HomeMy WebLinkAboutReso. 1976-020 - Declaring that public convenience and necessity require acquisition of easements over certain real property for public improvement, to wit, for construction and maintenance of an electric transmission line, and authorizing eminentRESOLUTION NO. 7b -,),a A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF EASEMENTS OVER CERTAIN REAL PROPERTY FOR A PUBLIC IMPROVEMENT, TO WIT, FOR CONSTRUCTION AND MAINTENANCE OF AN ELECTRIC TRANSMISSION LINE, AND AUTHORIZING EMINENT DOMAIN PROCEEDINGS THEREFOR. (GRAVES). BE IT RESOLVED by the City Council of the City of Redding as follows: Section 1. The City Council of the City of Redding finds and determines that the public convenience and necessity require the construction and completion by the City of Redding of a public improvement, to wit, an electric transmission line to serve the citizens of Redding. Section 2. The City Council of the City of Redding finds and determines that the acquisition of easements over the following described property, to wit: Parcel 1: Four easements within the east one-half of the southwest one-quarter of Section 30, T. 32 N., R. 4 W., M.D.M., Shasta County, California, each easement being 5.00 feet in width and lying 2.50 feet on each side of the following four described centerlines which are identified as 1-A through 1-D, inclusive: 1-A Commencing at Engineer's Station E.C. 114+86.65 of the Realignment Centerline of Hilltop Drive as shown on the map filed for record in Book 40 of Land Sur- veys at page 42, Shasta County Records; thence S. 20° 05'37" W., 35.00 feet to the true point of beginning of this centerline, being hereinafter referred to as Point "M"; thence, N. 20°41'09" E., 105.00 feet to the point of termination of this centerline. 1-B Commencing at the above described Point "M"; thence, S. 68043'20" E., 205.22 feet to the true point of beginning of this centerline, being hereinafter refer- red to as Point "N"; thence N. 22024'42" E., 105.00 feet to the point of termination of this centerline. 1-C Commencing at the above described Point "N"; thence S. 66027'16" E., 187.79 feet to the true point of beginning of this centerline, being hereinafter referred to as Point "P"; thence N. 24139'50" E., 105.00 feet to the point of termination of this centerline. 1-D Commencing at the above described Point "P"; thence S. 64013'05" E., 199.78 feet to a point from which Engineer's Station 108+89.73 of said Realignment Centerline of Hilltop Drive bears N. 26056'05" E., 35.00 feet, said point being the true point of begin- ning of this centerline; thence N. 26°48109" E., 105.00 feet to the point of termination of this center- line. -1- Excepting from the four easements described above, all that portion lying westerly of the west line of the east one-half of the southwest one-quarter of Section 30, T. 32 N., R. 4 W., M.D.M. Also excepting from the four easements described above, all that portion lying southerly of the northerly line of the right of way described in the Deed of Right of Way to the County of Shasta recorded in Book 486 of Official Records at page 538, Shasta County Records. Parcel 2: An easement within the west one-half of the south- east one-quarter of Section 30, T. 32 N., R. 4 W., M.D.M., Shasta County,California, being 5.00 feet in width and lying westerly of and immediately adjacent to the following described line: Commencing at the control line monument at Engineer's Station "B" 62+34.09 P.O.T. as shown on Sheet 22 of 25 of the Record of Survey of Monumentation in Shasta County on Route 5 filed for record in Book 36 of Land Surveys at page 53, Shasta County Records; thence, along the control line of Route 5 as shown on said Record of Survey of Monumentation, S. 77.71 feet (77.70 feet grid distance per said Record Survey of Monumentation) to Engineer's Station "B" 61+56.39; thence W. 155.02 feet (155.00 feet grid distance as shown on said Record of Survey of Monumentation) to the true point of beginning of this line, being a point on the westerly right of way line of said Route 5; thence, along said west- erly right of way line the following courses: N. 70.10 feet (70.09 feet grid distance as shown on said Record of Survey of Monumentation); thence N. 03°49'45" W., 35.00 feet to the point of termination of this line. Excepting therefrom all that portion of the above described easement lying southerly of the northerly line of the right of way described in the Deed of Right of Way to the County of Shasta recorded in Book 486 of Official Records at page 538, Shasta County Records. Parcel 3: Three easements within the west one-half of the southeast one-quarter of Section 30, T. 32 N., R. 4 W., M.D.M., described as follows: 3-A That portion of the south 10 feet of the northwest one-quarter of the southeast one-quarter and of the north 10 feet of the southwest one-quarter of the southeast one-quarter of said Section 30, lying east of the land described in Deed to the State of California, recorded May 1, 1962, in Book 704 of Official Records at page 18, Shasta County Records. 3-B The west 10 feet of the southerly 25 feet of that portion of the northwest one-quarter of the southeast one-quarter of said Section 30, lying east of the land described in Deed to the State of California, recorded May 1, 1962, in Book 704 of Official Records at page 18, Shasta County Records. 3-C The west 20 feet of that portion of the southwest one-quarter of the southeast one-quarter of said Section 30 lying north of Hilltop Drive as described in Deed to the County of Shasta, recorded March 9, 1956, in Book 486 of Official Records at page 538, Shasta County Records, and east of the land described -2- in Deed to the State of California, recorded May 1, 1962, in Book 704 of Official Records at page 18, Shasta County Records, is necessary for the construction and completion of the aforesaid public improvement and that the taking of said easement interest in said parcelsof real property is necessary'therefor. Section 3. The City Attorney of the City of Redding is hereby authorized, empowered and directed to: 1. Commence an action or actions in eminent domain in the Superior Court of the State of California in and for the County of Shasta, in the name of the City of Redding, to acquire the neces- sary property. 2. To incur in the name of the City of Redding and on behalf thereof, all obligations and expenses necessary to acquire the above mentioned property.
