SUBJECT: 4.4(a) --Adopt Resolution waiving the 60 -day notification requirement for
establishing a County facility in the City of Redding limits (1075 N. Court Street), pursuant to
Government Code section 25351.
Recommendation
Adopt Resolution granting County of Shasta's request to waive the 60 -day noticing requirement
for the lease of space located within the City of Redding limits, located at 1075 N. Court Street,
for the temporary storage of property as needed, pursuant to the provisions contained in
Government Code Section 25351.
Fiscal Impact
There is no financial impact associated with this action.
Alternative Action
The City Council (Council) could choose to not adopt the resolution and require the County of
Shasta (County) to wait 60 days to lease and use the storage space.
Background/Analysis
The County has requested a waiver of the California Government Code requirement that it notify
the City of Redding (City) at least 60 days prior to entering into a lease for building space to be
used for County purposes. The 60 -day notification requirement is established by Government
Code Section 25351. The County has notified the City of its intent to lease space at 1075 N.
Court Street for temporary storage of property, as needed. In accordance with Government Code
Section 25351, the County sent a 60 -day notice letter on January 23, 2024, and the County
expects that it will need to sign the lease before March 23, 2024.
The Government Code provides for a waiver of the 60 -day requirement if the Council adopts a
resolution authorizing the waiver. Lacking the waiver, the County would simply have to wait the
60 days otherwise required by state law before leasing and using the storage space.

The Redding General Plan and Zoning Map designate the property as "GC," General
Commercial, which allows storage uses. Staff finds no reason to oppose the County's immediate
lease and use of the storage units and, therefore, believes the 60 -day noticing waiver is
supportable.
Environmental Review
This is not a project defined under the California Environmental. Quality Act, and no further
action is required.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
WAIVING THE 60 -DAY NOTIFICATION REQUIREMENT FOR
ESTABLISHING A COUNTY FACILITY WITHIN THE CITY LIMITS, AS
REQUIRED BY GOVERNMENT CODE SECTION 25351
WHEREAS, Government Code Section 25351 requires that a county notify a city in advance of
its intent to locate a county facility in the incorporated area; and
WHEREAS, Government Code Section 25351 further requires that said advance notification.
occur at least 60 days prior to use and occupancy of the county facility, unless the City Council
waives the notification requirement by resolution; and
WHEREAS, the County of Shasta (County) has requested a waiver from the 60 -day notification
requirement in order to begin leasing indoor storage space at 1075 N. Court Street in the City of
Redding (City); and
WHEREAS, the granting of the waiver will enable the County to immediately lease and occupy
the storage space rather than waiting 60 days; and
WHEREAS, the use of the building by the county for storage would not be inconsistent with any
City code or the goals and policies of the General Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT the City of
Redding grants the County of Shasta a waiver of the 60 -day notification requirement to lease and
use the building located at 1075 N. Court Street for indoor storage.
I HEREBY CERTIFY that the foregoing resolution was introduced and adopted at a regular
meeting of the City Council of the City of Redding on the 6th day of February, 2024, by the

Pursuant to Government Code section 25351, the County of Shasta ("County") is providing
notice that it intends to lease, subject to negotiation and approval of a lease acceptable to County,
space at 1075 North Court Street, City of Redding. The anticipated County services are temporary
storage of property, as needed.
The 60 -day timeline expires March 23, 2024. The County plans to commence the lease
prior to this date to provide indoor storage for County property and respectfully requests that the
City Council, pursuant to Government Code section 25351, approve a resolution waiving the 60 -
day requirement for the County of Shasta to lease property within the City of Redding.
