RESOLUTION NO. 2004-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING DRAFT CONTRACT WITH THE BUREAU OF RECLAMATION CONTRACT NO. 14-06-200- 5272A-L TRl (BUCKEYE CONTRACT) FOR PURCHASE OF CENTRAL VALLEY PROJECT WATER AND AUTHORIZING THE MAYOR TO APPROVE AS TO FORM. WHEREAS, the City has two Municipal and Industrial Contracts with the Bureau of Reclamation (Bureau) for wate:r, with the "Buckeye Contract" having an expiration date of December 31, 2009; and WHEREAS, The Buckeye Contract is a Central Valley Project contract for 6,140 acre-feet of water; and WHEREAS, the Bureau and the City entered into Contract No. 14-06-200-5272A, as amended, which established terms of delivery to the City of Project Water from the project facilities of the Bureau from February 22,1971, through December 31,2009; and WHEREAS, the Bureau and the City have, pursuant to subsection 3404( c )(3) of the Central Valley Project Improvement Act (CVPIA), subsequently entered into a binding agreement contract identified as contract No. 14-06-200-5272A-BA, which sets outtheterms pursuant to which the City agreed to renew the existing Contract before its expiration date after the completion of a programmatic environmental impact statement and other environmental documentation and negotiation of a renewal contract; and WHEREAS, the amount of water available to the City of Redding is a maximum of 6, 140 acre- feet of water per year. The City currently uses approximately 78 percent of the 6,140 acre-feet; and WHEREAS, the City has requested the long-term contract renewal of the existing Contract, pursuant to the terms of the existing Contract, Federal Reclamation law, and laws of the State of California, for water service from the Central Valley Project; and WHEREAS, City staff has been in contract negotiations with the Bureau since December 15, 1999, and has completed the negotiation process for the new Contract, which incorporates all the agreed upon terms and conditions between the Bureau of Reclamation and the City of Redding; and WHEREAS, the new Contract term would be for 40 years and will expire in the year 2044, and provides for provisions for annual rate increases, new shortage provisions, and increased water conservation programs. NOW, THEREFORE, IT IS RESOLVED by the City Council to approve the Draft Contract as to form between the Bureau of Reclamation and the City of Redding, which will allow the Bureau to post the Draft Contract for public review and comment before execution of the contract.
