A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING A PROPOSAL TO DISSOLVE THE CASCADE COMMUNITY
SERVICES DISTRICT AND ANNEX ITS TERRITORY TO THE CITY
OF REDDING.
WHEREAS, there is attached to this Resolution and
incorporated herein by reference a proposal to dissolve Cascade
Community Services District and annex its territory to the City
of Redding, prepared by Bill G. Minton, Executive Officer of
Shasta County and submitted to the Shasta County Local Agency
Formation Commission, and
WHEREAS, the aforesaid proposal is subject to five
conditions as set forth therein, and
WHEREAS, the proposed dissolution and annexation can
be handled by the County of Shasta and the Local Agency Formation
Commission of Shasta County as a single "reorganization" under
the District Reorganization Act of 1965 (Government Code Section
56003.1), if the City Council makes no objection and approves
the aforesaid proposal, and
WHEREAS, the City Manager, the Planning and Community
Development Director, and the City Attorney of the City of Redding
have advised Council that the attached proposal is the most ap-
propriate procedure to accomplish the proposed "reorganization,"
and the City Council has carefully studied the proposal and deems
it to be in the best interests of the City of Redding and its
citizens,
NOW, THEREFORE, BE IT RESOLVED that the attached proposal
to dissolve Cascade Community Services District and annex its
territory to the City of Redding be and it is hereby approved by
the City Council of the City of Redding, and the City Council
hereby determines that the plan of reorganization together with
the conditions thereof is unobjectionable.
I HEREBY CERTIFY that the foregoing Resolution was intro-
duced and read at an -adjourned regular meeting of the City Council
of the City of Redding on the 9th day of March, 1976, and was
duly adopted at said meeting by the following vote:

Subject: Proposal to dissolve Cascade Community Services District
and annex its territory to the City of Redding
Annexation of territory within boundaries of Cascade Community
Services District to City of Redding and a plan of dissolution
of District was requested by petition of resident voters residing
within boundaries of District. County Clerk certifies there are
approximately.1,860 registered voters residing within boundaries
of District. There are 344 qualified signatures on petition which
constitute more than the five percent requirement. Land area is
approximately 3,100 acres with an estimated population of 4,500.

The District tax rate of $1.40 covers $1.00 per $100 for operation
of the water department and fire protection, and $0.40 per $100
for payment of bonds.
The City of Redding tax rate of $1.92 includes bond payments and
street lighting. The additional $0.30 tax rate in Redding Ranchettes
would be absorbed by City and included in the City $1.92 tax rate.
The State Board of Equalization estimates the City will collect an
additional $32,780 in sales and use tax in the proposed annex and
the County will lose. the same amount. The City will be assuming
certain functions such as police protection and road maintenance
that is now provided by. County.
Proponents state this proposal is made as the best course of action
for provision of long-range water supply, fire protection, parks and
recreation, street lighting, and the most economical electrical
service. Sewer service eventually could come to the area by formation
of sewer assessment district and would be more economical if area were
within City boundaries, as the City main line goes through Cascade area.
Assuming the City does not object to the two changes in organization,
they can be handled as a single "reorganization" under the District
Reorganization Act of 1965 (Government Code §56003.1). It is anti-
cipated that the City Council will consider such approval at its
meeting of March 9, 1976. If no objection is made, it is recommended
that the reorganization be approved subject to the following conditions:
1. That the annexation election be held only within the area to be
annexed.
2. That the ballot measure read substantially as follows:
"Shall the order adopted on 1976, by
the Board of Supervisors of the County of Shasta
ordering an reorganization dissolving the Cascade
Community Services District and annexing the territory
thereof to the City of Redding be confirmed?"

3. That the City of Redding assume the bonded indebtedness and
all other debts and obligations of the Cascade Community
Services District.
4. That the City of Redding employ those permanent employees of
the Cascade Community Services District listed in Exhibit "A"
hereto and permanently employed on the effective date of an-
nexation at a salary at least equal to that paid by the Cascade
Shasta County Local Agency

Community Services District and with employee benefits and
rights consistent with such benefits and rights offered by
the City to other comparable City employees of comparable
seniority at the time of such employment.
5. That it be the finding of the Commission that the application
of the restrictions of Government Code §35002.3 (creation of
corridors) would be detrimental to the orderly development of
the community as to this reorganization and based upon such
finding, the restrictions of said section be.waived. _.
County Counsel has advised that the effective date of the dis-
solution and annexation would be the date of recordation of the
Secretary of State's Certificate with the County Recorder (G.C.
§56455). He further advises that upon dissolution the City would
be the successor to the District for purposes of winding up the
affairs of the District (G.C. §56501(a)), that the City would succeed
to all funds and assets of the dissolved District, and that upon an-
nexation the annexing area becomes equally liable with other areas
of the City for debts and obligations of the City at the time of
annexation (G.C. §56482).
There are at present four street lighting districts located within
the area to be annexed formed under Section 19000 and following of
the Streets and Highways Code. Pursuant to §19270 of that Code,
the City may unilaterally dissolve such districts following such
annexation, and it is anticipated that they will do so.
It appears that the single act of annexation will have no impact
on the environment within the area to be annexed, and for that
reason a Negative Declaration has been prepared for adoption by
the Commission, a copy of which is attached hereto. The completed
Declaration will be filed with the County Clerk following its adoption.

Upon approval by the Commission, assuming that the City of Redding
has not objected to t1le inclusion. of the City annexation in this
reorganization, the Commission's action will be forwarded to the
Board of Supervisors to conduct further proceedings pursuant to the
Commission's approval. --_

PROJECT: Annexation of territory within boundaries of Cascade
Community Services District to City of Redding and
plan of dissolution of District
The Local Agency Formation Commission of Shasta County,
after reviewing the referenced project at its regular meeting on
March 10, 1976, has determined that such project will not have a
significant environmental effect in that the annexation merely
transfers the governmental functions of the Cascade Community
Services District to the City of Redding; the impact of such trans-
fer of governmental functions on existing and future development
within the boundaries of both the Cascade Community Services
District or the City of Redding will be negligible.
