' � . �.�"L � v \�% RESOLUTION NO. g�'3/ A RESOLUTION OF THE CZTY COUNCIL OF THE CITY OF REDDING APPROVIIdG THE REPORT AND FINDINGS OF THE BOARD OF APPEALS AND ORDERING THE ABATEMENT OF THE UNSAFE AND UNSIGIiTLY BUILDING ON PROPERTY IDENTIFIED AS A.P. 108-120-17 , SOUTH OF 4735 CEDARS ROAD. (OWNED BY SCHROEDER/CULP) . WHEREAS, on December 7, 1981, the City Council adopted Resolution No. 81-278, a Resolution of Intention to begin abatement proceedings under the provisions of Chapter 9. 36 of the Redding Municipal Code, affecting property owned by Ron Culp and Sheryl Culp, formerly known as Sheryl Schroeder, being the lot south of 4735 ' Cedars Road in the City of Redding, being Assessor' s Parcel No. 108-120-17, and more particularly described in said Resolution No. 81-278; and WHEREAS, notice of hearing by the Eoard of Aopeals on this abatement proceeding .has been posted on the subject property and served on the owners of •record, and - WHEREAS, on January 28 , 1982, and on February 25, 1982, public hearings were held before said Board of Appeals as provided in said Municipal Code, and. testimony received by the IIoard, and no person objecting to said ,abatement proceeding, the said Board , of Appeals found that good and sufficient cause does not exist why the unsafe and 'unsightly' buiTding on said property should not be abated, and • WHEREAS, said Board of Appeals having filed with this City Council •its report of the hearing and its recommendation for abatement, by_ rehabilitation or demolition, NOW, THEREFORE, BE IT RESOLVED by the City Council of � � the City of Redding that the report. of the Board of Appeals of the ti City of Redding of its findings that the unsafe and unsightly �+ \ -1- .,PJ�_ _"__ � ' \ . - .. , �. _ � V � _ v� building existing on property identified as A.P. No. 108-120-17 should be abated by rehabilitation or demolition, be and said report is hereby approved. BE IT FURTHER RESOLVED by the City Council that the Fire t4arshal of the City of Redding is hereby directed to abate said un- safe and unsightly condition after a period of thirty (30) days, by having the unsafe and unsightly building demolished and removed, if ' the owner fails to rehabilitate or demolish within said period, and the Fire Marshal and his authorized representatives are expressly authorized to enter upon the property for that purpose, and are directed to keep an itemized account of the cost of abatement, to be assessed against the property if not paid by the owner. BE IT FURTHER RESOLVED that a copy of this Resolution shall be served upon the property owners in. accordance with the provisions of Section 9. 36. 060 of the Redding Municipal Code, and the property owners shall have the right to have such .unsafe and . unsightly building abated at their own expense, providing the same . is done prior to the expiration of thirty (30) days.
