HomeMy WebLinkAboutReso. 1981 - 275 - Intention to begin legal proceedings of abatement under 9.36 RMC on 1122 Willis StreetRESOLUTION NO. ul z7S A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF INTENTION TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER CHAPTER 9.36 OF THE REDDING MUNICIPAL CODE ON CERTAIN REAL PROPERTY IN THE CITY OF REDDING. (Owned by Luise Y. Reed,'1122 Willis Street). WHEREAS, the provisions of Chapter 9.36 of the Redding Municipal Code provide that all, buildings or structures which are structurally unsafe, or are.dilapidated from old age, neglect, de- cay or other causes within the City of Redding, which constitute a fire menace or are dangerous to human life, or a likely resort for vagrant or dissolute persons, may be declared a nuisance by the City Council of the City of Redding and thereafter abated as provided therein, and WHEREAS, the. Fire Marshal has made an inspection of the building located on real property as hereinafter described, and has declared it to be unsafe and/or a hazard to safety, health and 1 public welfare, and WHEREAS, it has been determined that this matter is cate- gorically exempt from the provisions of CEQA, NOW, THEREFORE, BE IT RESOLVED by the.City Council of the City of Redding, as follows: I That it is the intention of this City Council to begin legal proceedings of abatement under Chapter 9.36 of the Redding Munic'ioal Code'on;,the property described in "Exhibit'A",.attached hereto. ;BE IT- FURTHER -RESOLVED that -said building mentioned here- inabove is hereby decl°a red to�be a public nuisance as provided by Chapter 9.36 of the Redding Municipal Code, and is hereby ordered 00 to be abated by repair, rehabilitation, demolition, or removal. -1- '1 / BE IT FURTHER RESOLVED that the Fire Marshal•and"the Board,of Appeals of the City "of Redding are hereby directed to take all proceedings provided in Chapter 9.3'6 of the Redding Municipal Code. BE IT FURTHER RESOLVED that the City Clerk pf'the City of Redding, be and she'is hereby authorized.and directed,to forward a certified copy of'this Resolution to the .County Recorder of, Shasta'County',for,recordation. A, 7HAYS,.CityOAttorney '. -2- 0 Real property situate in the City of Redding, County of Shasta, State of California, described as follows: COMMENCING at a point on the West line of Willis Street in Breslauer's Addition to the Town, now City, of Redding, 66 1/2 feet Northerly from the corner common to Lots 1 and 2, Block 7, and run thence Northerly along the West line of Willis Street 86 1/2 feet to a stake at the Southerly side of the Old Shasta Road; thence running West along the South line of said road 99.70 feet, more or less, to the East line of that certain tract of land conveyed to William Ladeveze, by Deed dated August 30, 1938, recorded October 21, 1938 in Book 142 of Official Records at page 133; thence run Southerly and parallel with the East line of said Lot 1, 117.00 feet; thence Easterly and parallel with the South line of said Lot 1,95.00 feet to the point of beginning. EXCEPTING THEREFROM all that portion described in the Final Order of Condemnation, in favor of. the State of California, dated December 13, 1956, recorded December 13, 1956 in Book 516 of Official Records at page 126, Shasta County Records.
