A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING ITS INTENTION TO VACATE AND ABANDON A STORM DRAINAGE EASEMENT BETWEEN VALENTINE LANE AND THE SACRAMENTO RIVER. WHEREAS, the City of Redding has been requested to abandon a storm drainage easement between Valentine Lane and the Sacramento River, which is described (defectively) as follows: Commencing at a 6" x 6" concrete monument marking the south boundary line of the City of Redding, Shasta County, and designated as Engineer's STation 106+49.37 on that certain Map recorded in Book 5 of Land Surveys at page 36, in the Shasta County Recorder's Office, and running thence S. 14° 51'11" W., a distance of 26.40 feet: thence S. 3.3°38'02" W., a distance of 1360.83 feet; thence S. 56051$58" E. a distance of 655.00 feet; thence S. 33038102" W. a distance of 290.78 feet; thence S. 8029'18" E. a distance of 10.00 feet to the true point of beginning of this description and running thence N. 81130142" E. a distance of 115.00 feet more or less over and across that certain parcel of land described in a deed recorded in Book 289 of Official Records at page 186 in the Shasta County Recorder's Office, in an Easement document which was given to the County of Shasta in the year 1952, and which is shown in its"actual location on the diagram which is attached hereto as "Exhibit A", and WHEREAS, the subject area has since been annexed to the City of Redding, and WHEREAS, it is the determination of the City Council of the City of Redding that the said easement is not necessary or con- venient to the public use in either location, and WHEREAS, the Director of Public Works of the City of Redding has duly investigated the proposed abandonment, and has determined there will be no further use in either location for said easement to be so abandoned, and WHEREAS, the City Council of the City of Redding elects to proceed in this matter under the provisions of the Public Service Easements Vacation Law, with the provision that this resolution shall be deemed an ordinance of intention, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows, to wit: -1- IN correct. 1. That all of the foregoing recitals are true and 2. That the City Council intends to and hereby declares its intention to vacate and abandon that certain storm drainage easement both as described hereinabove and as shown in "Exhibit A". BE IT FURTHER RESOLVED that Monday, the 6th day of December, 1976, at the hour of 7:30 P.M. at the City Council Chambers and Police Department Building in the City of Redding are hereby set as the time and place for hearing all persons interested in or object- ing to the abandonment of the said easement. BE IT FURTHER RESOLVED that the Director of Public Works be and he is hereby instructed to post or cause to be conspicuously posted at points not more than three hundred feet (300') in distance apart and along the line of the subject easement, both as hereinabove described and in its actual location as shown on the attached diagram, notices of this intention to abandon said easement.. Said notices shall set forth the passage of this resolution of intention and shall also set forth the time and place of hearing as hereinabove set forth. At least three such notices as above set forth shall be posted in each location, in the manner above set forth, and said posting shall be completed not less than ten (10) days prior to the date of hearing. BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage and adoption of this resolution of intention and shall cause the same.to be published once in a newspaper of general circulation printed in the City of Redding at least fifteen (15) days before the date set for public hearing on protests to the afore- said proposed abandonment. I HEREBY CERTIFY that the foregoing Resolution was intro- duced and read at a regular meeting of the City Council of the City of Redding on the lst day of November, 1976, and was duly adopted at said meeting by the following vote: AYES: COUNCILMEN: Anderson, Demsher, Gard, Pugh, and Fulton NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None L E D.
