RESOLUTION EXPRESSING PRELIMINARY INTENT TO FORM ASSESSMENT DISTRICT AND CONDUCT SPECIAL ASSESSMENT PROCEEDINGS SUNSET WEST ASSESSMENT DISTRICT NO. 1981-4, CITY OF REDDING The City Council of the City of Redding resolves: Sunset West Partnership, ("the developer") is to undertake the construction of the following described public improvements: Public road improvements, water, sewer, storm drainage and underground utilities to serve the parcels within Sunset West Subdivision. The developer has proposed to this Council that the City Council undertake special assessment proceedings to acquire these public improvements after their completion, the cost of the acquisi- tion to be assessed on property of the developer benefiting from the improvements. The City Council accepts this proposal in principle, subject to the following conditions: 1. That the special assessment proceedings shall be taken under the Municipal Improvment Act of 1913, with improvement bonds to be issued under the Improvement Bond Act of 1915. 2. That the described improvement shall be certified by the Director of Public Works as complete and ready for acceptance before the adoption of the Resolution of Intention. 3. That the developer shall submit evidence satisfactory to this Council that the costs proposed to be assessed shall have been actually incurred and paid, and that the land proposed to be assessed 0 C����Q� 0 � shall be free of mechanics' liens resulting from the construction of the improvements. 4. A written commitment for purchase of the 1915 Act bonds in a form and on terms satisfactory to the Director of Finance of the City of Redding and bond counsel shall be submitted to the City. 5. The final subdivision map for said subdivision shall be recorded with the County Recorder of the County of Shasta. 6. Information will be submitted to the Director of Finance as required to demonstrate to the satisfaction of said Director of Finance that the amount of the assessment to be imposed on any of the lots does not exceed one-third of the estimated fair market value of such lots following installation of the improvements to be acquired by said assessment proceedings. This resolution shall in no way constitute a guarantee or assurance that the special assessment proceedings will be completed, the City Council being without jurisdiction to assure the levy of special assessments until conducting a public hearing as required by the Municipal Improvment Act of 1913. * M I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the City Council of the City of Redding, Shasta County, California, at a regular meeting thereof, held on the 8th day of September, 1981, by the following vote, to wit: AYES: Councilmembers Demsher, Fulton, Gard, Kirkpatrick NOES: Councilmembers none ABSENT: Councilmembers None ABSTAINED: Councilmembers: Pugh ETHEL A.
