RESOLUTION NO. 7S—7y A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF INTENTION TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER CHAPTER 9 . 36 OF THE REDDING MUNICIPAL CODE ON CERTAIN REAL PROPERTY IN THE CITY OF REDDING. (Owned by Retha M. Sous and Archie R. Kaplan, 2110 and 2120 El Reno Lane) . WHEREAS , the provisions of Chapter 9. 36 of the Redding Municipal Code provide that all buildings or structures which are structurally unsafe , or are dilapidated from old age, neglect, decay or other causes within the City of Redding, which constitute a fire menace or are dangerous to human life , or a likely resort for vagrant or dissolute persons, may be declared a nuisance by the City Council of the City of Redding and thereafter abated as provided therein, and WHEREAS, the Fire Marshal has made an inspection of the buildingslocated on real property as hereinafter described, and has declared them.totbe unsafe and/or a hazard to safety, health and public welfare, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding, as follows : That it is the intention of this City Council to begin legal proceedings of abatement under Chapter 9 . 36 of the Redding Municipal Code on the following described property : Parcel 1: All that certain lot, piece or parcel of land situate, lying and being in the County of Shasta, State of California, described as follows : COMMENCING at the 1/4 section corner common to Sections 15 and 20 of the P. B. Reading Grant and running thence S. 42°15 ' W. , a distance of 520. 5 feet to a point; thence S. 7°30 ' E. , a distance of 1921. 9 feet to the Southeast corner of the land of J. K. Napier; as per plat recorded in Book 2 of Land Surveys , at page 92 thereof, Records of Shasta County, California; thence , S. 80°02 ' W. , a distance of 933. 48 feet to the Southwest corner of that certain parcel of land conveyed by Babe Smith, a single woman, to LeRoy E. Tobias and Clara B. Tobias, his wife, by Deed dated September 19 , 1946 , recorded October 3, 1946 , in Book 258 , Official Records, at page 332 , Shasta County Records , Document No. 6378 , which is the true point of beginning of this description, beginning at said point and continuing S. 80°02 ' W. , a distance of 164 . 92 feet, more or less , to the Southeast corner of I -s eq Rescinded by Res. No. 79-143 —1— that certain parcel of land conveyed by Archie R. Kaplan and Bessie L. Kaplan, his wife , to Nellie B. Sloan and Ora W. Chumley by Deed recorded April 17, 1947 , in Book 270 , Official Records, at page 126 , Shasta County Re- cords ; thence, N. 6°24 ' 22 " E. , on and along the Easterly line of the property so conveyed to Sloan and Chumley , a distance of 73. 00 feet, more or less, to the South line of that certain parcel conveyed by Valley Concrete Pipe and Products Company, a corporation , to Marion P. Howard and Emily E. Howard, his wife, by Deed dated October 1, 1941 , recorded November 4 , 1941, in Book 182 , Official Records , at page 381 , Shasta County Records , Document No. 4639 ; thence, N. 80°02 ' E. , on and along the South- erly line of the parcel so conveyed to Howard, a distance of 138. 92 feet, more or less , to the Westerly line of that certain parcel of land conveyed by Babe Smith, a single woman, to LeRoy E. Tobias and Clara B. Tobias , his wife, by Deed dated September 19 , 1946 , recorded October 3 , 1946 , in Book 258 , Official Records , at page 352 , Shasta County Records , Document No. 6378; thence S. 7°30 ' E. , on and along the line of the parcel so conveyed to Tobias , a distance of 71. 45 feet to the true point of beginning . Parcel 2 : All that portion of the P. B. Reading Grant described as follows : COMMENCING at the quarter section corner common to Sections 15 and 20 of the P. B. Reading Grant; thence S. 42°15 ' W. , 520. 5 feet; thence S. 7° 30 ' E. , 1921. 9 feet to the Southeast corner of the land of J. K. Napier, as shown on the map recorded in Book 2 of Land Surveys , at page 92 ; thence S. 80°02 ' W. , 90. 08 feet to a 3/4" pipe set on the Westerly right of way line of the existing State Highway; thence, continuing, S. 80° 02 ' W. , 1008. 42 feet to the Southeasterly corner of the parcel described in the Deed to Ora W. Chumley, et al. , recorded April 17, 1947 , in Book 270 , page 126 , Official Records ; thence, along the Easterly line of said Chumley parcel , N. 6°24 ' 22" E. , 73 feet, more or less , to the true point of beginning of this description at the point of intersection• with the Southerly line of the parcel described in the Deed to Jack Ussleman, et ux. , recorded July 20 , 1942 , in Book 192 , page 427 , Official Records; thence, continuing along the Easterly line of said Chumley parcel , N. 6°24 ' 22" E. , to a point in the Northerly line of said Ussleman parcel; thence, along said Northerly line, N. 80°02 ' E. to the most Northerly corner thereof; thence, S. 7°30 ' W. , 30. 03 feet; thence S. 80°02 ' W. , to the true point of beginning. BE IT FURTHER RESOLVED that said buildings mentioned hereinabove are hereby declared to be a public nuisance as pro- vided by Chapter 9. 36 of the Redding Municipal Code, and are hereby ordered to be abated by repair, rehabilitation, demolition or removal. BE IT FURTHER RESOLVED that the Fire Marshal and the Board of Appeals of the City of Redding are hereby directed to -2- take all proceedings provided in Chapter 9. 36 of the Redding Muni- cipal Code. BE IT FURTHER RESOLVED that the City Clerk of the City of Redding be and she is hereby authorized and directed to forward a certified copy of this Resolution to the County Recorder of Shasta County for recordation. I HEREBY CERTIFY that the foregoing Resolution was intro- duced and read at a regular meeting of the City Council of the City of Redding on the 5th day of June , 1978 , and was duly adopted at said meeting by the following vote: AYES : COUNCILMEN: Fulton, Gard, Kirkpatrick, Pugh, and Demsher NOES : COUNCILMEN : None ABSENT: COUNCILMEN: None DDONALD M.
