A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ACKNOWLEDGING RESPONSIBILITY FOR FEDERAL FY 1982 JUVENILE JUSTICE AND DELINQUENCY PREVENTION FUNDS . WHEREAS , th'e California Council on Criminal Justice (CCCJ) has adopted certain policies regarding the sub-state alloca- tion of Federal FY 1982 Juvenile Justice and Delinquency Prevention (JJDP) funds, which, combined with subsequent action regarding allocation of these funds by the Region B Criminal Justice Planning Board , appear collectively as Attachment 1 hereto, and WHEREAS, these policies provide for the continued payment of Federal action grants to the City of Redding , upon acknowledg- ment by the City Council of a commitment to oversee related plan- ning and administrative responsibilities, - .. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redding acknowledges its responsibility to oversee FY 1982 JJDP program and administrative funds through September 30 , 1983 , in accordance with Federal and State requirements . The policies approved are attached. Briefly , they state that for a local regional planning unit to control action fund decisions , a local unit of government must also commit to a - planning and administrative responsibility . Please note the discussion on exception to Region B at the bottom of page 3 and the recommendations on page 4 (emphasis added). For the last two years , Shasta County has provided the appropriate resolution as primary beneficiary of federal funds during that time . However, should the Region B Criminal Justice Planning Board remain intact and con- sistent with prior action, it would recommend that the 1982 federal JJDP action allocation estimated at $29 , 954 be prorated between the Redding Teen Center and Redding Police Department Juvenile Officer grants for third-year funding on a 34% - 66% basis , respectively . That will be my staff recommendation to the Region B Board tentatively scheduled to meet in early June, subject to the necessary state approvals and resolution of conimitment by the Redding City Council, if you agree . BACKGROUND At its January 16 meeting, the CCCJ approved California' s application. for 1982 JJDP funds, authorized OCJP to augment continuing projects in an amount sufficient to support them through June 30, 1982, and deferred allocation of FY 1982 JJDP funds on a substate basis . The deferment was recommended since the future of both the JJDP program and the remaining local and regional planning units , because the LEAA program is phasing dorm, continue to be in question. It was anticipated that prior to the April , 1982 CCCJ meeting, the Congress would have taken final action on a measure establishing a 1982 appropriation level for the JJDP program. Instead, on March 31 , 1982 another continuing resolution was adopted . As a result, there continues to be a question of whether the JJDP program will receive its full appropriation for FY 1982. Under the authority • of the continuing resolution, states may apply for no more than one- half of their total anticipated allocation. California has applied for but not received 'its S2 million with release of the remaining 52 million contingent upon further Congressional action. Likewise, there is little certainty about the FY 1983 JJDP appropriation. As noted in OCJP' s January report to the CCCJ, a meeting was planned with representatives of local and regional planning units expected . to survive the closure of the LEAA program to prepare a recommenda- tion for allocating FY 1982 JJDP funds. On March 18, OCJP staff met with local and regional planning unit representatives . The two main items for discussion at that meeting were: o Completion. of the LEAA phase-out o Substate allocation of FY 1982 JJDP funds The first item, regarding LEAA phase-out, is dealt with in a separate CCCJ agenda item. ALLOCATION OF FY 1982 JDDP FUNDS The major issues dealt with at the March 18 meeting are :set forth below. The general agreements reached on policy items are reflected in the proposed policy recommendations . Issues discussed included: A. FY 1982 JJDP Allocations for Local Programs Options ranged from retaining the local share of funds at state level and disbursing them based on a statewide competitive - process to maintaining the status quo. It was generally agreed that the present arrangement of allocating funds to local planning units should be continued. However, OCJP did express a desire to have assurances from local government that if FY 1982 program and administration funds were allocated to a local planning unit, it will be responsible for oversight of those funds during Federal FY 1982-83 (October 1 , 1982 - September 30, 1983) . OCJP' s interest in obtaining such assurances results from some less than pleasant lessons learned during the phase-out of the LEAA program. For example, in a number of instances when planning and administration funds were exhausted and the local planning region went out of busi- ness unexpectedly that left much of the close-out work to OCJP and local units of government. It was agreed that when a local planning unit submits its application for FY 1982 program and administration funds , it should be accompanied by a resolution from a local unit of government acknowledging responsibility to . oversee funds for Federal FY 1982. It should be noted that representatives of those local planning units , which report that they may oo out of business between July 1 and September 30, 1982, disagreed with this proposal . They argued for allowing their units to allocate FY 1932 JJDP program funds to local projects absent the requirement that they oversee funds and programs for the full year. Their argument for this approach was based on the fact that their local programs would not .have to compete-for funding out of the balance-of-state share of JJDP funds. Representatives of local units which expect to survive the LEAA close-out and administer FY 1982 JJDP funds recommended a July 1 , 1982 due date for 1982 program and administration applications. !% MBERS OF THE CALF^4NIA • • COUNCIL ON CRIMINAL STICE Page Three April 6, 1982 . CThey generally agreed tliat .by July, 1- most local budgets. will have been adopted and they will have a better idea of their own staffing levels for the next fiscal year. • To provide for exceptions should they arise, it was suggested that local :units , with OCJP approval , be allowed to delay submission of their application until after July 1 but not later than October 1, 1982. It was further suggested that if a local unit asked for such an extension, it would have to give OCJP written assurance, no later than July 1, that it would comply with all Federal statutory and guidelines requirements and Council policies governing 1982 JJDP funds. The purpose of this commitment is to assure that OCJP will have sufficient information, before the local application is submitted, to satisfy reporting requirements established in Federal law and OJJDP guidelines . No changes were proposed in existing CCCJ policies governing • the division of funds between state and local government - and among local planning units and balance-of-state: B. Compliance with Federal Regulations __ The Federal JJDP Act and supporting guidelines place certain requirements on state and local grant recipients . For example, states accepting Federal funds must agree to deinstitutionalize status offenders , separate youthful from adult offenders in correctional institutions, and target at' least 30% of 1982 . funds on program which deal with serious and violent youthful offenders. • It was agreed that, as in the past, each local planning unit receiving an allocation of funds would be required to shoulder its relative share of these obligations. One exception, dealing with the 30% requirement for serious and violent offenders, was proposed. Regions "B" counties of • Lassen, Modoc, Shasta, Siskiyou, Tehama and Trinity and "M" • counties of Monterey, San Benito and Santa Cruz asked for an exemption from this requirement since the amount of funds which would result are so small that they would not be sufficient to support a separate project. OCJP will not oppose their request since a number of other local units have given assurances that they intend to allocate more than the required 30% to projects dealing with serious and violent offenders. • MEMBERS OF THE CALIFORNIA COUNCIL ON CRIMINAL JUSTICE Page Four April 6, 1982 • C. Interim Application and Project Approval At its last meeting the CCCJ authorized OCJP, should the need arise, to make administrative augmentations to continuing JJDP programs in an amount sufficient to support the project for a period not to extend past June 30, 1982. Also , it was reported that many continuing projects have sufficient funding to support them through June 30. If the Council establishes July 1 , 1982 as the submission date for 1982 JJDP applicants, it may be necessary to augment some projects so that they can continue until the CCCJ meets to review 1982 applications and projects . Based on past experience it is oftentimes difficult to schedule Council meetings during the summer months. For this reason, OCJP suggests that if the Council does not intend to meet in late June, or early July,-so that augmentations and project approvals can be dealt with, that the authority to approve : local JJDP applications and projects and state-level projects be delegated to the committees of the Council proposed under Agenda item IV. Consistent with the Council approved 1982 State JJDP Applica- tion and SAG approval would be appropriate preconditions for commitee consideration of local applications and projects and state-level projects. RECOMMENDATIONS It is recommended that the CCCJ: . . 1. Approve the Following policy: • Allocation of FY 1982 JJDP Funds As to FY 1982 JJDP funds it is the policy of CCCJ that: (1) Local applications for JJDP action and administration funds must be submitted to OCJP not later than Julu- I; 1982. Requests for deferral must be accompanied by a written commitment that the local planninq,:.unit wiill,`in-its FY 1982 application, satisfy all Federal statutory and guideline require- . ments and CCCJ policies which pertain to JJDP funds. 2. Delegate interim JJDP application and project approval authority to the local and state cor;rn ttees of the Council, proposed in Agenda Item IV.
