HomeMy WebLinkAboutReso 82-116 - Intention to Begin Legal Proceedings of Abatement Under Chapter 9.36 of the Redding Municipal Code on Certain Real Property in the City of Redding (Owned by Arthur R Steinbach, located at 1031 Bond Street) r • • • RESOLUTION NO. 4.2'//(; A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF INTENTION TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER CHAPTER 9 . 36 OF THE REDDING MUNICIPAL CODE ON CERTAIN REAL PROPERTY IN THE CITY OF REDDING. (Owned by Arthur R. Steinbach and located at 1031 Bond Street. ) WHEREAS , the provisions of Chapter 9 . 36 of the Redding Municipal Code provide that all buildings or structures located within the City of Redding which are structurally unsafe or are dilapidated from old age, neglect, decay or other causes which constitute a fire menace or are dangerous to human life or a likely resort for vagrant or dissolute persons , may be declared a nuisance by the City Council of the City of Redding and thereafter abated as provides therein, and WHEREAS , the Fire Marshal has made an inspection of the building located on real property as hereinafter described , and has declared it to be unsafe and/or a hazard to safety, health and public welfare, and WHEREAS , it has been determined that this matter is categorically exempt from the provisions of CEQA, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows : That it is the intention of this City Council to begin legal proceedings of abatement under Chapter 9 . 36 of the I` Redding Municipal Code on the following described property : Situate in the City of Redding, County of Shasta, State of California, described as follows : COMMENCING at the Northwest corner of Section 8 , Township 31 North, Range 4 West, M. D.M. and run- ning thence South 89°18 ' East 20 . 0 feet; thence South 0°41 ' 16" East on and along the Easterly boundary of the county road 496 . 50 feet to the true point of beginning of this description; beginning at said point and running thence South 89°19 ' 30" East 200 . 0 feet; thence South 0°41 ' 16" East 86 . 16 feet; thence North 89°21 ' West 200. 0 feet; thence North 0°41 ' 16" West 86 . 25 feet to the point of beginning. BE IT FURTHER RESOLVED that said building mentioned hereinabove is hereby declared to be a public nuisance as provided by Chapter 9 . 36 of the Redding Municipal Code , and is hereby ordered to be abated by repair , rehabilitation , demolition or removal . BE IT FURTHER RESOLVED that the Fire Marshal and the Board of Appeals of the City of Redding are hereby directed to take all proceedings provided in Chapter 9 . 36 of the Redding Municipal Code. BE IT FURTHER RESOLVED that the City Clerk of the City of Redding be and is hereby authorized and directed to forward a certified copy of this Resolution to the Shasta County Recorder for recordation.
