PART;-OF ,THE' HARTNELL AVENUE_ ASSESSMENT 'DISTRI_CT'. (FORCELLA PROPERTY):.: BE IT, RESOLVED by 'th'e City Council 'of the City of Red-- ed-ding, ding,as' follows Section-1. The'City.Council of the'City of Redding finds and determines that-. the public•convenien'' and necessity. require •the'construction and maintenance by the. City of Redding of- public," -,..improvements, to wit,,'-the extension':of Hartnell Avenue and related drainage and sewer and water.,f'acilities; as part of, the. Hartnell Avenue Assessment..Dis'trict, and Government;Code Section 3.7350.,5.; authorizes tjie `City' to :acquire the necessary` Te 'al property interests: for said public improvements-by'.eminent-domain. ; Section-12.. .. The . City Council- finds and;, determines that the* subject.proj.eet has been .planned •and is ,to *,be *located in -the manner that- will-.be� most compatible with the .'greatest public-'good .and -the ;least ,private. injury.. Section T..,•In compliance with`CEQA requirements, the Council-has reviewed the finale Environmental-Impact Report'prepared.- for`.this project, and has found that changes'gr alterations have' been required in, or incorporated into, such. project/, which miti-• gate or avoid.the significant environmental--effects thereof as'- • identified in:-the. final EIR.: Section 4. The City Council also finds and determines that the acquisition of the property interests described'in "Exhibit A attached' hereto;. situate- in the City, of, ;Redding, \ County of Shasta, State'of;California; is necessary for .the con- :struc-tion and maintenance' of* they, afaresaid pu-b.lic. -.improvements,.' and .that the' ,taking of: said;,property interests• is necessary `therefor. Section 5.? The - City Attorney of the City of Redding is hereby authorized,.- empowered and directed'to:- 1. Commence an action or actions in eminent domain in the Superior Court of the State'of California, in and fo•rthe County.. of Shasta, •in the name of the City of Redding, to acquire_ the necessary property interests. 2 To incur in .the name. -of .tlie ,City of Redd ng:.anl on behalf thereof,, all. obligations and-expenses•necessary-to acquire the' above,'mentioned property.,interests.
