A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING AN AGREEMENT WITH THE CALIFORNIA HIGHWAY
PATROL PERTAINING TO A TRAINING PROGRAM FOR CITY POLICE
TO BE PROVIDED BY THE CHP, AND AUTHORIZING THE CITY
MANAGER TO EXECUTE THE NECESSARY DOCUMENTS .
WHEREAS, the Department of California Highway Patrol
requires written training agreements from cities participating
in one of their training programs , and
WHEREAS , Police Chief Robert Whitmer has recommended
that the City of Redding participate in Motorcycle Training
Class 3-78 , sponsored and administered by the CHP, and
WHEREAS , it is estimated that the City of Redding
Police Department participation will not cost more than $655 . 00 ,
and
WHEREAS , the CHP requires a Council resolution of
approval for participation in such program, and
WHEREAS , after careful study and review, it is deemed
by the City Council to be in the best interests of the City and
its citizens for the Police Department to participate ,
NOW, THEREFORE , BE IT RESOLVED that Training Agreement
#149 of the Department of California Highway Patrol with the City
of Redding for the fiscal year 1977-1978 is hereby approved , and
the City Manager is hereby authorized and directed to execute
said agreement for and in behalf of the City of Redding .
I HEREBY CERTIFY that the foregoing Resolution was intro-
duced and read at a regular meeting of the City Council of the
City of Redding on the 17th day of April , 1978 , and was duly
adopted at said meeting by the following vote :

TRAINING AGREEMENT
THIS AGREEMENT, made and entered into this day of
April , 1978 , by and between the State of California, acting by
and through the Department of California Highway Patrol , herein-
after called CHP , and the City of Redding , hereinafter called
Contractor ,
WITNESEET H:
By and in consideration of the covenants and conditions
herein contained, CHP and Contractor do hereby agree as follows :
1. CHP agrees to allow Contractor to attend training
classes during the period as follows : Initial Motorcycle Training
Class , 3-78 , 5/16-26 , 1 trainee .
-- 2 . CHP agrees to provide living , dining , and classroom
facilities as required.
3 . As consideration for the use of the Academy facilities ,
Contractor agrees to pay CHP upon receipt of an invoice in accord-
ance with the following :
Per resident student $ 25 . 00 per day
Per non-resident student . . . $ N/A per day
Instruction fee $ 38 . 00 per 8 hour day
TOTAL not to exceed $655 . 00
4 . All training is conducted on a space available basis .
In the event Contractor ' s personnel occupy CHP Academy as a resi-
dent and do not remain in residence for the duration of training ,
but complete training course, Contractor agrees to pay full resi-
dence fees for the entire training period.

5 . Contractor agrees to indemnify , defend, and save
harmless CHP, its officers, agents , and employees from any and
all claims and losses accruing or resulting to any person , firm,
or corporation who may be injured or damaged by the contractor
in the performance of this agreement.
6. Contractor shall be responsible for paying any cost
• incurred by CHP for facility damage caused by the willful or
malicious misconduct of contractor ' s trainees.
7 . This agreement shall become effective when signed
by both parties , and upon CHP ' s receipt .of a resolution covering
the agreement. Training shall not be authorized until the resolu-
tion is on file with CHP.
8 . This agreement may be amended by mutual consent of
the parties hereto.
9. Notices and communications hereunder shall be sent
to the addresses appearing below the signatures .
