SUBJECT: 4.11(c)--Award Bid Negotiation No. 5408 (Job Order No. 2688) Stillwater
Wastewater Treatment Plant Facultative S1ud e La oon and Slud e Dr in Bed Pro'ect
Recommendation
Authorize the following actions relative to Bid Nego�iation No. 5408 (Job No. 2688), Stillwater
Wastewater Treatment Plant Facultative Sludge Lagoon and Sludge Drying Bed Project:
(1) Reject the apparent low bid by T & S Construction Co., Inc. as nonresponsive and award
the project to the second low bidder SnL Group, Tnc., in the amount of$7,660,744.83;
(2) Approve an additional $780,000 to cover the cost of administration and inspection fees
and$228,074 for project development costs;
(3) Approve $760,000 to provide construction contingency funding;
(4) Authorize the City Manager to approve additional increases in either the construction
management or construction contingency amounts up to a total of$50,000; and
(5) Find that the Project is categorically exempt from review under the California
Environmental Quality Act Guidelines, pursuant to Section 15301 - Existing Facilities,
Section 15302 —Replacement or Reconstruction, and Section 15303 —N�ew Construction
or Conversion of Existing Facilities.
Fiscal Impact
The Stillwater Wastewater Treatment Plant (SWWTP} Facultative Sludge Lagoon and Sludge
Drying Bed (Project) is being funded by the Wastewater Utility Fund. Sufficient funding for the
project is available in the 2023-24 Wastewater Utility budget.

construction management, and construction contingency funds may be necessary to balance the
project within the approved budget.
Alternative Action
The City Council may choose not to award the bid for the project and provide staff with alternate
direction. Without this project, staff would need to pursue other alternatives to managing
biosolids disposal at the treatment plant. This may present future regulatory and fmancial
impacts to the Wastewater Utility.
Ba ckgro u n d/f1 n alysis
Attached is a tabulation of bids received and opened on October 26, 2023, for construction of the
project. The low bid in the amount of $7,245,000 was received from T & S Construction Co.
Inc., of Sacramento, California. T & S Construction failed to list a11 subcontractors per the
project bid documents and Public Contract Code (PCC) 4104 in their proposal. Since T & S did
not list a subeontractar to complete the coating and painting on the projeet, they would be
required per PCC 4106 to self-perform this work. The City requested T & S to provide details, in
writing, regarding their intention to self-perform the work. However, no response was received.
The City Attorney's office advised and the City Engineer agrees that T & S's bid is
nonresponsive.
The second low bid in the amount of $7,660,744.83 was received from SnL Group, Inc., of
Redding, California. The engineer's estimate was $7,301,660. Total project development costs
for this project are estimated to be $228,074. Project development costs inelude engineering,
surveying, environmental, consultant services, and permit fees.
The SWWTP project includes the following items of work: construction of two facultative
sludge lagoons with LLDPE liners, floating aerators, dredge equipment, and flow splitting
facilities; construction of two concrete walled, asphalt lined sludge drying beds with underdrain
systems; installation of a 20-foot wet well and package lift station; associated yard piping, site
grading, fencing, plant road improvements, drainage systems, and associated electrical and
instrumentation improvements.
Environmental Review
Staff has determined that the project is categorically exempt from environmental review under
California Environmental Quality Act Guidelines, pursuant to Sections 15301 - Existing
Facilities, Section 15302 — Replacement or Reconstruction, and Section 15303 — N�ew
Construction or Conversion of Existing Structures. Class 1 exemptions include the operation,
repair, maintenance, or minor alteration of existing facilities, struct�ures, ar equipment involving
negligible or no expansion of use. Class 2 exemptions consists of replacement or reconstruction
where the new structure wi11 be located on the same site and will have substantially the same
purpose and capacity. Class 3 exemptions consist of construction and location of limited
numbers of new small facilities and equipment, as well as the reconstruction or conversion of
existing structures. The project involves the construction of limited numbers of new sludge
facilities and eQuipment, as we11 as the reconstruction or conversion of existing facilities and
equipment. The project will be constructed within the existing SWWTP facility and will result in
negligible expansion of use. The project area has been reviewed for sensitive resources such as
threatened or endangered species or their habitats, sensitive vegetation communities, tribal lands,
or tribal cultural resources. The project area has no potential to have a significant effect on the
environment.
