RESOLUTION NO. 2004-69

LANDSCAPE MAINTENANCE DISTRICT "c"
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE REPORT OF THE ENGINEER AS FILED, AND
DECLARING ITS INTENTION TO:
(1) SET A PUBLIC HEARING DATE RE LANDSCAPE MAINTENANCE
DISTRICT "C;" AND
(2) RE-DESIGNA TE A SUBDIVIDED, REMAINING PARCEL OF THE
GOLD HILLS SUBDIVISION AS UNIT 6 OF AREA 4 OF THE
DISTRICT;
(3) DETACH UNITS 3A, 5, 6, AND REMAINING PARCELS, R-l AND R-2,
OF THE GOLD HILLS SUBDIVISION FROM AREA 4 OF THE
DISTRICT; AND
(4) LEVY AND COLLECT ASSESSMENTS FOR FISCAL YEAR 2004-2005
PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972,
COMMENCING WITH SECTION 22500 OF THE STREETS AND
HIGHW A YS CODE.
WHEREAS:
A. The City Council heretofore ordered the consolidated formation of Landscape
Maintenance District "C" (District) under authority granted by the Landscaping and Lighting Act of
1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of
California.
B. The purpose of the District is to provide maintenance to those landscaping
improvements required within the public rights-of-way by the conditions of development approval
ofthe subdivisions contained therein.
C. Minor changes in existing improvements are proposed for Fiscal Year 2004-2005.
D. The Engineer has filed his Report with the City Clerk pursuant to Streets and
Highways Code Section 22565, et seq.
E. This Resolution is made in satisfaction ofthose requirements set forth in the Streets
and Highways Code Sections 22607, 22609 and 22624.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT:
1. Pursuant to the Streets and Highways Code Sections 22586, 22607 and 22623, the Report
of the Engineer, as filed, is hereby approved.
2. The Report of the Engineer, on file with the City Clerk, contains a full and detailed
description of the improvements, the boundaries of the District-including the areas proposed
to be annexed in-and any zones therein, and the proposed assessm~nts upon the assessable
lots and remaining parcels within the District.
3.
The existing improvements for each subdivision in the District are set forth in Part G ofthe
Engineer's report, on file with the City Clerk, under the column entitled "Landscape
Description. "

5. Minor improvements are proposed for Fiscal Year 2004-2005. Only costs for the
maintenance of landscaping, miscellaneous lighting, mulching, vandalism, repairs to the
irrigation system, electric and water charges, replacement of vegetation as necessary, removal
of trimmings, rubbish, debris, maintenance of the detention basin, and other improvements
to remove or cover graffiti, administrative costs, painting of any walls, and such other
maintenance and incidental expenses as are authorized by Streets and Highways Code
Sections 22526 and 22531, wiII be assessed.
6. A public hearing wiII be held on Tuesday, June 1,2004, at the hour of7:00 p.m., or as soon
thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress
A venue, Redding, California, to address the proposed detachment and annexation of the
territories described herein and the levy and collection of the proposed assessment for Fiscal
Year 2004-2005. The proposed assessment for Fiscal Year 2004-2005 of $7.46 per parcel
is the same as last year's assessment.
7. That the City Clerk shaIl give notice of said hearing pursuant to the Streets and Highways
Code Sections 22608 and 22626(a).
I HEREBY CERTIFY that the foregoing resolution of intention was introduced,
read and adopted at a regular meeting of the City Council on the 4th day of May, 2004, by the
