HomeMy WebLinkAboutReso. 78-234 - Ordering the Vacation and Abandonment of 150 Feet of the West Half of Market Street North of Placer Street 411 RESOLUTION NO. 71—)3 c, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE VACATION AND ABANDONMENT OF 150 FEET OF THE WEST HALF OF MARKET STREET NORTH OF PLACER STREET . WHEREAS, proceedings have been duly conducted and held in accordance with the provisions of the Street Vacation Act of 1941 (Streets and Highways Code Sections 8300 , et seq . ) , and WHEREAS , the City Council of the City of Redding finds and determines that the hereinafter described real property is not necessary for present or prospective public street purposes , and is necessary for improvements to be constructed as part of Phase III of the Redding Downtown Mall within this area, and WHEREAS , the City Council has reviewed the Negative Declaration prepared in connection herewith, and has determined that this abandonment will create no significant effect on the environment, NOW, , THEREFORE, the City Council of the City of Redding hereby resolves and orders as follows : 1. That certain real property in the City of Redding, County of Shasta, State of California, being 150 feet of the west half of Market Street north of Placer Street, and as the same is more particularly described as follows : Beginning at the southeasterly corner of Lot 6 , Block 29 of the Original Town of Redding as shown on the map recorded March 5 , 1900 , in Book of Town Plats , at page 11 , Shasta County Records; thence along the westerly line of Market Street N. 17°40 ' W. , 150 . 00 feet to the north- easterly corner of Lot 4 of said Block 29 ; thence N. 72°20 ' E. , 40 . 00 feet to the centerline of Market Street; thence along said centerline S. 17°40 ' E . , 150 . 00 feet to the northerly line of Placer Street ; thence along said line S. 72°20 ' W. , 40 . 00 feet to the point of beginning , ty7 tfi -1- 0 0 ' be and the same is hereby vacated and abandoned as a public street , to accommodate the construction of Phase III of the Redding Downtown Mall within this area, in consideration of the- payment to ,the City of the sum of $22 , 500 . 00 by the developer of Phase III , Humboldt Financial Services, Inc. 2 . That the City retains a three foot (3 ' ) utility easement within the abandoned area as shown on the diagram which is attached hereto as "Exhibit A" . 3 . That the City Clerk of the City of Redding be and • she hereby is directed to record a certified copy of this Resolution , attested by the City Clerk under the seal of the City of Redding , in the office of the Shasta County Recorder. I HEREBY CERTIFY that the foregoing Resolution was intro- duced and read at a regular meeting of the City Council of the City of Redding on the 4th day of December , 1978 , and was duly adopted at said meeting by the following vote: AYES : COUNCILMEN: Fulton, Gard, Kirkpatrick, and Demsher NOES : COUNCILMEN: None ABSENT: COUNCILMEN: Pugh ATTEST: ALD M.
