HomeMy WebLinkAboutReso 82-094 - Intention to Begin Legal Proceedings of Abatement Under Chapter 9.36 of the Redding Municipal Code on Certain Real Property in the City of Redding (Owned by George and Louise Miller, 530 Hartnell Avenue) • • RESOLUTION NO. g.2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF INTENTION TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER CHAPTER 9 . 36 OF THE REDDING MUNICIPAL CODE ON CERTAIN REAL PROPERTY IN THE CITY OF REDOING. (Owned by George and Louise Miller , 530 Hartnell Avenue. ) WHEREAS , the provisions of Chapter 9 . 36 of the Redding Municipal Code provide that all buildings or structures which are structurally unsafe, or are dilapidated from old age, neglect, de- cay or other causes within the City of Redding, which constitute a fire menace or are dangerous to human life, or a likely resort for vagrant or dissolute persons , may be declared a nuisance by the City Council of the City of Redding and thereafter abated as provided therein , and WHEREAS , the Fire Marshal has made an inspection of the building located on real property as hereinafter described, and has declared it to be unsafe and/or a hazard to safety , health and public welfare , and WHEREAS, it has been determined that this matter is cate- gorically exempt from the provisions of CEQA, NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of Redding , as follows : That it is the intention of this City Council to begin legal proceedings of abatement under Chapter 9 . 36 of the Redding Municipal Code on the property described in "Exhibit A" , attached hereto . BE IT FURTHER RESOLVED that said building mentioned here- inabove is hereby declared to be a public nuisance as provided by Chapter 9 . 36 of the Redding Municipal Code, and is hereby ordered ti 4— • • to be abated by repair, rehabilitation, demolition, or removal . BE IT FURTHER RESOLVED that the Fire Marshal and the Board of Appeals of the City of Redding are hereby directed to take all proceedings provided in Chapter '9 . 36 of the Redding Municipal Code . BE IT FURTHER RESOLVED that the City Clerk of the City of Redding be and she is hereby authorized and directed to forward a certified copy of this Resolution to the County Recorder of Shasta County for recordation . HAYS , City/Attorney J• EXHIBIT A • • DESCRIPTION The real property referred to in this guarantee is situate in the City of Redding, County of Shasta, State of California, described as follows: Lot 3, in Block 2 of PARSONS SUBDIVISION, as per map filed July 9 , 1946 in Book 6 of Maps at page 19, Shasta County Records. • EXCEPTING THEREFROM all that portion of Lot 3 in Block 2 of Parsons Subdivision, as shown on the map filed in the office of the Shasta County Recorder in Book 6 of Maps at page 19, Shasta County Records, contained within a strip of land 42 feet in width lying Easterly of and measured at right angles, to the following described line: BEGINNING at Engineers Station 96+65.74 B.C. as established from the Shasta County Department of Public Works' 1962 Survey of County Highway Route 2H03E, and as shown on the right of way map of Bechelli Lane on file_ in the Shasta County Surveyors Office, from which a 2 inch pipe marked R.E. 6051, set at the Southwest corner of said Parsons Subdivision bears North 11°45 '43" East 144.59 feet; and running thence from a tangent that bears North 1°O1'04" West along a curve to the right havin$a radius of 15,000 feet through an angle of 1°05'16" for a distance of 284. 78 feet. ALSO EXCEPTING THEREFROM all that portion of said Lot 3 in Block 2 of Parsons Subdivision included within the following described parcel : C0iII1ENCING at Engineer's Station 97+81.00 P.O.C. , said survey of Bechelli -Lane described in first above exception and running thence North 89°25 '20" . East 62.08 feet to the point of beginning; thence North. 0°34'40" West 30.00 feet; thence from a tangent which bears South 89°25'20" West along a curve to the right having a radius of 20.00 feet through an angle of 90°11'30" for a distance of 31.49 feet; thence from a tangent which bears South 0°23'10" East along a curve to the left having a radius of 14,958 feet through an angle of 0°23'00" for a distance of 100.08 feet; thence from a tangent which bears North 0°46'10" West along a curve to the right having a radius of 20.00 feet through an angle of 90°1.l'30" for a distance of 31.49 feet; thence North 0°34 '40" West 30.00 feet tp the point of beginning. ALSO EXCEPTING THEREFROM all that portion of said Lot 3 in Block -2, of Parsons Subdivision, as described in that deed from George Miller, et ux. , to the City of Redding, which recorded June 30, 1980, in Book 1734 of Official Records at page 669, Shasta County Records.
