A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF A STORM DRAINAGE EASEMENT IN SHASTA TERRACE SUBDIVISION. WHEREAS, the City of Redding has been requested to abandon a portion of a fifteen foot wide storm drainage easement in Shasta Terrace Subdivision, the portion to be abandoned being described as follows: and The easterly five feet of the westerly fifteen feet of Lot 17, Block 4, Shasta Terrace Subdivision, as shown on that certain Map recorded in Book 9 of Maps at page 24, Shasta County Records, WHEREAS, it is the determination of the City Council of the City of Redding that the described portion of the said easement is not necessary or convenient to the public use, and WHEREAS, the Director of Public Works of the City of Redding has duly investigated the proposed abandonment, and has determined there will be no further use for said portion of said easement to be so abandoned, and WHEREAS, the City Council of the City of Redding elects to proceed in this matter under the provisions of the Public Service Easements Vacation Law, with the provision that this resolution shall be deemed an ordinance of intention, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows, to wit: correct. 1. That all of the foregoing recitals are true and 2. That the City Council intends to and hereby declares its intention to vacate and abandon a portion of a certain storm drainage easement, as described hereinabove. BE IT FURTHER RESOLVED that Monday, the 4th day of October, 1976, at the hour of 7:30 P.M. at the City Council c - Chambers and Police Department Building in the City of Redding 0 are hereby set as the time and place for hearing all persons interested in or objecting to the abandonment of the said easement. -1- PP" 0 BE IT FURTHER RESOLVED that the Director of Public Works be and he is hereby instructed to post or cause to be conspicuously posted at points not more than three hundred (300) feet in distance apart and along the line of the subject easement hereinabove described, notices of this intention to abandon said portion of said easement. Said notices shall set forth the passage of this resolution of intention and shall also set forth the time and place of hearing as hereinabove set forth. At least three such notices as above set forth shall be posted, in the manner above set forth, and posting of said notices shall be completed not less than ten (10) days prior to the date of hearing. BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage and adoption of this resolution of intention and shall cause the same to be published once in a newspaper of general circulation printed in the City of Redding at least fifteen (15) days before the date set for public hearing on protests to the aforesaid proposed abandonment. I HEREBY CERTIFY that the foregoing Resolution was intro- duced and read at a regular meeting of the City Council of the City of Redding on the 7th day of September, 1976, and was duly adopted at said meeting by the following vote: AYES: COUNCILMEN: Anderson, Demsher, Gard, Pugh, and Fulton NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None ATTEST: MILDRED h.
