The portion being considered for summary vacation was acquired by dedication with the recording of the Boardman Addition to Redding in 1901 and with the recording of the Second Clairmont Addition to Redding in 1910. B. This portion of street: right-of-way has not been used for the purpose for which it was dedicated or acquired. Therefore, the owner of the property has asked that the City vacate this portion of street right-of-way, described in Exhibit "A" and shown hatched on Exhibit "B," attached and made a part hereof by reference. C. The Engineering Division of the Development Services Department has advised the City Council that there are in-place public utility facilities that are in use or that would be affected by the proposed vacation; therefore, the City is retaining a public-service easement over the portion of right-of-way described in Exhibit "A" and shown hatched on Exhibit "B." NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. 2. The City Council approves the request to summarily vacate the portion of right of way described in Exhibit "A" and shown hatched on Exhibit "B." 3. This portion of street right-of-way has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding this vacation. ~ .D a " e e 4. The City reserves and excepts from the vacation a public-service easement for the purpose of erecting, installing, constructing, removing, repairing, replacing, reconstructing, maintaining and using for public-service purposes any and all materials, fixtures, appliances, equipment, pipes, pipelines, wires, and cables (including fiber optics) necessary for the transmission, distribution, and delivery of electricity, water, sewer, storm water, gas, cable television, communication, and information service utilities over, along, upon, under, and across the parcel of real property described in Exhibit "A" and shown hatched on Exhibit "B." 5. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. Reading Grant, and a portion of the Second Clairmont Addition filed in Book 1 of Maps at Page 57, Shasta County Records, in the incorporated City of Redding, Shasta County, California, more particularly described as follows: Beginning at the northeast comer of that certain parcel of land designated and delineated as 16.82 acres on said Parcel Map No. LS-79-89; thence, on and along the Easterly property line of the said certain parcel, also being the West line of West Street as shown on said map, S.08015'30"E., 746.28 feet; thence, leaving said line N.81 044'30"E., 15 feet; thence, N.08015'30"W., 726.92 feet; thence, along the arc of a 20.00 foot radius tangent curve, concaved to the Southwest, through a central angle of 75031 '21 ", and an arc length of 26.36 feet to the Point of Beginning, containing 0.26 acres, more or less.
