RESOLUTION NO. 2004-95
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ANNOUNCING
INTENT TO ACCEPT AN OPEN-SPACE EASEMENT
WHEREAS, Sections 51070, 51075, 51080 through 51087, and 27281 of California
Government Code authorize and provide for the governing body of the City to accept or approve
any grant of an open-space easement; and
WHEREAS, the owners of property known as Assessor's Parcel Numbers 103-290-037 and
103-690-021 (1170 Circle Drive and 2798 Shasta Street) have offered a portion of this property as
depicted on attached Exhibits A and B for open-space easement (nonbuilding area); and
WHEREAS:
1. The Development Services Department has reviewed the proposed dedication; and
2. The proposal is consistent with the City of Redding General Plan; and
3. The open-space easement would preserve the natural character of the land; and
4. The open-space easement, once recorded, shall not be abandoned until Benton Airpark
permanently ceases to operate as an airport; and
5. The open-space easement shall be subject to the City's open-space policies with the
following stipulations:
a. No construction of improvements shall occur within the open-space easement
area except:
i. Curb, gutter, sidewalk, and street pavement;
ii. Underground utilities;
iii. Streetlights within twenty (20) feet of the west boundary of the open- space
easement; and
IV. Fences not to exceed six (6) feet in height along the boundaries of the
easement and along the boundary between Lots 18 and 19 as shown on
attached Exhibit "A."
6. The landowner shall not construct or permit the construction of improvements except
for those set forth herein above.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a
regular meeting of the City Council on the 15th day of June,2004, by the following vote:

Non Building Easement
A parcel ofland situate in the City of Redding, County of Shasta, State of California, being a
portion of Parcels 1 and 2 as shown on that certain Parcel Map.for George Farley as recorded in
Book 6 of Parcel Maps at Page 103, Shasta County records, more particularly described as
follows:
All that portion of said Parcels 1 and 2 lying Easterly of the following described line;
Beginning at the Northerly most comer of Lot 5 as shown on the map ofNob Hill Unit 2 as
recorded in Book 14 of Maps at Page 101, Shasta county records; Thence North 17043'37" West
257.86 feet more or less to a point tangent to the 105 foot radius curve on the Easterly line of the .
lands described in the deed recorded in Book 1105 of Official Records at Page 354, Shasta
County Official Records; Thence continuing North 17043'37" West a distance of9.78 feet;
Thence North 72019'44" East a distance of 147.80 feet more or less to a point on the Westerly
line of Lot 9 as shown on the map ofNob Hill Unit 1 as recorded in Book 7 of Maps at Page 24,
Shasta County Records, lying 10' northerly of the Southwest comer of said Lot 9 and the Point of
Terminus of the herein described line.
