Code ~6103 A.P.N.073-230-19 2005-0000'930 Recorded I REC FEE .00 Official Records I County Of I SHASTA I CRIS ANDREWS J Recorder I I I ljgas 08:14AM 06-Jan-2005 I Page 1 of 4 RESOLUTION NO. 2004-194 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A PORTION OF THE WATERLINE EASEMENT DEDICATED TO THE CITY OF REDDING ON THE REDDING ELEMENTARY SCHOOL DISTRICT PROPERTY LOCATED AT 1805 SEQUOIA STREET, RECORDED IN BOOK 3074 OF OFFICIAL RECORDS AT PAGE 592 (1993-0048220), SHASTA COUNTY RECORDS, AS MORE PARTICULARLY DESCRIBED HEREIN (A-ll-03) WHEREAS: A. A waterline easement lying within the Redding Elementary School District property located at 1805 Sequoia Street was dedicated to the City of Redding by Easement Deed recorded in Book 3074 of Official Records at page 592, Shasta County Records (hereafter called the Easement). B. The owners of the property have asked that the City vacate a 962-square-foot portion of the Easement as described in Exhibit A and shown hatched on Exhibit B attached and made a part hereof by reference, as it has been superceded by relocation. C. The Engineering Division of the Development Services Department has advised the City Council that there are no in-place public-utility facilities that are in use or would be affected by the proposed vacation and that the hatched portion of the Easement is not required for public use. NOW, THEREFORE, THE CITY COUNCIL pETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: .; 1. The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. 9-:> o o k=-. \ - ..,S:) J;-.. :r " '.. e e .:2. > The City Council approves the request to summarily vacate the 962-square-foot portion of the Easement lying within the Redding Elementary School District property located at 1805 Sequoia Street, dedicated to the City of Redding by Easement Deed recorded in Book 3074 of Official Records at page 592, Shasta County Records, as more particularly described in attached Exhibit A and shown hatched on attached Exhibit B. 3. The 962-square-foot portion of the Easement has been superceded by relocation. Therefore, from and aft,er the date this resolution is recorded, the 962-square-foot portion of the Easement shall be vacated its entirety and no longer constitute an easement for waterline purposes. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. Reading Grant section 11, 12, & 13 in the City of Redding, Shasta County, California, being 15.00 feet in width and lying 7.50 feet on each side of the following described centerline: Commencing at Point 'B' described in the easement deed to the City of Redding recorded in Book 3074 of Official Records at Page 592, Shasta County Records; thence, S.14015'35"E., 514.13 feet; thence, S.37005'25"W., 59.56 feet to the TRUE POINT OF BEGINNING, thence, S.37005'25"W., 64.15 feet to the Point of Termination, from which Point 'c' as described in the above said existing easement bears, the following two courses S.37005'25"W., 26.90 feet; thence, S72017'55"W., 63.35 feet, containing 962 square feet, more or less.
