SUBJECT: 9.15(a) --Consider Resolution approving an exception to the California Public
Employee's Retirement System (Ca1PERS) 180 day wait period with regard to re -hiring
Kimberly Niemer as a retired annuitant in the position of Director of Community Services.
Recommendation
Adopt Resolution approving a 180 -day wait period exception and single interim appointment of
Kimberly Niemer as Director of Community Services for the City of Redding pursuant to
Government Code sections 7522.56 and 21224, effective February 7, 2024, for up to 960 hours;
and granting the City Manager authority to execute the necessary hiring documentation. The
resolution, if approved, would allow retired Director of Community Services, Kimberly Niemer,
to be rehired as an annuitant in the Community Services Department to manage the Emmerson
Art Project.
Fiscal Impact
The estimated salary cost for allowing the Community Services Department to hire the retired
annuitant on a temporary basis in Fiscal Year 2023-24, would be up to approximately $37,000.
Community Services estimates Ms. Niemer will work approximately 400 hours in this role,
which is well below the CalPERS hours limit of 960 hours for retired annuitants.
Alternative Action
The City Council could choose not to adopt the attached resolution, and a retired annuitant will
not be hired to assist with Emmerson Art Project.
Background/Analysis
Director of Community Services, Kimberly Niemer, retired from the City of Redding (City)
effective December 2, 2023, after 27 years of City service. Ms. Niemer will be able to use her
expertise and knowledge to provide project management and oversight for the Emmerson Art
Project.

Ms. Niemer's job classification will be Director of Community Services during her employment
as a retired annuitant. Although Ms. Niemer will have the classification of Director of
Community Services, as a retired annuitant, she will not be assuming all of the roles and
responsibilities of that position.
Environmental Review
This is not a project defined under the California Environmental Quality Act, and no further
action is required.

A RESOLUTION FOR EXCEPTION TO THE 180 -DAY WAIT PERIOD
GC sections 7522.56 & 21.224
WHEREAS, in compliance with Government Code section 7522.56 the Redding City
Council must provide Ca1PERS this certification resolution when hiring a retiree before 180 days
has passed since his or her retirement date; and
WHEREAS, Kimberly Niemer retired from the City of Redding in the position of
Director of Community Services, effective December 2, 2023; and
WHEREAS, section 7522.56 requires that post-retirement employment commence no
earlier than 180 days after the retirement date, which is May 31, 2024, without this certification
resolution; and
WHEREAS, section 7522.56 provides that this exception to the 180 -day wait period shall
not apply if the retiree accepts any retirement -related incentive; and
WHEREAS, the Redding City Council, the City of Redding and Kimberly Niemer certify
that Kimberly Niemer has not and will not receive a Golden Handshake or any other retirement
related incentive; and
WHEREAS, the Redding City Council hereby appoints Kimberly Niemer as an extra help
retired annuitant to manage the Emmerson Art Project for the Community Services Department
under Government Code section 21224, effective February 7, 2024; and
WHEREAS, the entire employment agreement, contract or appointment document
between Kimberly Niemer and the City of Redding has been reviewed by this body and is attached
herein; and
WHEREAS, no matters, issues, terms or conditions related to this employment and
appointment have been or will be placed on a consent calendar; and
WHEREAS, the employment shall be limited to 960 hours per fiscal year; and
WHEREAS, the compensation paid to retirees cannot be Less than the minimum nor
exceed the maximum monthly base salary paid to other employees performing comparable duties,
divided by 173.333 to equal the hourly rate; and
WHEREAS, the maximum monthly base salary for this position is $15,950 and the hourly
equivalent is $92.02, and the minimum monthly base salary for this position is $12,268 and the
hourly equivalent is $70.78; and
WHEREAS, the hourly rate paid to Kimberly Niemer will be $92.02; and
WHEREAS, Kimberly Niemer has not and will not receive any other benefit, incentive,
compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate;
and
THEREFORE, BE IT RESOLVED THAT the Redding City Council hereby certifies the nature
of the appointment of Kimberly Niemer as described herein and detailed in the attached
employment agreement/contract/appointment document and that this appointment is necessary
perform critically needed assistance with project management of the Emmerson Art Project for the
Community Services Department. Kimberly Niemer's title will be Director of Community
Services during her employment as a retired annuitant. Although Kimberly Niemer will have the
title of Director of Community Services, she will not be assuming all the roles and responsibilities
of that position.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a
regular meeting of the Redding City Council on the 6th day of February, 2024, by the following

C. EXPLANATION OF ACTION: Please be as specific as possible on the explanation of action. Indicate the

D. CREATE HELP DESK TICKET: Creating an IT Help Desk ticket is a required step in the onboarding and
off6oarding of employees. Employees cannot be assigned computer
permissions and an electronic access key badge unless they are entered into
the active directory via a help desk ticket. Changes to computer access and
facility access for separating employees should be completed on the
effective date of the separation.
