Recommendation
Authorize and approve the Agreement for Sa1e of Conservation Credits from Riparian Ranch,
LLC in an amount not to exceed $297,500, to offset long-term impacts on salmonids and
designated critical habitat for the Sacramento Drive over Olney Creek Bridge Replacement
Proj ect.
Fiscal Impact
The Sacramento Drive at 01ney Creek Bridge replacement project is 100 percent funded by the
Federal Highway Bridge Program (HBP), and the total project cost is estimated to be in the $3 to
$4 million range. There is funding within the existing budget to pay for the purchase of the
conservation credits.
Alternative Action
The City Council (Council) may ehoose not tio authorize the Agreement for Sale of Conservation
Credits (Agreement), and provide alternate direction to staff. It may be difficult to purchase
salmonid habitat conservation credits at a later date, as the mitigation banks within the approved
service area are running out of credits. Tf credits are not purchased construction approval would
not be granted.
Background/Analysis
On February 21, 2012, Council accepted federal funding from HBP for rehabilitation or
replacement of ten bridges in various locations throughout the City of Redding (City), and one of
those locations was the Sacramento Drive Bridge. Initial preliminary engineering funding of
$150,000 was allocated for this location so that staff could prepare a detailed project scope, risk
analysis, and cost estimate. This information was used to determine whether it would be prudent
for staff to pursue a rehabilitation or replacement of this bridge. From this initial analysis, it was
determined that this site required a bridge replacement, and on June 17, 2014, Council accepted
an additional $320,000 in HBP funding to complete the project design.

Since that time, the technical environmental studies have been completed. As the federal lead
agency, and in compliance with Section '7 of the Threatened and Endangered Species Act, the
California Department of Transportation (Caltrans) initiated a formal consultation with the
National M�arine Fisheries Service (NMFS) for the project. On March 23, 2022, NMFS issued a
Biological Opinion requiring the City to offset long-term impacts on salmonids and designated
critical habitat by purchasing 1.7 conservation credits at the Freemont Landing Conservation
Bank or other NMFS approved mitigation bank within critical habitat for the species.
In June 2023, the Freemont Landing Conservation Bank contacted staff to 1et us know that only
six credits remain available for purchase. Staff then contacted Caltrans to verify that the purchase
of conservation credits prior to the completion of National Environmental Policy Act (NEPA)
documentation, otherwise known as advanced mitigation, is federally reimbursable. Ca]trans
provided a written response confirming that an advanced mitigation purchase is eligible for
reimbursement.
The environmental phase is progressing, as NEPA is anticipated to be complete in December
2023 and compliance with the California Environmental Quality Act (CEQA) is anticipated to be
complete in February 2024. Once CEQA and N�EPA are complete, regulatory permits will be
obtained and the project can move to the right-of-way and construction phases. The right-of-way
appraisal and acquisition phase is anticipated to take twelve months. Advertising the project for
bids and construction is anticipated in 2025 depending on the bridge program funding
availability.
Given the limited number of mitigation banks and limited credits available within the service
area, staff is requesting Council authorize and approve an advanced mitigation Agreement for the
purchase of Conservation Credits from Riparian Ranch, LLC., in an amount not to exceed
$297,500.
Environmental Review
Authorization and approval of the Agreement is not a project as defined by CEQA or NEPA, and
no further action is required at this time. The environmental process for the project wi11 continue
forward and staff will return to Council in 2024 to request approval of the CEQA document.

This Agreement is made and entered into this day of October, 2023 by and
between RIPARIAN RANCH, LLC, a California limited liability coinpany (`Bank Owner") and
the CTTY OF REDDING, a municipal corporation("Project Proponent") as follows:
RECITALS
A. The Bank Owner has entitlements to the Fremont Landing Conservation Bank
(`Bank") located in Yolo County California; and
B. The Bank has been authorized by the National Marine Fisheries Service
("NMFS") to operate as a conservation bank with conservation credits available for sale; and
C. Project Proponent is seeking to implement the project described on E�ibit"A"
attached hereto ("Project"), which would unavoidably and adversely impact habitat thereon, and
seeks to compensate for the loss of habitat by purchasing conservation credits from Bank Owner;
and
D. Project Proponent has been authorized by NMFS Biological Opinion File No.
WCRO-2021-02995 to purchase 1.25 acres of salmonid or riparian habitat credits for the loss of
0.83 acres of riparian habitat and 0.45 acre of salmonid or shaded riparian aquatic ("SRA")
credits for the permanent loss of aquatic habitat associated with the Project; and
E. Project Proponent desires to purchase from Bank Owner and Bank Owner desires
to sell to Project Proponent 1.7 acre of conservation credits, comprised of 1.25 riparian
floodplain forest/salmonid habitat restoration(non-SRA riparian) conservation credits and 0.45
riparian floodplain forest/salmonid/SRA habitat restoration (SRA) conservation credits at Bank.
NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. Bank Owner hereby agrees to sell to Project Proponent and Project Proponent
hereby agrees to purchase from Bank Owner 1.7 acres of conservation credits, comprised of 1.25
riparian floodplain forest/salmonid habitat restoration(non-SRA riparian) conservation credits
and 0.45 riparian floodplain forest/salmonid/SRA habitat restoration (SRA) conservation credits
(collectively, the "Conservation Credits") for the purchase price of$297,500.00 ("Purchase
Price"), in accordance with the terms hereof. The Purchase Price for the Conservation Credits
shall be paid by wire transfer of funds or by check payable to "Riparian Ranch, LLC." Upon
receipt of the Purchase Price, Bank Owner will deliver to Project Proponent an executed Bill of
Sale in the form attached hereto as Exhibit"B."

2. The sale and transfe�•herein is nat intended as a sale or trans�'er to l'roject
Proponent of a secut•ity; licellse, lease, easement, or possessary or non-possesso��y interest in reai
property;nor the granting af any interest of the foregoing.
3. P�aject Proponent shall have no obligation whatsoever by reason of the purchase
of the Canservation Credits;to support,pay for;rnonitol,repar-t on,sustain, eontinue in
perpetuity; or atherwise be obligated o�•liable far the success or continuec� expense or
maintenance in perpetuity of the Conservation Credits so1d, or the Bank. As required by law;

DESCRIPTION OF PROJECT
TO BE

The proposed Project is to replace the existing Sacramento Drive Bridge over Olney
Creek with a new bridge. The purpose of the project is to better convey flood flows and to
provide a safe crossing over Olney Creek. The existing three-span, 83-foot-long, 30-foot-wide
bridge will be replaced with a two-span, 117.5-foot-long, 4&foot-wide precast,prestressed,
concrete,bridge at the same location. The new bridge will include two 12-foot wide lanes, each
with a 6-foot wide shoulder and a 5-foot wide sidewalk.
The proposed project includes multiple activities that will impact Olney Creek and its
habitat, including bridge demolition/reconstruction, stream widening/bank recontouring, stream
bottom excavation,rip-rap installation, and riparian plantings. The proposed project would be
completed over two construction seasons starting in summer 2022.
To address permanent loss of riparian and aquatic habitats, the proposed action includes
purchase of mitigation bank credits at a 1.5:1 ratio. Caltrans will purchase 1.25-acre credits of
salmonid or riparian habitat credits for the loss of 0.83 acres of riparian habitat. Caltrans will
purchase 0.45 acres of salmonid or shaded riparian aquatic (SRA) credits for the permanent loss
of aquatic habitat.

The project will provide for approximately 2,000 feet of Class ���rail conne�ting the newly
�constructed Sacramento River Trail east of the�Sacramento River,u��t�� �e hill���,����` ��'southern end�

Downtown east-west trail�and thereby allow much great��'l acces����t������`ecreational�amenities,and

on Hilltop Drive over Interstate 5. This bridge is very narrow and has limited pedestrian and cycling
facilities.
The praject is the first of a two-phase plan to provide a trail that overlooks the Sacramento River and
the Turtle Bay East Riparian Mitigation Site. This first phase will provide a direct connection from
the existing trail to Palisades Avenue. The second phase will provide a loop trail around the bluff
and will likely include interpretive signs and other public educational amenities.
This project is being pursued as a partnership with the California Department of Transportation,
which will provide right-af-way for a portion of the trail. The Shasta County Regional
Transportation Planning Agency has also extended its support of this important regional effort to
provide alternative transportation opporiunities for the community.
