The Pledge of Allegiance to the Flag was led by Personnel and Labor Relations Director Reynolds. The invocation was offered by the Reverend Charles Mellor of the Seventh Day Adventist Church. The meeting was called to order at 7:00 P.M. by Mayor Fulton with the following Councilmen present: Anderson, Gard, Pugh, and Fulton Absent: Councilman Demsher Also present were Assistant City Manager Courtney, Public Works Director Arness, Planning and Community Development Director Harris, Police Chief Whitmer, Personnel and Labor Relations Director Reynolds, Housing Administrator Henson, City Clerk Brayton, Para' - Legal Technician Hastings, and Associate Civil Engineer Hastings. APPROVAL OF MINUTES MOTION: Made by Councilman Pugh, seconded by Councilwoman Gard approving the minutes of the regular meeting of June 20, 1977 as mailed to each Councilman. The Vote: Unanimous Ayes CORRECTION OF MINUTES MOTION: Made by Councilman Pugh, seconded by Councilwoman Gard correcting the minutes of the regular meeting of June 6, 1977 by the addition of the following motion: ''.OAKVUE SUBDIVISION 11 MOTION: Made by Councilman Pugh, seconded by Councilman f j�lJV1 Demsher accepting the improvements in Oakvue Subdivision for maintenance and operation, and instructing the City Clerk to return the payment and performance bonds to the developers. NICHOLAS; WARD; MIRA VISTA STREET ASSESSMENT DISTRICT Associate Civil Engineer Hastings advised Council that petitions for complete street improvements and incidental utility installations have been received from property owners in three non-contiguous areas of the City, and it has been determined to form one assessment district to include all three areas. This will result in a savings to the property owners involved. The areas were shown on the Vu Graph. DANA DRIVE AND VICTOR.AVENUE ASSESSMENT DISTRICT 1977-1 Bond Counsel Sam Sperry submitted Resolution No. 77-112 for Council consideration, noting that this resolution is to eliminate any prospective attack on the proceedings, either at the time of the public hearing or thereafter, in connection with the fact that there is currently pending an appeal in the lawsuit which challenges the annexation of the territory of the former Enterprise Public Utility District to the City. AGREEMENT - Engineering Services - Linden Avenue Improvements Councilman Pugh abstained from discussion and voting on this item. Gelonek and Affiliates for engineering services re Linden Neighborhood `, 4 Preservation Program, and authorizing the Mayor to execute same on >r / behalf of the City. The Vote: Unanimous Ayes with Councilman Pugh abstaining ENTERPRISE ANNEXATION REQUESTS - Nos. 10 and 11 Planning and Community Development Director Harris reviewed his memorandum to Council dated June 30, 1977 re Enterprise Annexations Nos. 10 and 11, which memorandum is made a part of these minutes by reference. A Vu Graph was shown depicting the location of the properties C involved. Mr. Harris reported that the Planning Commission has re- J viewed these requests and it is the recommendation of the Commission that these two requests be combined as a single annexation and that the intervening narrow strip of property and the 42 acres of the EPUD sewer treatment plant now outside the City be included in the annexation. Mr. Harris stated that the Commission was aware that such an annexation would create an island of unincorporated territory to the north; however, the Commission felt that this area would ultimately request annexation. If the remainder of the area in the island were included in this annexation, it would probably be necessary to have an inhabited election, since there are nine dwelling units in that area. The Commission was of the opinion that, while it is desirable not to have islands, it may be necessary .in some instances if the City is to accomplish a program of developing a reasonable boundary. 174 In a discussion of this matter it was noted that there are two parcels fronting on Churn Creek Road and Rancho Road, adjacent to but not included in the annexation. It was the feeling of Council that these two parcels should be included in the annexation to provide a more reasonable boundary line. MOTION: Made by Councilman Anderson, seconded by Councilwoman Gard approving the recommendation re annexation and also including the, two parcels fronting on Churn Creek Road and Rancho Road adjacent to the annexation to provide a more reasonable boundary line. The Vote: Unanimous Ayes with Councilman Pugh abstaining. RESOLUTION - re Application for City's Community Crime Resistance Program MOTION: Made by Councilman Anderson, seconded by Councilman Pugh that Resolution No. 77-117 be adopted, a resolution of the City Council of the City of Redding authorizing the City Manager to file an application for grant for law enforcement purposes for funding the City's Community Crime Resistance Program, Project No. 2582-2-77. PUBLIC WORKS PLANNING REPORTS �i Public Works Director Arness submitted the Public Works Planning Reports for July 1977. PUBLIC HEARING - 1977-78 Budget and Proposed Uses of Revenue Sharing Funds and Setting of 1977-78 Tax Rate The hour of 7:30 P.M. having arrived, Mayor Fulton opened the d� Public Hearing re 1977-78 Budget and Proposed Uses of Revenue I� Sharing Funds and Setting of 1977-78 Tax Rate. The following documents are on file in the office of the City Clerk: i� Affidavit of Publication -',Notice of Public Hearing J Memorandums from Assistant City Manager dated June 9, 1977 and June 10, 1977 The City Clerk advised Council that no written protests had been filed, and the Mayor ascertained that there were no protests from the floor. Assistant City Manager Courtney advised Council that this Public Hearing and the June 8, 1977 Revenue Sharing Committee Public Hearing are required as a result of amendments to the Revenue Sharing law effective January 1, 1977. Mr. Courtney reviewed his memorandums to Council dated June 9, 1977 and June 10, 1977, which memorandums and attachments are made a part of these minutes by reference.
