A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE PURCHASE OF KUTRAS PARCEL 10 - TURTLE BAY,
AND AUTHORIZING THE EXECUTION BY THE MAYOR OF THE
NECESSARY DOCUMENTS TO ACCOMPLISH SUCH PURCHASE. .�

WHEREAS, on November 8, 1966 , the people of the City of
Redding, by a majority vote, authorized the City Council and its
proper officers to exercise any and all purchase options con-
tained in the Agreement between Frances W. Kutras and the City of
Redding dated March 16, 1966 , relating to the acquisition by the
City of lands commonly known as Turtle Bay, in such time and
manner as the City Council shall, in its sole discretion, determine
to be in the best interests of the City, and
WHEREAS, the afonesaid Agreement was amended on January
26, 1968, to provide for the purchase of Parcel Year 10, consisting
of approximately 18. 091 acres for $37,494. 25, on or before January
31, 1976, and
WHEREAS, it is recommended by the City Manager and the
Finance Director that Council authorize the use of community
development funds for the payment of fifty per cent of the purchase
price of this parcel, since open space grants are no longer avail-
� able, and _ � �
WHEREAS, the City Code expressly provides as one of the
. purposes and uses of transient' occupancy' tax revenues the purchase
of park and recreational land, and it is recommended that the
Council authorize the use of transient occupancy taxes for payment
of the other fifty per cent of the purchase price of this parcel,
and
WHEREAS, the City Council deems it to be in the best
interests of the City of Redding and its citizens to acquire Kutras
Parcel Year 10 in accordance with the aforesaid Agreement and Amend-
ment to Agreement,
NOW, THEREFORE, BE IT RESOLVED by the City Council of �
the City of Redding that the purchase of the parcel of land described .�

on "Exhibit A"., attached hereto and incorporated herein by refer-

ence, be and it hereby is approve8, and that the Mayor be and he
hereby is authorized to execute the escrow instructions for said
purchase for, and on behalf of the City of Redding, which provide
in part that all escrow costs relating to said purchase be paid
by the City, and the Mayor is hereby authorized to execute any and
all additional documents necessary to complete said purchase in
accordance with the provisions of the Agreement dated March 16 ,
1966 , and the Amendment to Agreement dated January 26, 1968.
BE IT FURTHER RESOLVED that community development funds �
be used to pay for fifty per cent of the total cost of this acquisi-
tion, and that transient occupancy tax revenues be used to pay for
the other fifty�per cent,
BE IT F.URTHER RESOLVED that the City Attorney be and he
� hereby is authorized to prepare escrow instructions and all other
necessary documents to acquire said parcel of land and to open an
escrow for such purchase and to incur for and in behalf ,of Ehe
City of Redding any and all necessary costs to accomplish said
purchase in accordance with the terms of the Agreement dated March
16, 1966, and the Amendment to Agreement dated January 26 , 1968.
I HEREBY CERTIFY that the foregoing Resolution was intro-
duced and read at a regular meeting of the City Council of the City
of Redding on the 5th day of January , 1976, and was duly adopted
at said meeting by the following vote:
