these Districts is to provide maintenance to those landscaping improvements required within the public rights-of-way and/or easements by the conditions of development approval for each District and the general locations as outlined in the table below; and C. The Engineer has filed his report with the City Clerk according to Streets and Highways Code Section 22565, et seq.; and D. This Resolution is made to satisfy those requirements outlined in the Streets and Highways Code Section 22624; and E. The assessments for the Fiscal Year 2024-25 are not an increase within the meaning of Streets and Highways Code §22624 and 22630.5 because the cost of living adjustment provided for herein was approved at the time of the formation of the Districts; NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL THAT: 1. The matters set forth above are true, correct, and are adopted herein. 2. According to the Streets and Highways Code §22623, the Engineer's Report as filed is hereby approved. The Engineer's Reports, on file with the City Clerk, contain a complete and detailed description of the improvements, the boundaries of the District and any zones therein, and the proposed assessments upon the assessable acres and remaining parcels within the districts. 4. The existing improvements for each subdivision in the Districts are outlined in Part B of the Engineer's Reports on file with the City Clerk. The general locations of the acres and remaining parcels in the District are outlined in Part A of the Engineer's Reports on file with the City Clerk. 6. Only costs for the maintenance of landscaping, miscellaneous lighting, mulching, vandalism, repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, removal of trimmings, rubbish, and debris, maintenance of the detention basin, and other improvements to remove or cover graffiti, administrative costs, painting of any walls, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed. 7. A public hearing will be held on Tuesday, July 16, 2024, at the hour of 6:00 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress Avenue, Redding, California, to address the confirmation and approval of the proposed assessment for the Fiscal Year 2024-25. The proposed assessment for the Fiscal Year 2024-25 is outlined in the table below. The Council intends to levy said assessment in the amount also indicated in the table below for the Fiscal Year 2024-25. The City Clerk shall give notice of said hearing according to the Streets and Highways Code Section 22626(a).
