RESOLUTION APPROVING AGREEMENT FOR ENGINEERING SERVICES UPPER CHURN CREEK SEWER ASSESSMENT DISTRICT NO. 1980-7 The City Council of the City of Redding resolves: This Council approves that certain agreement between the City of Redding, a municipal corporation of the State of California, and Sharrah-Nolte and Associates, for services as Engineer of Work for Upper Churn Creek Sewer Assessment District No. 1980-7, dated the 4th of May, 1981, and on file in the City Clerk's office. The Mayor is authorized to sign the agreement and the City Clerk is authorized to attest its execution. I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the City Council of the City of Redding, Shasta County, California, at a regular meeting thereof, held on the 4th day of May, 1981, by the following vote, to wit: AYES: Councilmembers Demsher, Fulton, Gard, Kirkpatrick, and Pugh NOES: Councilmembers None ABSENT: Councilmembers None ETHEL A. RICHTER, City Clerk, City of Redding, Shasta County, California Oo ROMMAL J AGREEMENT FOR ENGINEERING SERVICES UPPER CHURN CREEK SEWER ASSESSMENT DISTRICT NO. 1980-7 This is an agreement for engineering services between the City of Redding, a municipal corporation of the State of California, referred to as Client, and Sharrah-Nolte and Associates, referred to as Engineer. 1. Client retains Engineer as.Engineer of work for Upper Churn Creek Sewer Assessment District No. 1980-7 to perform the following services: (a) Preparation of a mao showing the proposed boundaries of the assessment district, in accordance with the requirements of Division 4.5 of the Streets and Highways Code. (b) Preparation of the report required by Section 10204 of the Streets and Highways Code (Municipal Improvement Act of 1913), and modification of the report if directed by the City Council. The report shall include the following: (1) Plans and specifications for the proposed improve- ment. (2) A general description of improvements to be acquired, if any, and a legal description of lands, rights-of- way, easements or other interests in real property to be acquired. (3) An estimate of the cost of the improvement, including the cost of acquisitions and all incidental expenses. (4) An assessment diagram showing the parcels of land to be assessed. (5) A proposed assessment of the total cost of the improve- ment on benefited parcels of land within the assessment district. (c) Compilation of a list of the names and addresses of all owners of land within the assessment district in accord- ance with records of the County Assessor or in accordance with title reports provided by the Client. 0 (d) Posting of notices of improvement on all open streets within the assessment district at distances not greater than 300 feet apart. Copies of the notice of improvement for posting are to be provided by the Client. (e) Construction staking. (f) Attendance at meetings of City Council, when requested by City staff, for the purpose of presenting and seeking approval of the documents and reports described in sub- paragraphs (a) and (l)) . (g) Attendance at all other public meetings of City at which matters relating to the assessment district are con- sidered, except routine matters. (h) Attendance at staff meetings or meetings of property owners upon the request of Client, after reasonable notice. (i) Telephone consultation with staff members and property owners to answer engineering questions about the assess- ment proceedings. (j) Preparation of chance orders as may be required during the course of construction. (k) Preparation of a final cost schedule after completion of the improvement and payment of all incidental expenses. 2. The services of Engineer under this agreement shall not include the following: (a) Preparation of an environmental assessment, to determine whether the improvement will have a significant impact on the environment within the meaning of the California Environmental Quality Act. (b) Preparation of an Environmental Impact Report. (c) Inspection of the work 'of Client's contractor and certifi- cation to Client of contractor's entitlement to progress payments. The performance by Engineer of services excluded by this paragraph, if required by Client, shall be under separate oral or written agreement. -2- J 3. In consideration of the services set forth in paragraph 1, Client shall pay to Engineer the following fee and costs: 12% of Construction cost for district. In no event, however, will the compensation of Engineer exceed the amount set forth by Engineer for that purpose in the Report, or any amended Report, prepared by him under Section 10204 of the Streets and Highways Code. 4. In the event said proceedings are not carried through to conclusion, or shall be abandoned, then Engineer shall receive nothing. Dated: May 4, 1931. ATTEST: ETHEL A.
