HomeMy WebLinkAboutReso 2023-131 - Declaring Approx. 90 Acres of Property Located at 7501 Eastside Road (APN 050-040-010) as Surplus Property, subject to the Retention of any EasementRESOLUTION NO.2023-131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING APPROXIMATELY 90 ACRES OF PROPERTY LOCATED AT 7501 EASTSIDE ROAD (APN 050-040- 010) AS SURPLUS PROPERTY, SUBJECT TO THE RETENTION OF ANY EASEMENT(S), IF REQUIRED, FOR PUBLIC SERVICE UTILITIES AND FINDING THIS ACTION TO BE CATEGORICALLY EXEMPT FROM REVIEW UNDER CEQA GUIDELINES SECTION 15061 COMMON SENSE EXEMPTION WHEREAS, the City owns property located at 7501 Eastside Road, approximately 90 acres (the "Property") as depicted on Exhibit A, attached and incorporated herein; and WHEREAS, portions of the Property are used for the Clear Creek Wastewater Treatment Plant and hold wastewater treatment ponds; and WHEREAS, the City has determined that there is not a need to retain the whole designated parcel for public purposes as future expansion will not occur in this space; and WHEREAS, the neighboring parcel to the North is currently owned by the City of Redding and used by the Clear Creek Wastewater Treatment Plant, and the property to the South is owned and operated by Haven Humane Society; and WHEREAS, any sale of the subject Property would require, if necessary, the retention of an easement(s) for public service purposes; and WHEREAS, the California Surplus Land Act (California Government Code sections 54220- 54234, inclusive) provides procedures for local governmental entities to follow regarding the sale or long-term lease of City -owned property; and WHEREAS, Government Code section 54221(b)(1) provides that the City Council must take formal action by resolution at a regular public meeting to declare the Property surplus or exempt surplus before it may take any action to dispose of the Property; and WHEREAS, pursuant to Government Code section 54221(b)(1), property may be considered surplus if it is "not necessary for agency use;" NOW, THEREFORE, THE CITY COUNCIL HEREBY FINDS, RESOLVES, AND ORDERS as follows: 1. The above recitals are true and correct and are hereby adopted as findings of fact and law. 2. The Property is hereby declared surplus, subject to the retention of an easement(s), if required, for public service purposes. 3. The City Manager is authorized and directed to issue a notice of availability of the Property for sale or lease pursuant to the Surplus Land Act. 4. Declaring the Property as surplus is categorically exempt from review under the California Environmental Quality Act Guidelines Section 15061 (Common Sense Exemption).
