RESOLUTION NO. 2005-76
A RESOLUTION OF THE CITY COUNCIL OF THE CiTY OF REDDING
APPROVING THE DISPOSITION AND DEVELOPMENT AGREEMENT BY
AND BETWEEN THE REDDING REDEVELOPMENT AGENCY, THE CITY
OF REDDING AND RESOURCES FOR RURAL COMMUNITY
DEVELOPMENT AND MAKING CERTAIN FINDINGS IN CONNECTION
THEREWITH
WHEREAS, the Redding Redevelopment Agency is engaged in activities necessary to
execute and implement the Redevelopment Plan for the Market Street Redevelopment
Project Area; and
WHEREAS, in furtherance of the objectives of the California Community
Redevelopment Law (California Health and Safety Code Section 33000 et seq.), the Agency
has undertaken the revitalization of the Parkview Neighborhood; and
WHEREAS, the Implementation Plan adopted by the Agency with respect to the
Redevelopment Plan includes neighborhood improvement and affordable housing activities;
and
WHEREAS, the Agency acquired the property in 1999 for future redevelopment
purposes pursuant to the Parkview Neighborhood Strategic Revitalization Plan (Parkview
Plan); and
WHEREAS, the Parkview Plan identifies the need to provide mixed-use development
on the south side of Park view Avenue; and
WHEREAS, the Parkview Plan further identifies the need to provide affordable housing
opportunitie.s in the Parkview Neighborhood; and
WHEREAS, RRCD desires to purchase property owned by the Agency located at 701-
715 Parkview Avenue (Property) for development of a mixed-use project consisting of an
approximate 1,288-square-foot office and three residential rental units affordable to low-
income individuals and families; and
WHEREAS, it has been determined that development of the Property as proposed is
consistent with the Redding General Plan, the Parkview Plan, and Parkview Neighborhood
design review criteria; and
WHEREAS, the City of Redding desires to assist development of the affordable
residential units by providing a loan of up to $418,175 in Home Rental Program funds; and
WHEREAS, the Agency, the City, and RRCD propose to enter into a Disposition and
Development Agreement; and

WHEREAS, pursuant to Section 33433 of the Community Redevelopment Law, the
Agency is authorized, with the majority approval of the City Council after a public hearing,
to convey property for redevelopment purposes pursuant to the Redevelopment Plan upon
a determination by the City Council that the sale of the property will provide housing for
low- or moderate-income persons and that the consideration for such sale is not less than
either the fair market value of the fair reuse value in accordance with the covenants and
conditions governing the sale and development costs thereof; and
WHEREAS, a joint public hearing of the Agency and the City Council on the proposed
Agreement was duly noticed in accordance with requirements of Health and Safety Code
Section 33433; and
WHEREAS, the proposed Agreement and a disposition report meeting the requirements
of Health and Safety Code Section 33433 were available for public inspection consistent with
the requirements of Health and Safety Code Section 33433; and
WHEREAS, on June 20, 2005, the Agency and the City Council held a joint public
hearing on the proposed Agreement and evaluated all of the information, testimony, and
evidence presented during the joint public hearing; and
WHEREAS, the City Council has reviewed the Disposition Report required pursuant
to Health and Safety Code Section 33433 and evaluated other information provided to it
pertaining to the findings required pursuant to Section 33433; and
WHEREAS, the sale of the property pursuant to the proposed Agreement will provide
housing for low- and moderate-income individuals and families; and
WHEREAS, the value of the consideration for the property pursuant to the proposed
Agreement will not be less than the fair market value of the site as set forth in the Disposition
Report; and
WHEREAS, the City of Redding's Development Services Director has determined that
the sale of the property for residential purposes is consistent with the Redding General Plan;
and
WHEREAS, the sale of property for infill development is categorically exempt under
Section 15332 of the California Environmental Quality Act; and
WHEREAS, the City Council has duly considered all terms and conditions of the
proposed Agreement and believes that the disposition of the Site pursuant thereto is in the
best interests ofthe City of Redding and the health, safety, and welfare of its residents, and
in accord with the public purposes and provision of applicable state and local laws and
requirements.

NOW, THEREFORE, the City Council ofthe City of Redding FINDS, RESOLVES
AND ORDERS as follows:
1. The above recitals are true and correct.
2. The City Council of the City of Redding makes the following findings in
connection with the proposed Disposition and Development Agreement:
(a) The sale of the property at 701-715Parkview Avenue will provide
housing for low- or moderate-income persons and is consistent with the
implementation plan adopted pursuant to Section 33490 ofthe California
Health and Safety Code; and
(b) The consideration is not less than the fair market value in accordance
with the highest and best use under the Redevelopment Plan.
3. The City Council ofthe City of Redding hereby approves the sale of the Property
and the provision of up to $418,175 in HOME Rental Program funding.
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted
by a majority vote at a special meeting of the City Council ofthe City of Redding on the 20th
day of June 2005.
