HomeMy WebLinkAboutReso. 78-180 - Declaring its Intention to Vacate and Abandon a Portion of Railroad Avenue Between Gold Street and South Street _ RESOLUTION NO. 7,5•/R(7 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF RAILROAD AVENUE BETWEEN GOLD STREET AND SOUTH STREET. WHEREAS, certain real property has been heretofore re- served for street purposes, and said property consists of Railroad Avenue in the City of Redding as the same is set forth on map and plan on file in the office of the City Clerk of the City of Redding, and a portion of said street is proposed to be abandoned, being 20 feet on the west side of Railroad Avenue between Gold Street and South Street, more particularly described as follows : Commencing at the northeast corner of Parcel 1 , as shown on that certain map for. Pacific .Gas and Electric Company, recorded in Book 7 of Parcel Maps, at page 24 , Shasta County Records, and thence S. 07°41 ' E. , on and along the east line of said Parcel 1, 0. 31 feet to the point of beginning; thence running the following bearings and dis- tances: From a tangent bearing N. 82°19 ' E. , on a 20 foot radius curve to the right, through a central angle of 90° , a distance of 31. 40 feet; thence S. 07°41' E. , and parallel with said east line , 264 . 07 feet; thence on a 20 foot radius tangent curve to the right , through a central angle of 80°01 ' a distance of 27.9''3 feet; thence S. 72°20 ' W. , 3. 52 feet to the southeast corner of Parcel 2 , as shown on said Parcel Map; thence on and along the east line of Parcels . 2 and 1 , as shown on said map, N. 07°41 ' W. , 304. 38 feet, more or less, to the point of beginning, and • WHEREAS, it is believed by and it appears to the City • Council of the City of Redding that the said above described prop- erty will not be necessary or convenient for public street purposes., and WHEREAS, the Director of Public Works of the City of Redding has duly investigated,,the proposed abandonment of the sub- + ; a ject property and has recommended to the City Council no indication that it will ever be required for public street purposes , and °p -1- O O WHEREAS, the Planning Commission of the City of Redding has held a public hearing regarding the abandonment of said prop- erty and at the conclusion of said hearing has recommended that the property be abandoned, and WHEREAS, the City Council of the City of Redding elects to proceed in this matter under the provisions of the Street Vaca- tion Act of 1941 , as the same is set forth in Section 8300, et seq. , of the Streets and Highways Code of the State of California, with the provision that this resolution shall be deemed an ordinance of intention, and WHEREAS, the City Council has reviewed the Negative Declaration prepared in connection herewith, and has determined that this abandonment will create no significant effect on the environment, 1NOW,A THEREFORE, BE _IT RESOLVED by the City Council of the City of Redding 'as follows, to wit: 1. That all of the foregoing recitals are true and correct. 2. That the City Council intends to and hereby declares its intention to vacate and abandon the above described portion of Railroad Avenue between Gold Street and South Street. BE IT FURTHER RESOLVED that all persons interested in or objecting to the proposed abandonment will be heard on Monday, the 6th day of November, 1978 , at the hour of 7 : 30 P.M. , at the City Council Chambers and Police Department Building at 1313 California Street in the City of Redding. BE IT FURTHER RESOLVED that the Director of Public Works of the City of Redding be and he is hereby instructed to post or -2- • • • cause to be conspicuously posted at points not more than three hundred (300) feet in distance apart and along the line of the property now proposed to be abandoned, notices of this intention to vacate and abandon this street right of way. Said notices shall set forth the passage of this Resolution of Intention and shall set forth the time and place of hearing as hereinabove set forth. At least three such notices as above set forth shall be posted, in the manner above set forth, and posting of said notices shall be completed not less than ten days prior to the date of hearing. BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage and adoption of this resolution of intention and shall cause the same to be published once in a newspaper of general circulation printed in the City of Redding at least fifteen (15) days before the date set for public hearing of protests to the aforesaid proposed vacation. I HEREBY CERTIFY that the foregoing Resolution was intro- duced and read at a regular meeting of the City Council of the City of Redding on the 2nd day of October , 1978 , and was duly adopted at said meeting by the following vote : AYES: COUNCILMEN : Fulton, Gard, Kirkpatrick, Pugh, and Demsher NOES: COUNCILMEN : None ABSENT: COUNCILMEN : None ATTEST: BALD M.
