Code ~6103 A.P.N. 204-500-005 & 006 aCZUZl4-00S8a 1 a Recorded I REC FEE .00 Official Records I County Of I SHASTA I CRIS ANDREWS I Recorder I I I ljgas 10:32AM ll--Dct-2004 I Page 1 of 3 RESOLUTION NO. 2004-141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING THE OPEN-SPACE EASEMENT DEDICATED TO THE CITY OF REnDING ON LOTS 5 AND 6 OF THE SUNSET COURT SUBDIVISION [815 AND 800 LEISHA LANE] RECORDED IN BOOK 20 OF MAPS AT PAGE 18, SHASTA COUNTY RECORDS, AS MORE PARTICULARLY DESCRIBED HEREIN (A-4-04). WHEREAS: A. An open-space easement lying within Lots 5 an 6 the Sunset Court Subdivision, was dedicated to the City of Redding on the map recorded in Book 20 of Maps at page 18, Shasta County Records. B. The City wishes to vacate the open space lying within Lots 5 and 6 of the Sunset Court Subdivision as shown hatched on Exhibit A, attached and made a part hereof by reference, since it has not been used for the purposes for which it was dedicated or acquired for five consecutive years immediately preceding this proposed vacation. C. Pursuant to Government Code ~7050, offers of real property for open-space purposes may be terminated, and the right to accept such offers abandoned in the same manner as is prescribed for the summary vacation of Streets and Highways by Part 3 (commencing with Section 8300) of Division 9 of the Streets and Highways Code. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8330, et seq. The City Council approves the request to summarily vacate the open-space easement lying within Lots 5 and 6 of the Sunset Court Subdivision, dedicated to the City of o *"' \ ~ .;;,? 2. .( e e ij..edding on the map recorded in Book 20 of Maps at page 18, Shasta County Records, as - shown hatched on Exhibit A. . 3. The open-space easement has not been used for the purposes for which it was dedicated or acquired for five consecutive years immediately preceding this proposed vacation. Therefore, from and after the date this resolution is recorded, the area hereby vacated shall no longer constitute an easement for open-space purposes. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
