A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE REPORT AND FINDINGS OF THE BOARD OF APPEALS
AND ORDERING THE ABATEMENT, BY REMOVAL, OF THE UNSAFE
AND DILAPIDATED BUILDING ON PROPERTY AT 2173 CALIFORNIA
STREET. (CARL R. MAUGER and ELLA I. MAUGER).
WHEREAS, on March 1, 1976, the City Council adopted
Resolution No. 76-24, a Resolution of Intention to begin abatement
proceedings under the provisions of Chapter 15 of the Redding City
Code, affecting property owned by Carl R. Mauger and Ella I. Mauger,
at 2173 California Street, in the City of Redding, and more parti-
cularly described in said Resolution No. 76-24, and
WHEREAS, notice of hearing by the Board of Appeals was
posted on the subject property and mailed to the owners by certified
mail, and
WHEREAS, on May 27, 1976, a public hearing was held before
the said Board of Appeals as provided in said Code, and testimony
received by the Board, and the said Board of Appeals found that
good and sufficient cause does not exist why said building should
not be demolished and removed, and
WHEREAS, said Board of Appeals having filed with this
City Council its report of the hearing and its findings herein,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Redding that the report of the Board of Appeals of the
City of Redding of its findings that the unsafe and dilapidated
building existing on the property at 2173 California Street should
be demolished and removed, be and said report is hereby approved.
BE IT FURTHER RESOLVED by the City Council that the Fire
Marshal of the City of Redding is hereby directed to abate said
nuisance after a period of thirty (30) days, by having the unsafe
and dilapidated buildings and structures demolished and removed,
and he and his authorized representatives are hereby expressly
authorized to enter upon the subject property for that purpose
and are directed to keep an itemized account of the cost of abating`
the said nuisance.

BE IT FURTHER RESOLVED that a copy of this Resolution
shall be served upon the property owner in accordance with the
provisions of Section 15-27 of the Redding City Code, and said
property owner shall have the right to have such unsafe and dilapidated
building removed or repaired at his own expense, providing the same
is done prior to the expiration of thirty days.
I HEREBY CERTIFY that the foregoing Resolution was intro-
duced and read at a regular meeting of the City Council of the City
of Redding on the 21st day of June , 1976, and was duly adopted at
said meeting by the following vote:

REPORT OF THE BOARD OF APPEALS OF THE CITY OF REDDING
PURSUANT TO SECTION 15-28 OF THE REDDING CITY CODE.
(MAUGER PROPERTY, 2173 CALIFORNIA STREET
TO THE HONORABLE CITY COUNCIL OF THE CITY OF REDDING:
The Board of Appeals of the City of Redding has held a
public hearing on May 27, 1976, in the City Hall of the City of
Redding to consider the abatement of unsafe and unsightly buildings
on property at 2173 California Street in the City of Redding, under
the provisions of Chapter 15, Article V, of the Redding City Code.
The findings of the Board of Appeals in regard to said nuisance
are as follows:
1. That the real property which is the subject of
this proceeding is more particularly described as follows:
The south 25 feet of Lot 5 and the north 25 feet of Lot 6,
Block B, Walden's Addition, as shown on the map of Frisbie's,
Walden's and Honn's Additions to the Town of Redding,
recorded October 14, 1887, in Book 1 of Town Plats at page 34.
2. That the legal owners of said property are Carl R.
Mauger and Ella I. Mauger.
3. That the Council adopted Resolution No. 76-24, a
Resolution of Intention to begin legal proceedings of abatement
under Chapter 15 of the Redding City Code, as to the subject
property, on March 1, 1976.
4. That jurisdiction has been obtained by the posting
of the required notices upon the property, and by the mailing by
certified mail of notices to Carl R. Mauger and Ella I. Mauger at
their last known address.
5. That a residential building or buildings exist on
the subject property which constitute a dangerous, unhealthy and
unsightly condition on the property.
6. At the hearing of the Board of Appeals on May 27,
1976, testimony was given by the Assistant Fire Marshal concerning
the condition of the subject building. The property owner and.his,real-
tor asked for a continuance so that he might have time to sell the
property. In view of the dangerous condition of the building, the
Board refused such a continuance. No other persons appeared to protest
these proceedings.
7. After hearing the testimony as to the unsafe condition
of the building and the property owner indicating that he felt it
was unpractical to put any money into the building, it is the
unanimous finding of the Board of Appeals that good and sufficient
cause does not exist why the unsafe and unsightly buildings located
on the Carl R. Mauger property at 2173 California Street should not
be demolished and removed, and it is the recommendation of the
Board of Appeals that said unsafe and unsightly buildings on said
property be abated by demolition and removal by the Fire Marshal
in the manner which he, in his discretion, considers most economical.
