On March 16, 2004, by Resolution No. 2004-38, the City Council adopted a Resolution of Intention to abandon the hereinafter-described Area of Vacation. 2. Proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways, and Service Easements Vacation Law as set forth in Section 8300, et seq., of the Streets and Highways Code of the State ofCalifomia. 3. This vacation is subject to: (a) the Conditions of approval set forth below and (b) the City of Redding reserving and excepting from the vacation a public-service easement and right to maintain all existing and future public utility easements within the entire area of abandonment. 4. When Condition of Approval 5A(l), set forth below, has been met, the Area of Vacation will be unnecessary for existing or future public-street purposes. NOW, THEREFORE, THE CITY COUNCIL FINDS, DECLARES, AND RESOLVES as follows: 1. The foregoing recitals are true and correct. 2. The Area of Vacation is that portion of Argyle Road lying adjacent to property at 3901 Airport Road, as more particularly described in EXHIBIT "A" and shown hatched on EXHIBIT "B" attached and made a part hereof by reference. 3. On the basis of the environmental document prepared by the City of Redding, the City Council finds that: A. The proposed vacation is consistent with the City's General Plan. B. The street segment is unnecessary for present or prospective public use and, therefore, it is not in the interests of the City to continue the establishment and maintenance of the street or alley. C. The environmental document adequately addresses the proposed vacation, and it would not result in any significant environmental impacts. (d tn '? r \) ;:.. I ~ 4. All requirements of California Streets and Highways Code Section 8300, et seq., have been complied with. 5. The Area of Vacation is hereby vacated SUBJECT TO: A. The following Conditions of Approval: (1) The abandonment shall not become effective nor shall the resolution of abandonment be recorded until all improvements to Airport Road and Argyle Road required for the development of the first phase of the Clover Creek Planned Development (PD-I-OO and S-15-02) are completed and accepted by the City of Redding. (2) A public-service easement shall be retained over the entire area of abandonment. (3) Within the abandonment street section, the applicant shall be responsible for the removal of the existing road base and asphalt; land remediation through seeding with native or occurring grasses; and any necessary striping, marking, or barricade placement in accordance with the specifications of the City Engineer. 6. When Condition of Approval 5A(1) set forth above has been satisfied, the Area of Vacation will be unnecessary for present or prospective public use as a street and an alley. This vacation shall not become effective nor shall this resolution be recorded until said Condition of Approval has been met. 7. When the Development Services Director advises the City Clerk that Condition of Approval 5A(1) has been met, the City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder.
