HomeMy WebLinkAboutReso. 78-072 - Opposing S.B. 1874, Which Would Repeal Provisions of the Municipal Organization Act of 1977 Providing Special Procedures for Annexing Islands of Unicorporated Area Where the City Provides Services But Has No Jurisdiction RESOLUTION NO. 7A--7`17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OPPOSING S.B. 1874 , WHICH WOULD REPEAL PROVISIONS OF THE MUNICIPAL ORGANIZATION ACT OF 1977 PROVIDING SPECIAL PROCEDURES FOR ANNEXING ISLANDS OF UNINCORPORATED AREA WHERE THE CITY PROVIDES SERVICES BUT HAS NO JURISDICTION . WHEREAS , the State Legislature last year enacted A.B . 1533 , the Municipal Organization Act of 1977 , which provided a special procedure for annexing islands of unincorporated area surrounded or substantially surrounded by a city , so as to give the inhabitants of such islands and the surrounding city taxpayers a more equitable relationship, and WHEREAS , S . B. 1874 , which has just been approved by the Senate Committee on Local Government, would repeal the provisions of the Municipal Organization Act of 1977 , and WHEREAS, if the special annexation procedures provided by the Municipal Organization Act of 1977 are repealed, cities will have no means of seeking fair and equitable cost-sharing by the residents of the unincorporated island areas who are benefit- ting from city services , and WHEREAS , Redding presently has ten such islands within its boundaries where the City must provide sewer service but has no jurisdiction and collects no taxes , and where fair and equitable cost sharing could be accomplished by annexation without an election within three years , unless this option is eliminated by the enactment of S .B. 1874 , NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redding finds it in the best interests of the City and its citizens that the Municipal Organization Act of 1977 remain law, and the City Council vigorously opposes the enactment of S.B. 1874 . BE IT FURTHER RESOLVED that the City Clerk is directed to send copies of this Resolution to Senator Ray Johnson , and to Assemblyman Stan Statham, and to the members of the Assembly Committee on Local Government.
