HomeMy WebLinkAboutReso. 78-200 - Declaring its Intention to Vacate and Abandon 150 Feet of the West Half of Market Street North of Placer Street RESOLUTION NO. 7$ •,.)00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING ITS INTENTION TO VACATE AND ABANDON 150 FEET OF THE WEST HALF OF MARKET STREET NORTH OF PLACER STREET. WHEREAS, it is the intention of the City Council of the City of Redding to abandon 150 feet of the west half of Market Street north of Placer Street in the City of Redding , as the same is set forth on a map and plan on file in the office of the City Clerk of the City of Redding, said portion of Market Street being more particularly described as follows : Beginning at the southeasterly corner of Lot 6 , Block 29 of the Original Town of Redding as shown on the map recorded March 5 , 1900 , in Book of Town Plats , at page 11 , Shasta County Records; thence along the westerly line of Market Street N. 17°40 ' W. , 150 . 00 feet to the north- easterly corner of Lot 4 of said Block 29; thence N. 72°20 ' E. , 40 . 00 feet to the centerline of Market Street; thence along said centerline S . 17°40 ' E. , 150 . 00 feet to the northerly line of Placer Street; thence along said line S. 72°20 ' W. , 40 .,00 feet to the point of beginning, and WHEREAS, the said real property is depicted as the shaded area on the attached diagram, marked "Exhibit A" , and incorporated herein by reference, and WHEREAS , the abandonment of said portion of Market Street is necessary for improvements to be constructed as part of Phase III of the Redding Downtown Mall within this area, and is no longer needed for street purposes , and WHEREAS , the City Council of the City of Redding elects to proceed in this matter under the provisions of the Street Vaca- tion Act of 1951 , as the same is set forth in Section 8300 , et seq. , of the Streets and Highways Code of the State of California , with the express provision that this Resolution shall be deemed an ordinance of intention, and that the proceedings shall be taken -1- • 0 . q . subject to the reservations and exceptions recommended by the Director of Public Works , and WHEREAS, the-,City Council has reviewed the Negative r 1 Declaration prepared in connection herewith, and has determined that no significant .effect on the environment is created hereby, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows , to wit : 1. That all of the foregoing recitals are true and correct. 2 . That the City Council intends to and hereby declares its intention to vacate and abandon 150 feet of the west half of Market Street north of Placer Street, more particularly described above, all in accordance with the map or plan on file in the office of the City Clerk of the City of Redding, to which map and plan reference is hereby made for particulars as to the proposed abandonment. BE IT FURTHER RESOLVED that Monday, the 6th day of November, 1978 , at the hour of 7 : 30 P .M. , at the Police Department and City Council Chambers Building at 1313 California Street in Red- ding are hereby set as the time and place for hearing all persons interested in or objecting to the abandonment of said property. BE IT FURTHER RESOLVED that the Director of Public Works be and he is hereby instructed to post or cause to be conspicuously posted at points not more than three hundred (300) feet in distance apart and along the line of the subject street, hereinabove described, notices of this intention to vacate and abandon the above described portion of said street . Said notices shall set forth the passage of this Resolution of Intention and shall also set forth the time and place of hearing as hereinabove set forth. At least three such notices as above set forth shall be posted, in -2- 411 the manner above set forth, and posting of said notices shall be completed not less than ten (10) days prior to the date of hearing. BE IT FURTHER RESOLVED that the City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published once in a newspaper of general circulation printed in the City of Redding at least fifteen (15) days before the date set for public hearing of protests to the aforesaid proposed vacation and abandonment. I HEREBY CERTIFY that the foregoing Resolution was intro- duced and read at a regular meeting of the City Council of the City of Redding on the 16th day of October , 1978 , and was duly adopted at said meeting by the following vote : AYES : COUNCILMEN: Fulton, Gard, Kirkpatrick, Pugh, and Demsher NOES : COUNCILMEN: None ABSENT: COUNCILMEN : None \Q\\J ��/� ATTEST: Laa5 +t DONALD M.
