Fiscal Impact Wastewater Utility funding in the amount of $2,650,000 was approved for this project for Fiscal Year 2021-22. The total project cost, including surveying, design, bidding, construction, field engineering, inspection, and contract administration, is $2,240,895.37. Alternative Action The City Council (Council) may choose not to accept the project as satisfactorily complete, and advise staff on how to proceed. Background Jason Abel Construction has completed all items of work on the California Alley Utility Improvement Project as of July 28, 2023, which was within the contract time frame. The project warranty period expires one year from the completion date. The Public Works Department subsequently filed a notice of completion with Shasta County. At its meeting of November 16, 2021, the Council awarded a construction contract to Jason Abel Construction of Corning, California, for $1,621,355 and approved a $245,000 construction contingency fund. Also authorized was $175,000 for contract administration and construction inspection fees and $290,000 for project development costs, and the City Manager was authorized to approve additional increases in either the construction management or construction contingency amounts up to a total of $100,000 for a total authorized amount of $2,431,355. During construction, there were seven change orders in the amount of $174,294.89, leaving a balance of $70,705.11 in the contingency fund. The final project cost was $2,240,895.37. During construction, a Stop Payment Notice was filed on April 21, 2023, to withhold construction funds due to lack of payment to a subcontractor that performed work on the project. On April 27, 2023, the City withheld $15,342.10 from the construction contract as required per the contract documents and public contract code. Currently, the contractor has not paid their subcontractor and the subcontractor has commenced an action against the City per Civil. Code 9502 in order to enforce payment of their claim. The project also connected existing roof drains to the existing storm drain system of California Street Alley between Yuba and Placer Streets. Environmental Review On November 16, 2021, Council determined that the California Alley Utility Improvement Project is categorically exempt from review under the California Environmental Quality Act, pursuant to Section 15302(c) — Replacement or Reconstruction.
