HomeMy WebLinkAboutReso. 1976-189 - Approving annexation of certain uninhabited territory designated "Enterprise Annex no. 94"RESOLUTION NO. -14-_l l 9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "ENTERPRISE ANNEX NO. 94" TO THE CITY OF REDDING. WHEREAS, on the 6th day of December, 1976, the City Council of the City of Redding did pass and adopt Resolution No. 76-166, giving notice of the proposed annexation to the City of Redding of certain uninhabited territory being therein designated as "Enterprise Annex No. 94", and said Resolution describing the boundaries of the territory proposed to be annexed, and WHEREAS, the Local Agency Formation Commission of Shasta County, California, did in session duly assembled on Wednesday, August 11, 1976, consider and approve the proposed annexation of said "Enterprise Annex No. 94" as hereinafter described, and WHEREAS, said Resolution No. 76-166 did contain a notice of the day, hour and place where and when the Council of the City of Redding would hear protests made by any person owning real property within the City who does not also own property in the territory to be annexed, appearing before the City Council of the City of Redding to show cause why such uninhabited territory should not be annexed to the City of Redding, and WHEREAS, on Monday, the 27th day of December, 1976, at the hour of 12:00 Noon in the Council Chambers on the second floor of the Police De- partment and City Council Chambers Building in the City of Redding, County of Shasta, State of•California, said time and place being the day, hour and place fixed in said Resolution No. 76-166 for hearing protests to the annexation, the said City Council did hear and pass upon all protests made to the proposed annexation, and WHEREAS, said territory is contiguous to the City of Redding, and is uninhabited territory in the County of Shasta, and WHEREAS, the owners of all the land in the territory proposed herein to be annexed have filed consents to this proposed annexation with the Local Agency Formation Commission of Shasta County, and also consents to the 26 taxation of property within the annexed area to pay any indebtedness or liabil- -1- ity of the City of Redding contracted prior to or existing at the time said territory is annexed, including any bonded indebtedness of the City of Redding outstanding or authorized at the date of the first publication of City Council Resolution No. 76-166, giving notice of this proposed annexation, and WHEREAS, the Local Agency Formation Commission of Shasta County, California, did, at the session duly assembled on Wednesday, August 11, 1976, waive the requirement of notice, hearing, or an election by the City of Redding, on the proposed annexation of said "Enterprise Annex No. 94", as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of Redding 1. That the annexation of the territory hereinafter described to the City of Redding is hereby approved, and that said territory be and it is hereby annexed to the City of Redding. 2. That said territory, the annexation of which to the City of Redding is hereby approved, is described in "Exhibit A", attached hereto and incorporated herein. 3. That the City Clerk of the City of Redding shall certify to the adoption of this Resolution and cause it to be published once in the Record -Searchlight. I HEREBY CERTIFY that the foregoing Resolution was introduced and read at an adjourned regular meeting of the City Council of the City of Redding on the 27th day of December, 1976, and was duly adopted at said meeting by the following vote: AYES: COUNCILMEN: Anderson, Demsher, Pugh, and Fulton NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Gard ATTEST: LEE D. Beginning at the Northwest corner of Lot 1, Block 1, Loma Vista Sub- division, Unit No. 2, as shown on that map recorded in Book 9 of Maps at page 34, Shasta County Records, the point of beginning of this annexation; thence, from said point • of beginning along the North line of said Lot 1 N. 89°52'03" E., 147.50 feet to the Northeast corner of said Lot 1; thence, along the East line of said Lot 1 and the West line of Ricardo Avenue (Co. Rd. No. 3H166A) S. 0°33'25" E., 101.25 feet to the Southeast corner of said Lot 1; thence, along the South line of said Lot 1' S. 89°26'35" W., 147.44 feet to. the Southwest corner of said Lot 1; thence, along the West line of said Lot 1 N. 0°35'31" W., 102.35 feet to the point of beginniing. ..Containing an area of 0.34 acre more or less.
