Fiscal Impact Adopting the Resolution will have no fiscal impact to the City of Redding (City). All costs associated with the processing of this project are paid by the applicant. Alternative Action The City Council may choose not to adopt the Resolution and leave this portion of Twin View Boulevard in place. Background/Analysis The portion of Twin View Boulevard being considered for summary vacation is approximately 45 square feet in area and lies southerly and adjacent to the parcel of land owned by the Applicant. This area of Twin View Boulevard was deemed to be prescriptive roadway by the State of California in 1964 when a realignment of Twin View Boulevard was necessitated by the construction of the Oasis Road interchange at Interstate 5. The applicant intends to develop his parcel of land at a future time and has requested the City to summarily vacate the portion of Report to Redding City Council February 14, 2024 Re: 4.11(c) --Adopt Reso for Summary Vacation of a Portion of Twin View Boulevard Page 2 Twin View Boulevard as described in the attached Exhibit A and depicted in Exhibit B. This portion has not been used for any public purpose since the construction of Interstate 5 and contains no public facilities. The request was coordinated by the various City departments and it was determined there is no foreseeable need for public purposes. This portion of Twin View Boulevard may be determined to be excess and eligible for summary vacation per Streets and Highways Code 8334. The summary vacation is consistent with the General Plan as it will reduce maintenance needs, not preclude uses consistent with current zoning, and will encourage design consistent with the surroundings. Environmental Review The summary vacation is consistent with the General Plan and staff have determined that it is exempt from environmental review under the California Environmental Quality Act Guidelines, pursuant to Section 15305 (Minor Alterations in Land Use Limitations). The Class 5 exemption allows for minor alterations to land use limitations, as long as the average slope on site is less than 20 percent and would not result in any changes in land use or density. This action will not result in the creation of any new parcels, nor will it change land use density. The existing General Plan and Zoning land use designations would remain as they currently exist and the average slope does not exceed 20 percent. In addition, the project area does not contain underlying values for wildlife habitat or other environmental resources. The action has no potential to have a significant impact on the environment. The portion of Twin View Boulevard being considered for summary vacation is considered prescriptive roadway and is described in Exhibit "A" and shown on Exhibit `B" attached and made a part hereof by reference. The owner of the adjacent parcel has asked that the City vacate this portion of Twin View Boulevard. B. This portion of Twin View Boulevard has not been used for roadway purposes and is not required for street or highway purposes. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: 1. The recitals set forth above are true, correct and are hereby adopted as findings of fact. 2. Pursuant to Streets and Highways Code 8334, the City Council determines this portion of Twin View Boulevard to be excess and is unnecessary for present or prospective public street use. The City Council approves the request to summarily vacate this portion of Twin View Boulevard adjacent to Parcel 2 as shown on the Record of Survey recorded in Book 43 of Land Surveys at Page 59, Shasta County Records as described in Exhibit "A" and shown on the attached Exhibit «B " 4. The vacation of this portion of Twin View Boulevard is consistent with the General. Plan. This action will: reduce maintenance needs of public streets; will not preclude uses consistent with current zoning; and encourages design compatible with its surroundings. The vacation of this portion of Twin View Boulevard Avenue qualifies as Categorically Exempt from environment review under the California Environmental Quality Act Guidelines Section 1.5305 — Minor Alterations in Land Use Limitations. No changes in land use or density will occur and areas affected contain an average slope of less than 20%. There is no possibility that this action will have a significant impact on the environment. 6. The City Clerk is directed to cause a certified copy of this Resolution of Vacation, attested by the Clerk under seal, to be recorded in the Office of the Shasta County Assessor/Recorder.
