Fiscal Impact The cost of the architectural and engineering design far the South City Park Project is estimated at $623,050. The City of Redding (City) currently has $3.5 million in identified funding for the project, which is anticipated to cost a total of$'1 million. In October of 2023, the United States Department of Housing and Urban Development approved a $2.4 million Community Development Block Grant Section 108 Loan. The Section 108 Loan will fund the design and construction of infrastructure improvements at South City Park. The remaining funding identified for the project consists of$1.1 million in Park Development and In-Lieu funds. Staff has applied for multiple grants to make up the $3.5 million difference and expeets awards to be announced in January 2024. Since South City Park is not part af a landscape maintenance district, the new park facilities wi11 require further funding for operations and maintenance. Anticipated maintenance costs will be explored as part of the City's unmet needs workshop in March. Alternative Action The City Council (Council) could choose not to award the cantract to Gates & Associates and provide staff with an alternate direction. Report to Redding City Council January 12,2024 Re: 4.6(a)--Award RFP Schedule 5418 Page 2 Background/Analysis At their June 21, 2022 meeting, the Council approved a concept to reimagine South City Park and authorized staff to refine the concept, develop a program, and estimate project costs with assistance from Project for Public Spaces. At the December 6, 2022 Council meeting, Council approved the resulting South City Park Activation Plan and a grant application for the Outdoor Recreation Legacy Partnership (ORLP) program. Staff submitted the ORLP grant application, and CA State Parks recommended it to National Parks Service for the next competitive round. An announcement is expected in January 2024. Staff is beginning the design process for the project, which is estimated to cost $7 million for the following components of the South City Park Design and Activation Plan: • Destination playground with spray/misting/water feature; • Arrival and activities plaza; • Flex greenspace; • Pickleball court complex; • Youth area, including a skate plaza, baske�ball court, lounge areas, climbing, and rope features; • Improvements and renovations to existing restrooms, baseball field, and bocce ball courts; • Conversion of existing pathways to a walking/jogging loop with wayfmding and distance markers; • Lighting and landscaping throughout; • Sma11 dog park; and • Removal of the existing tennis courts and basketball courts. As part of the design process, the City must contract with qualified design firms to create buildable plans for project construction as outlined above. On October 23, 2023, the City issued a Request for Proposal (RFP) for architectural and engineering services to design South City Park. The RFP resulted in five firms submitting proposals, listed as follows: • Gates &Associates; • NJA Architecture; • Melton Design Group; • Roach & Calnpbell; and • CALA. A �hree-member selection panel, consisting of City staff from the Engineering Division and the Community Services Department, evaluated the proposals based on the criteria outlined in the RFP. The criteria consisted of project understanding, project approach, responsible personnel, project schedule and related experience, which included a minimum of three references. Following the review of the proposals and ranking by staff, the group selected Gates & Associates as their overall recommendation. Report to Redding City Council January 12,2024 Re: 4.6(a)--Award RFP Schedule 5418 Page 3 It was the opinion of the selection panel that Gates & Associates delnonstrated an ability to meet the objectives of the RFP, fully understood the activation plan, and related the importance of creating the perception of safety through design. The consultant had several examples of park projects and many with similar renovations. Their team makeup also scored highly. They were one of only two consultants that submitted proposals with a team that included a skate park design firm, which will be necessary for the youth area's skate plaza. Lastly, when City staff contacted their references, Gates & Associates were highly recommended by previous clients. The RFP is a qualification-based selection process. Following the proposal review and coming to a group consensus, staff evaluated the cost proposal and determined the proposed costs are consistent with pre-proposal estimates and they provide good value for the services included. Additionally, Gates &Associates' cost proposal was the lowest received. Environmental Review This action is not a project as defined under the California Environmental Quality Act(CEQA), and no further action is required. On December 6, 2022, Council found that the project is categorically exempt from review under the CEQA Guidelines, per Sections 15301(d) —Existing Facilities, 15302(c) — Replacement or Reconstruction, and 15303(d & e) - New Construction or Conversion of Existing Structures. Attachments Consulting and Professional Services Contract - Signed Previous Staff Report- Grant Application- December 6, 2022 Previous Staff Report- Grant Application- June 6, 2023 Previous Staff Report-Approve Funding Changes -November 1, 2022 CITY OF REDDING CONSULTING AND PROFESSIONAL SERVICES CONTRACT THIS CONTRACT is made at Redding,California,by and between the City of Redding("City"), a municipal corporation, and Gates & Associates ("Consultant") for the purpose of design and engineering seiti�ices for the Soutli City Park Project. WHEREAS, City does not have sufficient personnel to perform the services required herein thereby necessitating this Contract for personal services. NOW, THEREFORE, the Parties covenant and agree, for good consideration hereby acknowledged, as follows: SECTION 1. CONSULTANT SERVICES Subject to the tenns and conditions set forth in this Contract, Consultatit shall provide to City the seivices describcd in Exhibit A,attached and incoiporated herein. Consultant shall provide the services at the time, place and in the inamier specified in Exhibit A. SECTION 2. COMPENSATION AND REIMBURSEMENT OF COSTS A. City shall pay Col�sultant for services rendered pursuant to this Contract, at tl�e times and in the manner set forth in Exhibit B, attached and incaiparated herein, in a total amount not to exceed six hundred twenty-three thousaud fifty dollars ($623,050.00). This sum includes all out-of-pocket travel, lodging and incidental expenses incun-ed by Consultant tl�at are reasoilably associated with the provision of services under this Contract. The payments specified herein shall be t}�e only �ayrnents to be made to Const�ltant for services rendered pursuailt to this Contract. B. Consultant shall submit monthly invoices to City for work completed to the date of the invoice. All invoices shall be itetnized to reflect the einployees perfonning the requested tasks, the billing rate for each employee and the hours worked. C. All correct,complete and undisputed invoices sent by Consultant to City shall be paid within thirty(30) calendar days of receipt. D. Pursuant to Section 1781 of the Labor Code, Consultant is adviscd that tl�e work contemplated iii Sections 2.3 through 2.5, inclusive, of Exhibit A in this contract is subject to the pa}nnent of prevailing wages and all other requirements of the Prevailii�g Wagc Law. The prevailing wage of each job classification may be found by inquiry with the California Departnient of Industrial Relations. Coilsultant shall comply with all laws i-elated to the performance of public work including, but not limited to, tt�e employment of apprentices pursuaut to Section 1777.5 of the Labor Consultinb and Professional Serviccs Agrectnent Pagc 1 Gates&Associates—Soutl�City Park Project(GXXXXX) code, work day/week hours and overtilne i�ates pursuant to Sections 1813 and 1815 of the Labor Code in regards to payment of prevailing wages and to provide the City of Redding and Department of I�idustrial Relations certified payrolls when required. A certified copy of all payroll records relative to this project shall be submitted to the City of Redding along with the related invoice. Receipt of certified pa}n-oll records is a prerec�uisite to receiving payment. E. No Consultant or subconsultant may be listed on a bid proposal for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5. No Consultant or subconsultant may be awarded a contract for public work on a public works project unless registered with the Department of Indlistrial Relations pursuant to Labor Code Section 1725.5. All Consultants and subconsultants must fui-nist� electronic cei-tified payroll records to the Laboy Commissioner. This requirein�nt applies to all public works projects, whether new or ongoing. Consultant is further advised that the work contemplated herein is subject to campliance monitoring and enforcement by the Department of Industrial Relations. SECTION 3. TERM AND TERMINATION A. Consultant shall cominence work on or about January 21, 2024 and complete said work no later than January 21, 2026. Time is �f the essence. B. If Consultant fails to perfonn its duties to the satisfactior� of City, or if consultant fails to fulfill in a titnely a17d professional manner its obligations under this Contract, then City shall have the right to tenninate t1�is Contract effective inm�ediately upon City giving written notice thereof to Consultant. C. Either Party may terminate this Contract without eause on thirty(30) calendar days' written notice. Notwithstanding the preceding, if the teim set forth in Section 3.A. of this Contract exeeeds ninety(90)calendar days in duration, Consultant's sole right to terniinate shall be limited to tennination for cause. D. Consultant hereby acknowledges and agrees tl�at the obligation of Ciry to pay under this Contract is contingent upon the availability of City's funds which are appropriated or allocated by the City Council. Should the Punding for the project and/oi� work set forth herein not be appropriated or allc�cated by the City Council, City may termir�ate this Agreement by fuinishing at least thirty (30) caleildar days' written notice of its intention to terminate. In the event of a tennination pursuant to this subdivision, Consultant shall tiot be e�ititled to a remedy of acceleration of payments due over the term of this Agreement. The Parties acknowledge and agree that tl�e power to tenninate described herein is required by Article 16, Sectiol� 18, of the Califoi7lia Constitution, and that constitutional provisic�n supersedes any law, rule, regulation or stahrte which confliets with the provisions of this Sectian. In the event that City gives notice of termination, Consultant shall proiiiptly provide to City any and all finished and unfinished reports, data, shadies, photographs,chai�ts or other work product prepared by Consultant pursuant ta this Conh•act. City shall have full ownership, including, but not limited to, intellectual property rights, aud control of all such finished and unfinished reports, data, studies, photographs, charts or other work product. F. In the event that City tei-�nii�ates the Contract, City shall pay Consultant the reasonable value of services rendered �y Consultant pursuant to tl�is Contract; provided, however, that City shall not in any malmer be liable for lost profits which r��ight have been inade by Consultarit had Consultant conzpleted the services required by this Contract. Consultaizt shall, not later than ten (10) ealendar days after ter-mination of this Contract by City, fiirnish to City such financial information as in the judgment of the City's representative is necessary to determine the reasonable value of the services rendered by Consultant. G. In no event sl�all the termination or expiration of this Contp-act be coi�strued as a waiver of any right to seek reiiledies in law, equity or otherwise for a Party's failure to perfornl each obligation requit�ed by this Contract. SECTION 4. MISCELLANEOUS TERMS AND CONDITIONS OF CONTRACT A. City shall make its facilities accessible to Consultant as required for Consultant's performance of its services under tl�is Contract, and, Up0I1 leC]UESt Of COI1Sl1It111t, provide labor and safety equiprnent as required by Consultant for sucli access. B. Pursuant to the City's business license ordinance, CoYlsultant shall obtain a City business license prior to comn�encing work. C. Consliltant represeuts and warrants to City that it has all licenses, permits, qualifications and approvals of any nature whatsoever that are legally required for Consultant to practice its profession. Consultant represeiits and warrailts to City that Consultant shall, at its sole cost and expense, keep in effect or obtain at all times during the term of this Conn•act any licenses, pern�its and approvals that are legally required for Consultant to practice its profession. D. Consttltant sllall, durii7g the entire tenn of tllis Corltract, be construed to be an independent contractor and nothing in this Contract is intended, nor shall it be constn�ed, to create an ernployer/employee relationship, association, joint venture relationship,tlust or partnership or to allow City to exercise discretion or control over tl�e professional mariner in which Consultant perfonns under this Contract. Any and all taxes imposed on Consultant's income, im�osed or assessed by reason of this Contract or its perfoi-�nance, including but not limited to sales or use tax�s, shall be paid by Consultant. Consultant shall be responsible for any taxes or penalties assessed by reason of any clainis that Consultant is an employee of City. Consultant shall not be eligible for coverage under City's workers' coii�pensation insurance plan, Consulting and Professional Services Agrecment Page 3 Gates&Associates—South City Park Project(C-XXXXX) benefits under the PuUlic Employee Retirement System or be eligible for any other City benefit. E. No provision of this Contract is intended to,or shall be for the benefit of,or construed to create rights in, or gl•ant r•e�nedies to, any persor� or entity not�a party hereto. F. No portioi� of the work or services to be performed under this Contract shall be assigned, transferred, conveyed or subcontracted without the prior written approval of City. Consultant may use the services of independeut contractors and subcontractors to perfonn a portion of its obligations under this Contract with the prior written approval of City. Independ�nt contractars and subcontractors shall be provided with a copy of this Contract and Consultant shall have an affirniative duty to assure that said independent contractors and subcontractors comply with the same and agree to be bound by its tenns. Consultant shall be the responsible party with respect to all actions of its independent contractors and sul�contraetors, and shall obtain such insurance afld indemnity provisions fi•om its contractors aild subcontractors as City's Risk Manager shall deterniine to be necessary. G. Consultant, at such times and in such form as City may require, shall furnish City with such periodic reports as it may request pertaining to the work or services undertaken pi�rsuant to this Contraet, the costs or obli�ations incurred or to be incun�ed in connection therewith, and any other matters covered by this Contract. H. Consultant shall inaintain accounts and records, ii�cluding personnel, property and fiilancial reeords, adequate to identify and account for all costs pertaining to this Contract and such other records as may be deemed necessary by City to assure proper accounting for all project funds. These records shall be made available for audit purposes to state aud federal authorities, or any authorized representative of City. Consultant shall retain such records for three (3) years after the expiration of this Contract, unless pi-ior pen�nission to destroy then� is granted by City. I. Consultant shall perfor�n all services required pursuaiit to this Contract in the manner and according to the standards observed by a competent practitioner of Consultant's profession. All products of whatsoever nature which Consultant delivers to Ciry pursuant to this Contract shall be prepared in a professional manner and confoi�n to the standards of quality noi7nally observed by a person practicing the profession of Consultant and its agents, employees and subcontractors assigned to perfonn tl�e serviees conteinplated by this Co»tract. J. All completed reports and other data or documents, or computer media including diskettes, and other rnaterials provided or prepared by Consultant in accordance with this Contract are the property of City, and may be used by City. City shall have all intellectual property rights ii7cluding, but not lirnited to, copyright and patent rights, in said documents,coinputer media,and othei•rnaterials provided by Consultant. City sliall release, defend, indemnify and hold l�armless Consultant from all claims, costs, Consulting and Professional Services Agreement Page 4 Gates&Associates—Soutl�City Park Project(GXXXXX) expenses, damage or liability arising out of or resulting from City's use ar modificatiot� of any reports, data, documents, di-awings, specifications or otl�er work product prepared by Consultant,except for use by City on tl�ose portions of the City's project for which such items were prepared. K. Cotlsultant, including its einployees, agents, and subconsultants, shall not maintain or acquire any direct or indirect interest that conflicts with the performance of this Contract. Consultaut shall comply with all requirements of the Political Refonn Act (Government Code § 8100 et seq.) and other laws relating to conflicts of interest, including the following: 1) Consultant shall not make or participate in a decision made by City if it is reasonably foreseeable that tbe decision may have a material effect on Consultant's economic interest, and 2) if required by the City Attorney, Cousultant shall file financial disclosure forms with the City Clerk. ECTION 5. INSURANCE A. Unless modified ui writing by City's Risk Manager, Consultant shall maintain the following noted insurance during the dt�ration of the Contract: Covera�e Required Not Required Commercial General Liabllity X Comprehensive Vehicle Liability X Warkers' Compensation and Employers' Liability X Professiona] Liability(EiYors and Omissions) X (Place an"x"in the appropriate box) B. Coverage shall be at least as broad as: 1. Insurance Services Office form number CG-0001, Commercial General Liability Insurance, in an amount not less than$1,000,000 per occurrence and $2,000,000 ;eneral aggregate for bodily injury, personal injury aud property damage; 2. Insurance Services Office for�i�number CA-0001 (Ed. 1/87), Comgrehensive Automobile Liability Insurance, which provides for total limits of not less than $1,000,000 combined single lin�its per accideilt applicable to all owned, non-owned and hired vehicles; 3. Statutory Workers' Compensation required by the Labor Code of the State of Califoniia and Elnployers' Liability Insurance in an amount not less than $1,000,000 per occurrence. Both the Workers' Cornpensation and Employers' Liability policies shall cotltain the il�surer's waiver of subrogation Gonsulting and Professional Services Agreement Page 5 Gates&Associates—South City Park Project(C-XXXXX) in favor of City, its elected officials, officers, employees, agents and volunteers; 4. Professional Liability (Errors and Omissions) Insurance, appropiiate to Consultant's profession, against loss due to error or omission or malpractice in an amount not less tl�an $1,000,000. 5. The City does not accept insurance certificates or endorsements with the wording "but only in the event of a named insured's sole negligence"or any other verbiage limiting the insured's insurance responsibility. C. Any deductibles or self-insured retentions must be declared to and approved by City. At the option of the City,either: the insurer shall reduce or eliminate such deductibles or self-insured retentions as respects the City, its elected officials, officers, employees, agents and volunteers; or the Consult�ant shall procure a bond guaranteeing payment of losses and related investigations, claims adTninistration and defense expenses. D. The General Liability shall contain or be endorsed to contain the following provisions: l. City, its elected officials, officers, employees, and agents are to be covered as additioual iilsured as respects liability arising out of work or operations perforn�ed by or on behalf of Consultant; premises owtled, leased or used by Consultant; or automobiles owned, leased, hired or bon-owed by Consultant. The coverage shall contain no special limitations on tl�e scope of protection afforded to City, its elected ofticials, ofticers, employees, agents and volunteers. 2. The insurance coverage of Consultant shall be primary i�lsurance as respects City, its elected officials, officers, employees, agents and volunteers. Any insurance or self-insurance maintained by City, its elected officials, ofticers, employees, agents and volunteers, shall be in excess of Consultant's insurance a11d shall uot contribute with it. 3. Coverage shall state that the insurance of Cousultant shall apply separately to each insured against whom claini is made or suit is brought, except with i-espect to the limits of ihe i�lsurer's liability. 4. Each insurance policy required by this Contract shall be endorsed to state that coverage shall not be canceled except after t�lirty (30) calendar days' prior written notice l�as been givcn to City. In additioti, Consultant agrees tl�at it shall not reduce its coverage or limits on any such policy except after tl�irty (30) calendar days' prior written notice has beep given to City. Insurance is to be placed with insurers with a current A.M.Best's rating of no less than A-VII. F. Consultant shall designate the City of Redding, 777 Cypress Avenue, Redding, CA 96001 as a Certificate Holder of the insurance. Consultant shall fiirnish City witl� certificates of insurance and original endorsements effecting the coverages required by this clause.Certiticates and endorsements shall be submitted electronically via the PINS Advantage systeln. A link will be provided for tl�e Consultant, or their insurance a�ent, to enter and upload documents directly to PINS Advautage. The certificates and endorsements for each insurance policy are to be signed by a person authorized by the insurer to bind coverage on its behalf. All endorsements are ta be received and approved in PINS Advantage by the City's Risk Manager prior to the coinmencement of contracted services. City rnay withhold pa}nnents to Consultant if adequate certificates of insurance and endot�sements required have not been submitted as described above or provided in a timely manner. G. The requirements as to the types and limits of instu-ance coverage to be maintained by Consultant as required by Section 5 of tt�is Coiltract, and any approval of said insurance by City, are not intended to and will not in any manner limit or qualify the liabilities and obligations otherwise assumed by Consultant pursuant to this Coi�tract, including, without limitation, provisions concerning indemnification. H. If any policy of insurance required by this Section is a"claims made"policy,pursuant to Code of Civil Procedure y� 342 and Government Code § 945.6, Consultarit shall keep said insurance in effect for a period of eighteen(l 8)months after the ternlination of this Contract. I. If any damage, including death, personal injury or property damage, occurs in connection with the perfoi-�nance of this Contract, Consultant shall immediately notify City's Risk Manager by telepl�one at (530) 225-4068. No later tl�an three (3) calendar days after the event, Consultant shall submit a written report to City's Risk Manager containing the following information,as applicable: 1)name and address of injured or deceased person(s);2)name and address of witnesses; 3)name and address of Consultant's insurar�ce company; and 4) a detailed description of the damage and whether any City property was involved. SECTION 6. INDEMNIFICATION AND HOLD HARMLESS A. Consistent with Califonlia Civi] Code § 2782.8, when the services to be provided under tl�is Contract are design professional seivices to be perfonned by a design professional, as tl�at tenn is defined under Section 2782.8, Consultant shall, to the fullest extent permitted by law, indemnify protect, defend and hold harniless, City, its elected officials, officers, employees, and agents, and each and evei-y one of them, � from and against all actions, damages, costs, liability, claims, losses, penalties and expenses (i»cluding, but not limited to, reasonable attoi7�ey's fees of the City Attorney or legal counsel retained by City, expert fees, litigation costs, and Consulting and Professional Services Agreement Page 7 Gates&Associates—Soutl�City Park Project(C-XXXXX) investigation costs) of every type and description to which any or all of thenz may be subjected by reason of, ol� resulting from, directly or indirectly, the negligence, recklessness, or willful misconduct of Consultant, its �fficers, emplayees ar agents in the�erformance of professional services under this Contract,except when liability arises due to the sole negligence, active negligence or misconduct�of the C�ity. B. Other than in the performance of professional services by a design professional, which is addressed solely by subdivision (A) of this Section, and to the fullest extent permitted by law, Consultant shall indemnify protect, defend and hold hari�nless, City, its elected officials, officers, employees, and agents, and each and every one of them, froin and against all actions, damages, costs, liability, clain�s, losses,penalties and expenses (including, but not limited to, reasonable attorney's fees of the City Attorney or legal counsel retained by City, expert fees, litigation costs, and investigation costs) of every type and description to which any or all of theln may be subjected by reason of the perforniauce of the services required under this Contract by Consultant its ofticers, employees or agents in the perfoY7nance of professional seivices under this Contract, except when liability arises due to the sole negligeuce, active negligence or misconduct of the City. C. The Consultant's obligation Co defend, indemnify and hold harn�less shall not be excused because of the Consultant's inability to evaluate liability. The Consultant shall respond within ttiirty (30) calendar days to the tender of any claim for defense and indemnity by the City, unless this time has been extel�ded in writing by the City. If the Consultant fails to accept or reject a tender of defense and indemnity in writing delivey-ed to City within thirty (30) calendar days, in additiou to any other remedy authorized by law, the City may withhold such funds tl�e City reasonably considers necessary for its defense and indemnity until disposition has been made of the claim or until the Consultant accepts or rejects the tender of defense in writing delivered to the City, whichever occurs first. This subdivision shall not be constr�ued to excuse the prompt and continued pei-fonnance of the duties required of Consultant herein. D. The obligation to it�denZnify, protect, defend, and hold harmless set forth in this Section applies to all clainls and liability regardless of whether any insura»ce policies are applicable. The policy limits of said insuranee policies do not act as a limitation Lipon the amount of indetnnification to be provided by Consultant. E. City shall have the right to approve or disapprove the legal couilsel retained by Consultant pursuant to this Section to represent City's interests. City shall be reimbursed for all costs and attorney's fees incun-ed by City in enforcing the obligations set forth in this Section. SECTION '7. CONTRACT INTERPRETATION, VENUE AND ATTORNEY FEES A. This Contract shall be deemed to have been entered into in Redding, California. All questions regardirlg the validity, interpretation or perfonnance of arly of its tenns or Consulting and Professional Services Agreement Page 8 Gates&Associates—South City Park Project(C-XXXXX) of any rights ar obligations of the parties to this Contract shall be governed by California law. If any claim, at law or otheivvise, is made by either- party to this Contract, the prevailiilg party sl�all be entitled to its costs and reasonable attorneys' fees. B. Fiscal Impact Approving the conceptual plan has na direct fiscal impact. This decision will set a course in motion to secure the funding necessary to construct this park design. The Outdoor Recreation Legacy Partnership (ORLP) Program grant application will request up to $3.5 million to begin phase one construction of the South City Park (Park) improvements. The ORLP Program requires a 50 percent match, which will be sourced from the CDBG Section 108 Loan authorized by the City Council (Council) at the November 1, 2022, meeting and additional park development and grant funds. Funding for phase two elements of the Park project will reguire alternate funding sources and/or additional grants. Background/flnalysis South City Park, Redding's oldest park, is nearly 100 years old and is uniquely poised to serve the community. It has, within its boundaries, a baseball fie1d, bocce ball courts, tennis courts, a basketball court, walkways, and open grassy areas for picnicking, sitting, and other informal uses. In recent years, community utilization decreased, and the Park needed revitalization to return to its original vibrancy. On November 16, 2021, staff presented a proposal to the Council, recommended by the Community Services Advisory Commission, to conduct a broad community engagement effort regarding the future of the Park. Since the City Council approved a thorough community process to address the future of the Park in November 2021, the Community Services Department has launched a series of engagements. Three open houses were conducted — two in-person and on-site and another through Zoom. Coinmunity Services Department staff led discussions and used pop-up boards to collect data that reflects the priorities of the community. Staff also created an online survey in order to reach greater community engagement and reach those who were not able to be heard or were unable to attend open houses. From December 1 through J�anuary 19, the public survey collected almost 1,300 responses. Results highlighted the difficulty in accessing the park by foot or bike and the perception of a current lack of safety when utilizing the Park. Staff retained the services of Project for Public Spaces (PPS), a multi-disciplinary firm that has facilitated many public placemaking community engagement efforts, published multiple studies and reports on the subject, and assisted communities in reactivating neglected public spaces. PPS made two extended site visits and convened over a dozen focus groups as well as key interviews. At the June 16, 2022, meeting, the Council approved a coneept to reimagine the Park and authorized staff to refine the eoncept, develop a program, and estimate project costs with PPS. At the Council meeting on November 15, 2022, the Council requested the item be reconsidered at the December 6, 2022, meeting. The consideration is for the updated conceptual plan, including a revised layout including: • Arrival and activities plaza(7,300 sq. ft.) • Destination playground (25,200 sq. ft.) • Multi-use pavilion(4,500 sq. ft.) • Covered porch (1,600 sq. ft.) • Flex lawn (26,500 sq. ft.) • Pickleball Courts (17,280 sq. ft,) • Youth area (12,000 sq. ft.) • Fenced dog area (6,000 sg. ft.) It ]ayers a variety of activities, age groups, active and passive uses, and schedules to build an attractive and active public space. The design for the Park creates a new focal entry point, a circulation pattern, an. arrangement of activity spaces, and other necessary features such restrooms, storage, tables, chairs, benches, bike racks, and portable play items. The suggested program matrix (page 28-31) includes a variety of daily, weekly, monthly, and annual events with seasonal offerings such as musical performances, specialty markets, lawn game tournaments, chili cook-offs, Paesano Days, Library programs, and more. Construction costs are estimated at $8-$10 mi]lion, which exceeds the existing $2.5 miIlion budget, and staff is seeking additional funding to begin engineering and construction of the plan. The ORLP is a National Park Service (NPS) grant program focusing on communities with little to no access to nearby, publicly available, outdoor recreation opportunities in urban areas. The program funds the acquisition or development of new parks and substantial park renovations in economically disadvantaged cities or towns of at least 30,000 people. I7se of this grant source will require the City to ensure that South City Park remain an outdoor recreation use area into perpetuity. ORLP includes two competitive processes. California's Department of Parks and Recreation reviews applications, selects finalists, and then forwards the finalists to the National Park Service for a nationwide review. Applications are due December 15, 2022, and the estimated award date is January 1, 2024. The application will request approxiinately $3.5 million to implement phase one of construction, which could include features such as the playground, pickleball courts, flex lawn, entry plaza, and youth area. Staff anticipates needing additional funding sources for the remaining project elements that will be considered by the Council at a future meeting. Envi�^onmental Review Staff has determined that the project is categorically exempt from review under the California Environmental Quality Aet (CEQA) Guidelines, per Sections 15301(d) — Existing Facilities, 15302(C) — Replacement or Reconstruction, and 15303(d & e) - New Construction or Conversion of Existing Structures. Class 1 exemptions include the minor alteration of existing public structures and facilities. Class 2 exemptions consists of replacement or reconstruction where the new structure will be loeated on the same site and will have substantially the same purpose and capacity, Class 3 exemptions consist of construction and location of new small facilities and equipment, or conversion of existing structures. The existing park will be renovated to meet public recreational needs with modern accessible amenities that meet public safety standards. The project will be located on the same site, will have the same purpose and capacity, and will result in a negligible expansion of use. The action area does not have significant values for wildlife habitat or other environmental resources and the project has no potential to have a significant effect on the environment. If the City receives a grant, the National Park Service wi11 conduct a coordinated National Environmental Policy Act (NEPA) review with the City. No fiirther action is required at this time. This grant program will not cover overhead beyond direet costs for salary and benefits. Staff is examining alternative approaches to reduce or eliminate this overhead expense. Alternative Action The Council could provide staff with alternative direction or decline ta ratify the application for this grant opportunity. At the December 6, 2022 Council meeting, Council approved the South City Park Activation Plan and a grant application for the Outdoor Recreation Legacy Partnership (ORLP)program. Staff submitted the ORLP grant application, and CA Parks recommended it to National Parks Service for the next competitive round. An announcement is expected in the next few months. Staff is seeking another grant to improve the chances of receiving funds for the South City Park project. The LWCF is a National Park Service (NPS) grant program focusing on communities with limited access to nearby, publicly available outdoor recreation opportunities in urban areas. The program funds the acquisition or development of new parks and substantial park renovations in economically disadvantaged and park-deficient areas. The City's application for LWCF funding requests approximately $3.5 million to implement phase one park construction. The NPS funds both the ORLP and the LWCF programs and will only fund one grant per project. If the City is successful with ORLP, the LWCF application will be withdrawn. Construction costs are estiinated at $7 million for the following components of the South City Park Design and Activation Plan: • Arrival and activities plaza • Pickleball courts • Destination playground • Flex lawn • Youth area with basketball and skate plaza • Fenced dog area • Lighting and landscaping throughout The California State Parks Off'ice of Grants and Local Services encouraged staff to apply for the grant as a backup to the previous ORLP application. If successful, the grant agreement will include a deed restriction requiring that South City Park remain an outdoor recreation use area in perpetuity. Adopt Resolution approving the CDBG Section 108 Program application in the amount of$3,737,000; b. Authorize the City Manager to re-appropriate funding upon approval of CDBG Section 108 Program application for design and improvements at South City Park; c. Authorize the City Manager to execute any documents necessary to modify the Section 108 Program application and facilitate the funding changes; and (2) Authorize the following actions related to the American Rescue Plan Act (ARPA) funding: a. Adopt Resolution approving and adopting the '70th Amendment to City Budget Resolution N�o. 2021-0'78 decreasing existing allocations for South City Park by $2,407,'730 and appropriating $2,40'7,'730 in ARPA funding to Block 7 project infrastructure; and b. Authorize the City Manager to execute any documents necessary to facilitate the funding changes. Fiscal Impact Should the City Council(Council) approve this item, it will switch funding sources between the Block 7 and South City Park Projects. As these are two grant-funded projects, there is no impact to the General F�und. This action will limit opportunities for staff to obtain supplemental grant funding for South City Park. Background/Analysis South City Park, Redding's oldest park, is nearly 100 years old and is uniquely poised to serve the community. It has, within its boundaries, a baseball field, bocce ba11 courts, tennis courts, a basketball court, walkways, and open grassy areas for picnicking, sitting, and other informal uses. In recent years, community utilization decreased in the park and South City Park needed revitalization to return to its original vibrancy. On November 16, 2021, staff presented a proposal to the Council, recommended by the Community Services Advisory Commission (CSAC), to conduct a broad community engagement effort regarding the future of South City Park. Following the community engagement, on March 15, 2022, the Council opted to allocate Coronavirus State and Local Fiscal Recover Funds, also known as SLFRF and American Rescue Plan Act (ARPA), toward the revitalization efforts of South City Park. Staff retained the services of Project for Public Spaces (PPS), a multi-disciplinary firm that has facilitated many public placemaking community engagement efforts, published multiple studies and reports on the subject, and assisted communities in reactivating neglected public spaces. At the June 16, 2022, meeting, the Council approved a concept to reimagine South City Park and authorized staff to refine the concept, develop a program, and estimate project costs with PPS. Construction costs wi11 exceed the $2.5 million ARPA allocation. Staff discovered, while investigating other grant funding opportunities to address the funding gap, that some available grant programs do not accept ARPA funds as a match funding source. CDBG funding, however, is an eligible source of match for most federal programs. By reallocating previously authorized CDBG Section 108 Program funds for South City Park, rather than ARPA funding, staff may seek out and apply for grant opportunities to fu]ly fund the South City Park improvements. The CDBG Section 108 Program provides communities with a source of financing for economic development, housing rehabilitation, and public facilities. The Section 108 Program loan funds are borrowed and subsequently repaid by the City through its current and future CDBG allocations over a 20-year term. The current loan application specified infrastructure improvements on the Block 7 project. Necessary Block � project improvements include water, wastewater, storm drains, and underground utility infrastructure to support income-eligible housing, a11 of which are approved uses for ARPA funding. Staff proposes to move the Block '7 improvements to the ARPA program and the South City Park improvements to the CDBG Section 108 Program. The change in allocations will unloek more funding opportunities for South City Park. Staff will return to the Council to obtain authority to apply for grants as needed. �nvir�onmental Review This action is not a project as defined under the California Environmental Quality Act (CEQA), and no further action is required. Environmental studies are in progress for South City Park, and a CEQA/NEPA determination wi11 be made prior to construction. The NEPA Authority to Use Grant Funding document was executed by the U.S. Department of Housing and Urban Development on August 19, 2019.
