HomeMy WebLinkAboutReso. 1976-094 - Declaring its intention to vacate and abandon a portion of West Street north of Seventh StreetRESOLUTION NO. 7Z- %n A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF WEST STREET NORTH OF SEVENTH STREET. WHEREAS, certain real property has been heretofore re- served for street purposes, and said real property consists of West Street in the City of Redding, as the same is set forth on map and plan on file in the office of the City Clerk of the City of Redding, and a portion of said street is proposed to be abandoned, more particularly described as follows: and Beginning at the most southerly corner of that certain parcel described by Deed recorded in Volume 1011 of Official Records, at page 560, Shasta County Records, being also the point of intersection of the right of way lines of West Street and Seventh Street; thence, along the northerly right of way line of West Street N. 47030' W., 161.31 feet; thence from a tangent which bears S. 10°02'11" E., along a 45.50 foot radius curve to the right, through a central angle of 13°28'48" a distance of 10.70 feet; thence from a tangent which bears S. 05°33'23" E. along a 15.00 foot radius curve to the left, through a central angle of 41°56'37" a distance of 10.98 feet; thence S. 47°30'00" E., 132.56 feet; thence on a tangent curve to the left having a radius of 10.00 feet, through a central angle of 90°00'00" a distance of 15.71 feet more or less to the point of beginning, WHEREAS, it is believed by and it appears to the City Council of the City of Redding that the said above described portion of West Street is not necessary or convenient for the public use, and WHEREAS, the Director of Public Works of the City of Redding has duly investigated the proposed abandonment of the sub- ject property and has recommended to the City Council no indication that it will ever be required for public street purposes, and WHEREAS, the Planning Commission of the City of Redding has held a public hearing regarding the abandonment of said portion of said street and at the conclusion of said hearing has approved the proposed abandonment, and WHEREAS, the City Council of the City of Redding elects to proceed in this matter under the provisions of the Street f Vacation Act of 1941, as the same is set forth in Section 8300 et a w -1- � • seq of the Streets and Highways Code of the State of California, with the provision that this resolution shall be deemed an ordinance of intention, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows, to wit: correct. 1. That all of the foregoing recitals are true and 2. That the City Council intends to and hereby declares its intention to vacate and abandon the above described portion of West Street as shown on the map which is attached hereto as "Exhibit A". BE IT FURTHER RESOLVED that Tuesday, the 7th day of September, 1977, at the hour of 7:30 P.M. at the City Council Chambers and Police Department Building in the City of Redding are hereby set as the time and place for hearing all persons interested in or objecting to the proposed abandonment. BE IT FURTHER RESOLVED that the Director of Public Works of the City of Redding be and he is hereby instructed to post or cause to be conspicuously posted at points not more than three hundred (300) feet in distance apart and along the line of the property now proposed to be abandoned, notices of this intention to vacate and abandon this portion of said street. Said notices shall set forth the passage of this Resolution of Intention and shall set forth the time and place of hearing as hereinabove set forth. At least three such notices as above set forth shall be posted, in the manner above set forth, and posting of said notices shall be completed not less than ten days prior to the date of hearing. BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage and adoption of this resolution of intention and shall cause the same to be published once in a newspaper of general circulation printed in the City of Redding at least fifteen (15) days before the date set for public hearing of protests to the aforesaid proposed vacation. -2- I HEREBY CERTIFY that the foregoing Resolution was intro- duced and read at a regular meeting of the City Council of the City of Redding on the 16th day of August 1976, and was duly adopted at said meeting by the following vote: AYES: COUNCILMEN: Anderson, Demsher, Gard, Pugh, and Fulton NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None LEE D.
