HomeMy WebLinkAboutReso. 1976-170 - Giving notice of proposed annexation to City of Enterprise Annex No. 98 and giving notice of the time and place for hearing of protests• • RESOLUTION NO. � 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING GIVING NOTICE OF PROPOSED ANNEXATION TO THE CITY OF REDDING.OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "ENTERPRISE ANNEX NO. 98" AND GIVING NOTICE OF THE TIME AND PLACE FOR HEARING•.,OF PROTESTS THERETO. WHEREAS, the owners of all the land in the territory pro- posed herein to be annexed have filed consents to this proposed an- nexation, and to the taxation of property within the annexed area to pay any indebtedness or liability of the City of Redding con- tracted prior to or existing at the time said territory is annexed, including any bonded indebtedness of the City of Redding outstanding or authorized at the date of the first publication of this resolu- tion of the City Council giving notice of this proposed annexation, with the Local Agency Formation Commission of Shasta County, and WHEREAS, the Local Agency Formation Commission of Shasta County, California, did in session duly assembled on Wednesday, October 13, 1976, consider and approve the proposed annexation of "Enterprise Annex No. 98", more particularly described hereinafter, and WHEREAS, at the aforesaid session, the Local Agency Forma- tion Commission of Shasta County, California, did waive the require- ment of notice, hearing, or an election by the City of Redding, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows: 1. That the City Council does hereby initiate proceedings to annex "Enterprise Annex No. 98" on its own motion, the owners of all the land in the territory proposed to be annexed in this annexa- tion having heretofore petitioned the Local Agency Formation Commis- sion of Shasta County, California, for annexation alternatively to the Enterprise Public Utility District or to the City of Redding, and the Local Agency Formation Commission having approved said an- nexation in the alternative. Subsequent thereto, the registered voters of the Enterprise Public Utility District did, on November 2, 1976, by a majority vote, vote in favor of the reorganization of the Enterprise Public Utility District by dissolution of the District :• and annexation of the territory thereof to the City of Redding. The annexation of the territory within the boundaries of proposed *�.. -1- "Enterprise Annex No. 98" not having been completed to the Enter- prise Public Utility District at the time of said election, it becomes necessary and desirable for the City of Redding to initiate the completion of such proposed annexation to the City of Redding. 2. That the territory which is proposed to be annexed to the City of Redding as "Enterprise Annex No. 98" is situate in Shasta County, California, and more particularly described as follows: A portion of the southeast quarter of Section 17, T. 31 N., R. 4 W., M.D.M., Shasta County, California. Beginning at a point on the north line of Churn Creek Road (Co.Rd. 2H03A), also a point on the west line of Parcel 1 as shown on that map recorded in Book 8 of Parcel Maps, page 59, Shasta County Re- cords, from whence the quarter corner common to Sections 17 and 20 bears S. 0103'44" E., 62.20 feet and S. 89050130" W., 350.00 feet, the point of beginning of this annexation; thence from said point of beginning on and along the west line of said Parcel, N. 0°03'44" E., 812.80 feet; thence S. 89050'30" W., 79.52 feet to a point on the centerline of Churn Creek; thence on and along the centerline of Churn Creek northeasterly and northerly to a point on the north line of said southeast quarter; thence leaving said centerline on and along said north line, N. 89041'39" E., 1460 feet, more or less, to a point that bears S. 89°41'39" W., 30.00 feet from the east quarter corner of said Section 17; thence, parallel with the east line of said Section 17, S. 0003'26" E.*, 1440.48 feet; thence, east 30.00 feet to a point the east line of said Section 17; thence on and along said.east line S. 0103'26" E., 1020 feet, more or less, thence leaving said east line on and along the north line of that parcel as described in Book 1319 of official Records at page 317, Shasta County Records, westerly 210 feet to the northwest corner of said parcel; thence on and along the west line of said parcel southerly 118 feet, more or less; thence leaving said west line, on and along the north line of Rancho Road (Co.Rd. 3H085), from a tangent that bears N. 67°44'59" W., along a 545 foot radius curve to the left through an angle of 14000'00", a distance of 122.86 feet; thence N. 81°44'59" W., 22.47 feet; thence along a 125 foot radius curve to the left through an angle of 8702812911, a distance of 190.84 feet to a point on the north line of said Churn Creek Road; thence on and along the north line of said Churn Creek Road, N. 89150'30" W., 1810 feet, more or less, to the point of beginning. Containing an area of 111.2 acres, more or less. 3. That Monday, December 27, 1976, at the hour of 12:00 Noon, in the Council Chambers in the Police Department and City Council Chambers Building, 1313 Market Street, Redding, Shasta County, California, is hereby fixed as the time and place when and where any owner of property within the City who does not also own property in the territory to be annexed may appear before the City Council of the City of Redding and show cause why such uninhabited territory should not be annexed to the City of Redding. Such protests must be in writing, may be filed at any time prior to the -2- . r . termination of said hearing for objections to the proposed annexa- tion, and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. Owners of land in the territory proposed to be an- nexed who have filed petitions or consents to this annexation with the Local Agency Formation Commission may not file written protests against the annexation, having previously filed such consents. 4. The City Clerk of the City of Redding is hereby authorized and directed to cause a copy of this Resolution to be published at least once in a newspaper of .general circulation published in the City, in such a manner that publication shall be complete at least four days prior to*the date set for the hearing. 5. The City Clerk is further authorized and directed to cause written notice of this proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed was assessed in the last equalized County assessment roll available on the date these proceedings were initiated, at the addresses shown on said assessment roll or known to said City Clerk. The City Council is proceeding herein pursuant to the provisions of Government Code Sections 35310 and 35310.1.
